I have purchased land in North Florida west of Gainesville and have similar issues with using my property for intended purposes ....
My question is, couldn't you ask the county for a variance to build a second home on your 19+- acres... after everything you have done to get to where you are, I wouldn't see why they wouldn't consider it...

It sounds like your local principalities are trying to control you and your property and what you do there. I have heard this from so many people so many homesteaders online it’s absolutely unbelievable.
Its a density issue and Florida is being ruined by development.
I have built over 40 homes in Northwest Florida and very much understand how the building departments can be. A solution to your situation would be to connect the two homes with a open walkway on the plans. that would make the two houses one dwelling. after the house is built and inspected, and you have your certificate occupancy, you can take down that walkway and have two homes.
You could also connect the detached garage and dream home with a covered walkway and, as long as it’s still over 3200 square feet, that should take care of the issue as well.

You own no property, slaves can't own property. Read the Deed to the property that you think is yours. You are listed as a Tenant. (Senate Document 43, 73rd Congress 1st Session)
The state owns everything besides the government. I see why these people don't want us to pay off anything. So these same people can have someone come out take it's, have the IRS/ uncle Sam at our throat. The only thing we own is ourself. Like saying my saying, " we're all born with nothing, and we die with nothing." Because the government will try to take or take it.

Another option that occurred to me is will your neighbor sell you .5 acre or whatever you need to be a full 20? Just a thought.

Same, this was my first thought. As small town, they may be willing to let go .5 acres. Especially, the neighbor with 1,600 acres.
But their work around sounds good too.
I thought,slept the property in two, and sell it to your inlaws, have your wife be the beneficiary in their will. 🤷🏻♀️ Now you have two ten acres and can build everything you need. 😂 Use one of the ten acres for a campground. You can't have enough campgrounds in FL
Go before the Zoning Board of Appeal and request a variance.

This process happens often in my jurisdiction. I would pursue it. The couple who never took a chance, never had a chance!
I was going to say the same thing. Not sure the rules there, but there may be a process to request a zoning variance. It's pretty common in most places with zoning regulations.
In our jurisdiction, client proceed through the Metropolitan Planning Commission. Your area may call it something different.
@@PineyGroveHomestead Men and women are different. If you go to a woman planner, she will fully comply with the rules. A man will try to think creatively think of how to solve the problem. Sorry gals, but while there may be exceptions, this is generally true. I have the same issue in a rural Arizona county. None of the neighbors would have an issue with it, but the county can’t possibly think for a second that they are there to SERVE the public.
Same EXACT thing happened to my wife and I in Columbia County, FL. They finally figured out a work around, but had to break some rules to get it done for us. Thank God we live in a rural County that had good people that made exceptions for us.

Columbia county is so disorganized. They can't make up their minds and the board of county commissioners can't get their act together.

extend the house which you built for your parents; either sharing the walls somehow, or place your house right next to it with a beautiful room connecting them into one house.. and then it becomes one house - one enormous house.. with a large room between - could make it a nice shared space full of plants

My exact thought
Have you ever heard of Grandfather Clause. This sounds like a perfect example of the clause, you gave the county a site plan with everything on it, they made the option of removing the main house with the option of adding it back when you were ready to build, then codes changed. If you can prove the original terms in that meeting, sounds like you might have option to do the original plan.

@@Jack-jp6ki Nope. The rules changed before they built. It happens all the time. What is no problem today is an issue next week. In my county all new home construction now needs to have very expensive systems to control water runoff. Not the case 20 years agon when I built.
I just learned the hard way too here in NC. Wanted to put a modular on a small corner of my 90 acres. There had been singlewides and 2 abandoned wells and septics but all removed in the 1980’s… so I went to get permits and was told no, only one dwelling. On 90 acres…. So had to subdivide and deed to myself to get it done… added 8 months to the simple process of bring family onto my land… i totally get ya, praying for you both.
That makes zero sense since the dwellings happened anyways.....just added to you the cost of a survey and deeding for no reason! Crazy! Glad you found a solution.

