    Hi atty,,if ever na demote ang tao,,tapos nag reklamo sa dole at napatunayan na wala talagang evidence ang employer,,pwd ba pabayarin ang employer sa kahihiyan nang employee.

    A good day to both of you Attorneys.
    I have a question po, hope you can find ways to answer.
    Regarding demotion of rank/work, and pay. The management said it is the employee who would make a voluntary letter of request transfer from higher dept/ rank and pay to a lower dept/ rand and pay.
    2nd question is can the employee still be obliged to perform duties before was demoted or can he/she declined the task/ errands being given, will it cause insubordination to the management.

    Hi Atty! I have a question po. My brother is working as a supervisor in a business engaged in selling bikes. I’d like to ask if apart from an employment contract entered into between him and his employer, a separate contract of agency may still be created between them by the mere fact that my brother is still tasks not only to supervise other employees, but at the same sell the employer’s products (such as bikes)?

    Hi atty. Dati po akong pulis with a rank of PO1 and naterminate po ako sa serbisyo nagfile po ako ng appeal sa Civil service commision and may nareceive po akong notice of decision coming from them na MODIFIED po ung dismissal case ko sa DEMOTION na lang po so PO1 po ako lower rank wala na pong mas baba sa rank na un what should i do po?Thank you

    Atty. Na mention kasi sa video yong case ni Danilo Leonardo vs NLRC. Dahil may jurispridence na regarding sa particular case tulad nito, si NLRC ba ay bound to render a decision same with supreme court if they encounter cases like this in the future?

      Generally yes as long as the situation is similar, the interpretation/rulings of the supreme court on the matter has not been modified, or the law had not been changed.

    Question po, if from R&F and was promoted to Managerial (of course the salary increases) then was demoted to R&F again, babalik pa ba sa dating salary grade when he was still R&F before promotion?

    Attorney, may tanong lang po ako. Yung mga supervisors po kasi namin gusto bumalik sa rank & file. Ang reason po nila is pagod na sa katigasan ng ulo ng mga tao at yung iba nman po ay umaayaw na sa bigger responsibilities. Maari po ba idemote sila? Hindi po ba magkaproblema sa labor code? Pwede ba ibaba din ang salary? Please advise po kung anong magandang gawin. Thanks po.

    Magandang araw po. Binabawi na po ng employer ko ang wifi modem na niloloadan nila monthly na naging part na po ng equipment ko for working from home. Hindi daw po part ito ng non dimunition of benefits kasi NON MONETARY benefits are not included in Article 100 of non dimunition of benefits. Kukunin na po this friday
    Sana po matulungan nyo po ako kasi di po ako makakapagtrabaho pag wala pong internet. Call center agent po ako. Maraming salamat po.

    mag ask lang uli ako sir,
    kwento ko lang po.
    Branch Manager po kse ako ng isang pawnshop.
    Ngaun po ung branch assignment ko nagsara po dahil nagkaron ng problema sa Lessor.
    Pansamantala po ako nilipat sa ibang branch,
    ang katanungan ko po dahil po dun sa pagsara ng Branch ko dati eh pwede po ba ako idemote ng employer ko? na yun po ang dahilan, na nagsara po kse ang dati ko na branch dahil sa problema po sa lessor? salamat po sir.

    ask ko lang po... if ang isang employee. ay walang ginawang kamalian sa kanyang trabaho at ang employer naman ay gusto siyang idemote ng walang valid reason, or reasonable grounds...maari po ba gawin yun ng isang employer?
