This entire case is a complete mess. The parents of those girls should be outraged at the incompetence (or intentional shenanigans).

When a defendant destroys evidence, the jury is instructed to hold that destroyed evidence as being detrimental to the defendant's case. If it doesn't apply the other way, that's BS. Because it should. The cops destroyed those videos because it harmed their case. And that judge facilitated the destruction of evidence. Whether Richard did it or not, this is disgusting. Throw out the prosecutor, throw out the judge, throw out everything. It's all garbage now. If a NEW prosecutor can find reason to bring the case against him before a NEW judge, so be it. But not this lot.

Yes; it should be the same both ways... but:
If I was setting the standard, the automatic presumption that the evidence is detrimental to the side that destroyed it (regardless of which side that was) would require some level of evidence (preponderance?) that the destruction was intentional and that they did or should have known it was relevant. Lacking that, I'd just let the other side establish in court that it was destroyed and let the jury decide for itself what that implies.
Except he would have a new trial but still be without the exculpatory evidence that was destroyed. That is so wrong.

On the face of it, the individuals whose interviews were lost were much more suspicious than the pharmacy tech they arrested.
He probably refused to hand over the Sudafed one day when he had to cover for a sick call or breaks.

When you add in why the defence team was thrown off the case and the dressing down they got from the judge it looks more and more like this was all intentional. If the defence team can tie anyone in that police force or the prosecutor's office to that cult even incidentally then the case needs to be dismissed.
I know the Odinist thing seems eye rolling worthy but the more I hear about it, the more I wonder. Richard Allen now has FOUR lawyers claiming the same thing. The lawyers that the judge replaced the original ones with have said the same thing.

When I first heard the claim about Odinist prison guards, I rolled my eyes thinking the defense had really over-reached by making such a ridiculous claim. I can't comment on the Defendant's guilt or innocence. However, the amount of issues before this has even gone to trial tells me that any conviction is likely to be incredibly unsafe. I'm astounded at some of the things that have happened in this case.
There's so much going on with this case that seems wrong. Between the judge and the prosecutor this isn't looking like it will be a fair trial at all.
It does a disservice to the victims and I think that gets lost in the ferver to put someone in prison.
This is scary. But it is also one of the many cases where a man goes to prison because the authorities who are tasked with finding the truth are more intent on getting a conviction,any conviction. That should not be the definition of a successful close to a case. The victims deserve better. We all do. And we need to take a closer look at the failure of the machinery and see why this happens so often.

When you consider that your average government employee is working at a job that it’s almost impossible to get fired from, earning in some cases less than half what they could in the equivalent private sector job, you come to realize that they’re not the brightest bulbs.
I find it hard to believe that someone who could make buckets of money in the private sector would choose to make what a government lawyer does, so most prosecutors are probably sub par lawyers.
The most frightening sentence is "I'm from the government and I am here to help"

@@ThatGuy182545 You ignore that those "buckets of money" are doing things like defending DuPont from the legal liability of poisoning the groundwater -- given those options, I'd bet a lot of folks (even some of the 'brighter bulbs') would go with the lower pay if it meant they didn't have to smother their conscience.

Ian, I’m pro law enforcement but this case is riddled with errors and everything seems to stink! I don’t know if RA is guilty but at this point with the actions of the judge and the DA I’m leaning the other way! Those poor girls and their families need justice!

I to tend to be pro law enforcement, but supporting law enforcement sometimes involves tossing some bad apples to preserve the rest. Be it malice or incompetence, I'm thinking someone's needs to be called on the carpet here to answer for what's going down.

Going in with just this, it feels more like a particularly shady prosecutor and possibly shady cops.
Imo, the judge may be biased towards the prosecutor, but that feels more like the judge maybe just being manipulated by someone who's trying to win.

There is no valid reason to overwrite a recording relevant to an open or appealable case without archiving a copy. This isn't rocket science.

It's a huge case, and those were the main suspects in 2017. There has to have been a back up.
I'm a security manager. That's not how DVR's worked. There's no "programming" error to be made. I know nothing about the case (other than finishing another great Runkle video!) and the guy could be guilty as charged but I know BS when I hear it.
I read it as, "oopsie, we didn't mark that for retention." It sounds unlikely. While it wouldn't technically be a programming error, novices used to "program" the DVR at home. Semantically, it's a novice statement. Logically, who ignores evidentiary rules on their biggest case?
As the owner of an IT services firm who makes most of their money on surveillance setups - no matter how cheap your system, (A) glitches don’t work that way. They did with tape back in the day, and my guess is they have used this “excuse” in the past and are dumb enough to think it applies to digital, or (B) they had this time period alone on a drive that was not properly backed up or raided - something EVERY NVR has setup with the click of a button, which would be negligent at true.
Here the problem with (B) - drives don’t work like that where a glitch overwrites a very specific area. If they lost that data, they would have lost a LOT of data. Also, the idea that these interviews weren’t immediately exported to transfer to a DA seems ludicrous.
The idea of overwriting the data is possible, but to put this in perspective, most offices I run surveillance in that have 10+ 4K cameras take months or years to overwrite data, and generally anything with a person in it is protected from that (as you would presume interview room recording would be). The number of things to go wrong for this to happen are… a lot.
There are too many strange happenings in this case. From how they are treating Richard Allen (holding him in prison, Odinists guards watching him) to the Judge denying motions without hearings, and now this! I just want the right person/people held accountable.
Honestly, I’m not surprised by this, it seems the whole investigation has been a disaster from the start.

