Here is the problem. They cannot be sued because there is not much money to gain from them. You can sue them after that, sure, but you pay expensive lawyers to win a defamation law that is hard to win.
It is just not financially feasible and no company in their right mind would do it. You'd just throw money out of the window, possible more than if listening to them.
The only way to convince companies to stop doing it is the bleeding of money continues and is consistent with following DEI and these consultancy companies directions. If it is a pattern then they will see it and will stop doing it.
They are not in the loop. They dont know what we know. They look at numbers, and if numbers tell them working with DEI and firms like SBI is bad for business they will stop doing it. We have to, somehow, make them see the link between their financial loss and working with DEI consultancy firms.

What kicked this all off was the claim in a chinese article a few days ago that sbi offered consulting services for $7M, and that ign's hitpiece articles from 8 months ago were retaliation for rejecting sbi's advances. If not for that chinese article, the sort of people who would buy wukong just because of this media coverage might not have heard of it.

I've been saying for a while now that the whole video game "consultancy" industry is nothing more than a protection racket. I'm not sure if UA-cam has allowed people to see those comments, though.
If you hire one of these firms while making your game, they have friends like Alyssa Morecunty in the media who'll see that your game gets good press. They have friends and bots on social media sites who'll help generate positive buzz for the game. They have friends at Sony and Microsoft who'll see that your game is allowed on their consoles even if it has content they normally don't allow. I suspect they even have friends at the ESRB who'll smooth out the rating process to your benefit, seeing as how Baldur's Gate 3 is rated M with full nudity and fairly graphic sex scenes (which would normally result in an AO rating, something no console maker will allow).
If you don't hire a consultancy firm, though... you get bad press. Bots come out in full force to trash your game on social media. Sony and Microsoft demand changes, sometimes trivial and pointless but sometimes grand and sweeping, to your game.
To hire a consultancy firm is to pay protection money. "Nice game you got, here. Be a real shame if somethin' were to... happen to it."
If you've ever wondered why one game with fanservice gets trashed in the gaming media scene for its fanservice while another game that goes farther with fanservice gets praised by the same media, this is why. The developer whose game is praised is the one that let Don Fanucci wet his beak a little.