Here in Citrus county Florida I have seen so many variances rubber stamped. Get a knowledgeable attorney and apply for a variance. Were rules changed after you land purchase ? If so you should be grandfathered in.

Although I have no plans to fence in my property, I would like to fence in some areas as well as put up a fence to create a buffer at the road. I found out that to do this, I would have to pull a permit and then hire a professional fence contractor to put up my fence. I have decided that instead of fencing that I’m going to use plantings to give me that buffer at the road. It isn’t as though I live in the city limits either. I purposely bought a couple of acres in the country. Sometimes I wonder why we are allowed to purchase land because it certainly isn’t ours. A can of worms that we will never find our way out of.

I began asking our building dept if they can show me in the United States Constitution that they have the authority to tell me what I can and cannot do on my own property> Silence. You are the sovereign owner of that land so you need to tell them what your going to do. I built a large barn and a 2200sq ft house, the county attached a non compliance notice on my property but that is it. You do not need their permission. The constitution is there to protect we the people from an over reaching government.
Except you're not the sovereign owner, stop paying the government their 'use fee' and watch how quickly they send the thugs with guns and badges to take it.
Try to sell that property later. It will be unsalavable and you may be racking up fines. One day they can auction your place out from under you.
The US Constitution directs and restrains the Federal gov. Your state and county gov fill in the void.
The only thing you can own in USA - your ability and the skill to speculate financially and evading the law legally. This is the most precious asset that is truly yours. Everything else is subject to change by the speculators on the top of food chain

Please make sure to get from the county in writing that you can build the two car garages attached to the house and be counted as square feet of a home structure. Also get in writing that your parents home will be changed to a secondary structure or whatever needs to be.
Have everything you need as far as proper paperwork ready before you build your home. I would make sure my parents home is changed before starting your own, and also that the county is not going to kick them out because they will be living in a secondary structure which usually means it is a structure for hay, farm equipment, animal's shelter and so on and so forth.

Here in Florida St Lucie County, AG 5 zoning 10.23 acres. We can have 1 home per 5 acres. that's terrible. Government overreach is getting out of control. Don't take what the first person says. Go higher up. Answer seems to change we've been through a lot of things.

Where I live we have the same roles. We had a similar issue. Our county includes covered walkways between sections of the structures. We added a covered walkway to our garage and a covered walkway to a gazebo. Maybe that can work for you and not need to change the buildings.

We chose SC for our dream home.
We bought 14 acres of cleared farmland.
Our lot is practically flat, trees around the edges, no trrees anywhere else except all the fruit trees and nut trees we added.
We built an amazing glass house with an incredible mountain view and added a small pond.
We pay $100 a year for property taxes.
Try that in Florida.
If you decide to move, try SC.

We will probably be about $10k plus a year once our house is built.
We build our own place in Alaska with views of the mountains in the east and west with a low horizon to the south. We only needed a driveway permit. Taxes are more than $100, but no sales or income taxes. We pay about $500 a year on a house the government appraises at about $300K , the real estate value is substantially more.
Some counties in SC are much higher
I went through a very similar situation in building on some family land in Indiana. The area plan commission is a nightmare to work with. However, there is some good hope for you. I have two suggestions:
1. Go back and talk to someone else. My experience is the left hand doesn't know what the right is doing in that office and if you speak to three different people then you will get three different answers.
2. If #1 doesn't work, hire a good land attorney from that county. They can make things happen that you can't. It will likely involve a variance but it could be easier than that. I think you can stick with your original plan by doing these two things. I would be glad to talk to you about how we had to do things.
Thanks for the advice. It's a small county and there are 3 people in the office and we have communicated with all three. A variance or lawyer would likely cost more in money or time than adding a garage. We're working with the drafter and builder now to see how much this change will cost us. Thanks for watching!

Here is a Clue... You are nothing but TAX Chattel. As a Resident of Northern Virginia, Loudoun County, I am quite familiar with the Virginia TAXES. If my children & grand children did not live here I would be in South Carolina.
We just need more Government. The Government needs More of your Money, More Rules, & More Laws! That would solve all the Governments Problems.