The families of these 2 girls deserve justice and Richard Allen deserves a fair trial. It seems the State of Indiana wants a conviction in this case no matter the cost. I’m VERY concerned he’s innocent, and is being railroaded. I think the guilty man died while they fumbled & they NEED someone to prosecute. I think the police in charge are too emotionally involved and can’t see what they are doing. The judge should be removed from the bench, for her behavior, imo.
This one bothers me. I don't want there to be any doubt when the person that did this is prosecuted whether it's Allen or someone else. This is about justice for Libby and Abby and about the reassurance that our neighborhood is safe for our kids. It bothers me that any evidence might be missing. While I have extreme doubts about the defense lawyers theory of the case, I don't want doubt. Not an inch.
Take a look at a picture of Brad Holder and see how much he also looks just like bridge guy… and he’s into that Odin crap. Something is going on in this case and it’s just not right!

If this was the only issue with this case I’d be able to get over it. But it’s bad all around. Starting from the police not preserving sticks from the crime scene & conservation officer losing tape of first interview with Richard Allen. And there’s more. Much much more. It’s bad. And it only gets worse.

What was the police department using to video the testimony, super 8 film? How can they possibly expect people to believe this? Our cell phones can NOT film 'over' a video. It has to be removed if you need the use the space.

So many things on this case make me go what the hell? Lost evidence, claims of major mistreatment, throwing his defense off for no good reason, the defense team being reinstated but with same judge who tossed them...sorry something's bad in the buttermilk. I'm not normally into conspiracy theories but man does it scream conspiracy theory to me.
Odinist is not a religious group or even a racial group, it is just a prison gang ie organized crime. If you view it from the standpoint of organized crime then everything snaps into place. I would look for reasons they wanted to punish one or more of the parent of these girls.

They got thrown off because their argument is that the guys who's tapes were destroyed are part of an occult cult doing ritual killings. The other person pointed out the group is a criminal gang, but the defense team doesn't seem to know that.

For a long time something has been suspicious about this case to me.
I’m so happy that RA has his attorneys back. They are looking under every rock and doing whatever they can for his defense. These are the type of defense attorneys I would want to defend me (though I hope I won’t ever need it)
I had Rossi as an attorney for an OWI (controlled substance) case back in the mid 00s. It was a first offense case. He was a fairly new attorney at the time.
He managed to get it dropped despite lab work supporting the prosecution and failed field sobriety tests. He found that the cop admitted to not being properly trained to perform the vertical gaze nystagmus test for a case involving an arrest after mine, issues with when I was mirandized, and some other issues to get the prosecutor drop the case.
It seems he hasn't lost his passion for defending his clients and for holding the police accountable in the almost 2 decades since then.

on 9/20/2017, the State claims interview videos older than exactly seven months were overwritten. I have seen 6 month retention; I have seen 12 month retention. A 7 month retention, while possible, is highly unusual.

I think that if there is a 6 month overwrite period then 7 months isn’t actually that unlikely; overwriting takes time to achieve. Lower rates of recording over a period can prolong the likelihood of retention even when the system has marked that space for use.

Nope. If it's relevant to an active case it should be preserved until the case is resolved. It's a safe bet, if they had a recording of this guy confessing, it would be saved for YEARS and played at his trial. If they do have a 6-month retention policy, it is just a license to dispose of any recording they want to get rid of.
And Why the F wouldn’t they have redundancy and multiple copies of key evidence in the biggest case they will ever handle?!?!

All that comes to my mind, each time I hear about this case, are the families of those murdered children. Their parents, brothers, sisters…and what this dysfunctional case is doing to them. All they want is justice, and instead are met with incompetence, sloppy work, and likely misconduct. I can’t imagine what this is doing to them. I am just BEYOND angry for them.
Similar to the Becky Hill issues, there can only be so much smoke before there must be a fire. The case against Richard Allen, it's getting really hard to breathe if you get near it. I'd like to think that we, as a society, would be more worried about getting it right, not just a conviction to close the case. I’m so glad you’re keeping an eye on this case. It is absolutely OFF THE RAILS. I have believed since day one that the evidence against RA is minuscule - at least the evidence they’ve made public. Now, if they can prove his guilt, sure, lock him away. But … does the Prosecutor’s Office have it? I suppose we’ll have to wait and see.

The loss of the recording and the absence of a recording of the other interview should weigh very heavily, and is very troubling. If I were a juror, I would be extremely reluctant to convict someone and deprive them of their freedom when such recordings should have been available and weren't. Every interview, every single one, should be recorded and every precaution taken to preserve such recordings. The very fact that they aren't available would say to careful jurors that there is an enormous problem the prosecution will have to overcome.
You're assuming that the judge is going to allow the defence to tell the jury that these interview records ever existed. I suspect that the prosecutions next move will be to ask for them to be excluded so as not to confuse the jury with facts not in evidence.
The picking of the jury will be painful and since evidence has already been discovered to have been tampered with possibly but probably, I fear for that jury. Seriously.

In a very real way,it doesn’t matter if the accused did it or not in as much as he is still entitled to a full and vigorous defense…which he is quite possibly (now) not going to be able to receive. I don’t know. If I was being charged with a horrific crime that could land me in prison FOREVER,I’d be pretty choked to learn that cops and a prosecutor “misplaced” or “accidentally” destroyed evidence that could cast some doubt on my guilt.

You are right. They planned for a Dvd to overwritten so they can set up Allen 6 years later, by destroying evidences, of which there are transcripts, from suspects that have alibis. Both multible witnesses and electronic devices.

so many think that asking for your attorney if you're innocent makes you LOOK guilty.. but defense attorneys will tell you to ASK for ONE ESPECIALLY if you're innocent. Interviews are never beneficial without an attorney. A prosecutor CANNOT tell a jury "when we tried to interview him.. he asked for counsel!" compared to a prosecutor telling a jury EVERYTHING you told them in an interview.

We can safely say, not a coincidence.
I think they should have whoever overwritten the drive... should be in the court, to find out the details how/why that data was overwritten, under oath. All involved with it should at least lose any seniority for the year, and a written reprimand for the failure to preserve the evidence. The fact the data could not be recovered... me as an IT professional, means it was more than an "Oops" overwrite. Those can be recovered from. It sounds more like the data was erased, then had some sort of secure wipe run multiple times to wipe it out. I think the fact of there being an interview but the data was destroyed should be told to the jury if it goes that far.
The police need to have it cause them issues with cases, and give doubt when they lose evidence, if the case which it contains goes forward. There are way too many cases of wrongful convictions.

In my stae of Queensland, Australia all formal interviews are recorded on both an audio and a video device and the person interviewed is given a copy of the audio recording immediately after the interview. If said recordings do not exist is very difficult to obtain a convicton.
I am highly inclined to dismiss anything that even remotely resembles a conspiracy theory. I just don’t find them credible in nearly 100% of cases. And I’m fully aware of the difficulties in keeping things secret. The more people involved the less likely something is to remain hidden. So most medium or large scale conspiracies can be written off because it simply isn’t plausible that no one would’ve spoken out.
That being said, this whole thing stinks of a conspiracy to convict RA. I’m not suggesting whether he’s innocent or guilty. I have no idea. But that is immaterial to my point. It really looks like law enforcement, the prosecutors and the judge have decided to ensure RA is convicted, robbing him of his right to a fair trial. If they succeed at getting a conviction against him, I cannot see it not being overturned eventually
I think the whole thing has to be halted. They need to remove the prosecutors and the judge. A special prosecutor and a new judge need to be appointed to examine everything that has happened so far and make an independent determination as to how to proceed, if at all
It’s really sad when widespread incompetence is the most charitable explanation for the actions of the justice system. But I’m really worried that the explanation is in fact far more nefarious than mere incompetence

Surely, any PCA is a conspiracy theory; the theory the state makes against the suspect for probable cause affidavit.

Prior to it, actually, the evidence suggests that the main crime actually took place 12 hours earlier...

I run an IT services shop for small businesses. There absolutely is a scenario where digital recordings can be overwritten, but so many things have to go wrong:
(A) there has to have been no backups of police interviews (unlikely)
(B) the interview room cameras would have had to been explicitly configured to be “non-essential” in the NVR and allowed to be written over when the drive(s) were full (unlikely)
(C) the drives would have to be small enough that the amount of recording that occurred between then and now caused an overwrite (most of my small businesses with 10+ 4K cameras go years without overwrites - and that’s with 24/7 recording, not occasional interviews)
(D) all other recordings prior to the interview date would have also been overwritten (overwrites occur chronologically) - not just a specific timeframe
(E) all persons who viewed the footage must have done so from that original surveillance system - no copies made or sent - which seems unlikely for a prosecutor or even police department to work directly from the surveillance system with no exporting of their interviews for distribution or archiving (unlikely)
The amount of negligence required from so many parties for this to happen makes this extremely suspect. The IT department would have had to setup their interrogation cameras in an extremely non-standard way, the DA and police department would have had to been working directly from the PDs surveillance system and never copied the footage of the case for distribution and access, the cameras would have had to record a tremendous amount of time since the interview to cause an overwrite, and no backup system of interrogation footage had to exist.
I can tell you one thing 100% - there’s no glitch that makes this happen. It’s possible there was a mistake in one of the many chain of events that had to go wrong above, but that’s a lot of mistakes to make this happen.
This is not good. I think the prosecution is toast. And it should be. They were, in fact, negligent.