Ohhhh, my sister in law built a home and a smaller mother-in-law house on the same property…they were only allowed it by having a large back driveway and then a “breezeway with sidewalk” attached to it in order to consider it part of the same “foot print.” That was their way of being able to have the separate structures but considered one footprint…

When we were looking for land a month ago, we knew the florida requirement of one dwelling per 10 acres, in AG2. In one spot we were looking was a divided to 5 acre plot from 10acres in AG2. Too small for us, BUT a variance was an option. You can APPLY for a variance on this-it is an occupancy variance. There is also a florida law that you can only have so many out buildings per acre-but I think that is going to be repealed. In the meantime, you need apply for a variance. You may be turned down, but it is worth a shot. Another option-add on to the existing house.
The "accessory structures" was a county limitation but it has since been repealed. We are working towards a solution. Thanks for watching!

Add a second story den with guest room with a deck to overlook your property...that will add to the SqFt. Another added SqFt option would be to build an attached 3 car-garage with a small 'apartment' above it as to not take away from your original house plans for your children to visit. Where I live in Calhoun County, Florida folks who live on 10 acres put 2 or 3 mobile homes on them and Tiny shed houses. The same 10 acre rule. I don't know how they get by with it. Your property is beautiful. I pray y'all get everything worked out.
Calhoun is a different county....not sure of their laws and land plan. And sometimes people just do things and don't ask and never get caught. We are not that lucky, so we try to do it right! Thanks for watching.

Also check what will be the taxes on a house of 3200 Sqft, all this will increase the living costs in the end with the attached garage.
What is wrong with 2-3 mobile homes on 10 acres, plenty space for that, use to live in Blountstown many years ago when I was in grade school with my uncle Homer who has passed away now, wasn't much to the town back then in the late 70s

A good local realtor should have been able to help you with your purchase and let you know about the one home per 10 acres code. I'm glad you figured out a solution and can continue your dream.
@Piney Grove Homestead. Submit a variance in front of the County PLANNING BOARD, then it goes to COUNTY COMMISSION in Florida. There is a fee for a variance. Best thing you can do is speak to your neighbors ahead of time and see if they will either testify at the hearing that they have no issue OR get a written letter signed and notified and read into the record by someone. Also, research all the variances in your area and have a list of them to submit to the county at the hearing, What about a barndominium?

Yup I see so many UA-cam's do this by a piece of land and then they can't build what they want to build because they didn't bother to check city ordinances. It's the first thing you check before you even look at buying land. Always buy land where you can build with no restrictions

We almost bought a beautiful piece of land in FL but it was just shy of the 2.5 acres needed to build. Researched the variance that also cost around $2500 and there is no guarantee it would be approved. Then we found out the county miss measured and the plot was actually 3.5 acres 😮 .5 is the road. THEN once we were going to move forward we found out that the lenders require a private road agreement that is nonexistent!!! We have passed on the property, meanwhile 20 acres away they are mowing down every tree to put in multi family! It all seems like a huge racket! Best wishes on your future plans, I’ll be watching. 🍀

Build a large, attached carport, unheated, say for three vehicles. One side is house, one side is entrance, build a half-wall around the two open sides for esthetics. That would increase the home's footprint at minimal cost and the vehicles would be protected.

If zoned farm your parents can be a hired hands quarters. Your land measurements also always counts the portion you gave county for road frontage when divided. You need an experienced land development company.

Seminole county ( Orlando area) has the same regulations
(Part XXIV, § 2, Ord. No. 92-5, 3-30-92). These are old local regulations that applies to most Florida counties.

It's called an ADU ( accessory dwelling unit). Florida allows them no as long as the ADU is 50% smaller. Makes no difference which one is built 1st. I'm kinda surprised this was missed when looking at zoning. A quick look at property appraiser website would show how many units per acre.
I’m really sorry about the restrictions. We are also building a MIL suite on our property but in the way of a dog trot on the house vice two separate homes.

Subscribed, very interesting story. Government making everything complicated. We are in a similar position in Washington County Florida. The counties have different restrictions because we have 2.5 acres. We can "build" a second dwelling, but we can't bring in a pre-built. Even if it is a typical 2x4 wooden structure built off site exactly to the same design and trucked in. If we rezone to residential then we can. So, we are buying a really nice older 5th wheel camper. And when people come to stay with us, it be comes our guest house. We could add on to our existing house, but that is really expensive for reasons I won't get into. Good luck with your dream!

We live in “Westwego” LA and small unincorporated city. But it’s not “Westwego” out zip code covers 4 towns
We had to “subdivide” 3 lots into one and hoping to get building percent to move the shell of the tiny home on a concrete pad and add 100sqft to it to make it compliant with the city codes.
Ugh! We get your frustrations.

I'm in michigan and went through a similar situation a couple years ago. I wanted to build a pole barn, but the township said my detached garage was an accessory structure as well as my deck, pool, and small greenhouse. We are only allowed 2,500 square feet of accessory structure REGARLESS of how much land you own. My solution was to connect my house to me detached garage thus making the detached garage a part of the primary structure. These zoning ordinances are way beyond protecting property values.

There is something similar in Oregon where if you have 5-acres but less than 20 it’s considered farm forest and you can’t get a residential permit. You can build an agricultural building but that’s it. You can try to get the land rezoned but 5k is the minimum starting cost and it was pretty obvious that you better hire a land use consultant and getting your request approved is less than 50-50

You could always add a bonus room above the garage if it needs to be conditioned space.
Our house has an attached garage "under air"; it is insulated and was originallly heated. When we put in the new heating system the contractor removed the "heat" ducts and left ONE vent that complies with the "under air" stipulation. We only heat 1340 sq ft of a 1960 sq ft house. When we sell (or our kids do when we pass) all it will take to bring it back up to 1960 sq ft is to add back in the ductwork.

I build houses on rural country acreages and it's frustrating because there are so many things to trip you up and the county doesn't always go out of their way to help you, it feels like they're more trying to stop you. Really they are in CYA mode because they have to follow some very specific and arcane rules put in place. It's really the zoning rules that drive up property prices, it creates an artificially low supply of buildable country properties.
I've had to go in front of the county commission before with members of the public, aka neighbors. The majority of the neighbors were happy that I was going to replace an old rotten shop building with a nice new 1000 sf home, except for one lady who owned land in the neighborhood, but didn't want a new house built, just because.
I did good approval because the county was supportive, that really helped.

I remember hearing someone with the same problem yrs. Ago & I think they got a letter from all their surrounding neighbors & some county officials/politicians? giving them a waiver to some of the zoning rules??
Also, could you build a large addition to the smaller house &/or maybe look for an even nicer place?

Retired, in my case, means I worked for years in the real estate legal & construction side of land & construction investments. Both residential & commercial projects. I had to write this three times to tone down my commentary. Go back to the point where you two began and see where you missed out on "what you should have done". The answer is right there. Most building departments have Variance Request form. The process of getting approved can be painful Ie certified letters to neighbors and public hearing. Most builders use local lawyers. Also a detailed site survey might help. Although it might be cheaper to in large the current home

I would ask for a variance first. My neighbor in Bay County Florida had to do this recently and was given the variance to build even with many neighbors expressing their concerns against the issuing of the variance. I have personally applied for a variance in henry county Alabama to build a house and found the process to be quite simple it just took a little time.

Go back to zoning, ask for the variance paperwork.
Its a simple process, as long as you dont get public pushback by neighbors you will get approved. A real-estate lawyer is definitely recommended.

I know some homes in GA where they created an enclosed patio/breezeway between the house and garage to satisfy zoning sqft requirements. I know FL has stricter rules but something like that could increase sqft but not necessarily heating/cooling cost. Technically it is just a large screened in porch.

okay, code planning issues. Got it. After watching the video, giving it a thumbs-up, started thinking about it. You need to add 1,100sf to your plans. A standard 2 car garage is 24 x24 =576sf. A standard 3 car garage is 24 x 36 = 1,296sf. Heating a garage is optional. When the cost of a detached garage is added to the overall cost, it doesn't make sense. I know you want what you want, I truly get that. As good people, you know that we make plans, and God may have other ideas.