Guilty or not, he is. We must always give everyone the benefit of a 100% fair trial. Not only because they might be innocent, but because you can cast unnecessary doubt into a case that will overshadow the victim.
Making a murderer is a prime example of this.

If the police and DA can't convict someone while playing by the rules than the accused should be acquitted or the DA should be fired. Being able to put together a strong cases when the suspect is guilt it literally what they are paid to do. --- That said; I have no idea if this is them failing to build a strong case to prosecute a guilty man or screwing up (twice) with someone who is innocent.

Their patsy is in a max security prison deteriorating, facing upgraded charges that are death penalty eligible, trying to strong arm him into a plea deal and avoid an embarrassingly illuminating trial.

They don't need to prove intentionality on the state, they only need a reasonable suspicion raised in the mind of the jury.

@@angelapetrick9675 I was referring to when they were reading the defences response to finding out some of the video interrogation was deleted. The defence said they thought might have deliberately deleted the evidence, and Runkle said they might have difficulty proving intentionality.

I would love to see a spoliation instruction in criminal cases like we saw in the Paltrow civil trial. Tell the the jury that if they believe the evidence was destroyed intentionally, they may conclude that the evidence was exculpatory.
Could the defence bring up that the police lost evidence and dig into that in front of the jury, could that be considered a “remedy”?
They are going to have a lot of direct examinations with corrupt investigators in front of the jury. The judge is playing hardball and denying motions left and right that would exclude evidence, but the investigators failed to realize they will have to sit and answer for their lies and ineptitude from two very skilled attorneys. They are shooting them selves in the foot. Did you read the transcript where judge Gull illegally disqualifies Baldwin and Rozzi? Rozzi in particular was so sharp and forward thinking under pressure, I would not want to be in the hot seat in front of him. The flop sweat will be epic. I hope cameras are allowed.

When you look at cases like this one, Bryan Kohberger and Karen Read, judges seem way too cozy with prosecutors and allow all kinds of jaw-droppingly egregious prosecutorial misconduct.
Judge Gull better be as outraged at this actual negligence as she was with two accidents by RAs attorneys. Richard Allen is an innocent man in a prison before any due process or a fair trial. He is We The People. Thanks for breaking it down for us Runkle!
Those issues aren't even close!
My thoughts:
1) the judge ought to keep the same energy for negligent prosecutors as she does for negligent defense attorneys and throw them off the case 🫣🤪
2) the jury ought to have the video to determine credibility for themselves. Will be much different from a written transcript.
3) can the defense ask for the storage device so that they can have their own data recovery done on it? It might be possible to recover the video (though less likely if recorded over unfortunately).
They don't have a written transcript, only a summary of the interview from the investigators. Thats the problem, the defense has no idea what the suspects said, and no way to scrutinize against other statements.

I think #3 is going to be a really tough sell. It sounds like a lot of data was wiped, not just those interviews. I could see the owners of the device the videos were stored on say No because it could give them access to other files they should not have. (Like videos of young "parsons" abuse.)
That and the only means of communication between the DA and defence team is through slow email and text, he will not take phone calls. @@win4jesse

My opinion is that the courts themselves should be held accountable when they violate people's rights or allow others to do so. This is really no different from not finding the criminal. Upsetting certainly, but not a valid reason to violate someone's rights.

I am extremely suspicious of the police at this point. They had so much pressure to solve this case the mistake of not backing up recordings is not acceptable. If this guy is guilty they are risking letting him go because of negligence. If he's not guilty they are railroading him to try to get a conviction. Either way makes law enforcement look at least incompetent.

It's not that hard, they just won't do it. James Madison impeached and threw out a lot of judges. The first time they veered from the constitution they were gone

The Supreme Court is also to blame they would not remove her, they said she was protecting RA and then sent him miles away from the second appointed lawyer team who were unable to complete the signing of document etc. etc. due to the poor environment and access to their client for interview. Crazy!

With the context that these 2 guys and close friends of them admitted to the crimes to their family members and lied about their alibis.. this recorded over interviews become much more nefarious
