Can you suspend an employee while there's an ongoing investigation (PREVENTIVE SUSPENSION)?

    Atty. nagsubmit po ako ng resignation last july 22 supposedly aug 22 po ang last day ko for turn over and all. pero sabi ng employer ko na kung pwede mag stay pa ako hanggang aug. 30 and pumayag naman po ako. then i just received an email na yung resignation ko ay naka on hold daw pending some clarifications. The questions are 1. tumatakbo na po ba yung 30 days notice ko since I formally submitted my resignation nung july 22?
    2. pwede ko po ba bawiin yung request ng employer up to Aug 30 and then mag stick sa sinasabi ng batas na 30 days turn over period?

    Atty. good day. Hihingi lng po ako ng legal advice. 10 years na po ako nagtatrabaho sa lending company. Ngayon po mag impose sila ng preventive suspension. Ano pa ba tamang proseso sa pag impose ng preventive suspension? Dumating po kasi ang aming head audit galing main office. Nga nag interview siya sa akin at pinagawan nya ko ng written affidavit ang dating po kasi ng interview eh parang interogation sa part ko at may pinabago siya sa writyen affidavit ko. At inakusahan nya agad ako na suspected oh kasabwat ako dun sa mga taong naka loan sa aming oposina dahil ako ang nag C.I tama po ba yang ginawa nila? Maraming salamat po

    May question lang po Ako..Pwede ka pa rin ba I NTE Ng HR kung ang sinasabing nagawa mo violation eh,umabot na po Ng 15 days, bago ka bigyan Ng NTE?

    50days na po ang preventive suspension, pero di ako binayaran sa PS extension ko w/c is 20 days. Now nag email sila na may Notice of decision na and the decision is another 30days suspension without pay

      Dapat po paid na yan after 30 days Rule 23 Section Book V of Dole. Nakapag follow up ka po ba sa kanila? Babayaran nila yung 20 days mo sir.

    What if more than 30 days ang PS then after 1 day tumawag na eextend daw for another 30days. Late na . Is it legal?

    Sir dapat kbang suspindihin ng limang araw sa hindi mo pag pasok ng dlawang araw na khit nkapag explained letter kna at valid nmn ang reason..dahil sa skit ng asawa ko n my chronic kidney deases.

    Atty sana mapansin nyo ...10 years na ako sa security ...case ko po leave on post binigyan ako nila nang preventive suspension ...oct 30 ako nag violate din po november nag tapos ng investigation ng officer.....dec.4 tinawagan ako ng officer na wag na ako pumasok preventive suspension ng send sila ng docs dec.7 preventive suspension daw ako pagkatapos january 03 binigyan ako nila ng relieve order....pwede ba ako mag reklamo sa kanila ...anu magandang gawin ko po ....thank you po

    Sa ilalim ba ng preventive suspension in 5 to 30 days limit of employer investigation, nakapending lang ang sweldo ng employee o walang sweldo na inaasahan dahil nga under preventive suspension sya? Kung sakali man na walang sweldo dahil nga iniimbestigahan sya at napatunayang not guilty naman sya. Kailangan bang bayaran ng employer yung perwisyo na hindi sya pinagtrabaho at walang sweldo dahil sa suspetsa sa nasabing empleyado? Tnx

    Atty salamat po sa Inyo natauhan po kami...sir ask lang po paano kapag tapos na Ang 30 days tapos di parin. Makabalik sa trabaho atty at nakalagay sa preventive suspension na 30 days tapos Wala kami Sala na Po at iba Ang may Sala po security guard po ako atty sa 10 po na kami 9 po kami na suspension at Ang head guard hindi na suspension po Tama po ba iyon....salamat po godbless

    If ever ba yung client nagsampa ng kaso laban sa EMPLEYADO na currently under PREVENTIVE SUSPENSION
    pwede ba shang kasuhan inspite na Sha lang nag process ng docs ng client
    Mangayare kase na yung COE ng client is computer generated then pinasa ng walang sign
    Pag dating Kay bank for loan nakita don sa verification process may pirma na?
    Si employee is may proof ng Convo with client na innocent Sha
    Pwede ba sha habulin ng client? Even though kinakausap na yung client ng legal department namin

    Hello po. What if umamin na ang employee at babayaran nya ang losses or yung ninakaw nya? at pumayag na employer at nagkasundo na sa Barangay. Ano ang gagawin ng employer ngayon?

    Gandang umaga po... Matanong ko lng po na hearing po ako sa aming company nung November 22 2022 tpos ngayun pong January 5 po bigla sila naglabas ng suspensyon na dapat daw po ee nung December pa naibigay sken... Valid pa po ba ang suspensyon.. Kung ang dahilan lng nmn po ee paggamit po ng company property para sa pansarili sa loob ng work place

    Atty. Paano po pag suspended yung tao, pati po ba yung sss maternity benefit claim nya hindi nya makukuha? Dec. 30 matatapos suspension days. Dec. 29 po mahuhulog sa atm account nya yung sss maternity benefits claim. Hindi rin po ba nya makukuha yun? Sana po masagot. Salamat

    Atty. si employee po may IR ng theft, gusto po namin sana ma preventive suspension sya pero kulang kami sa tao, meron po bang number of days kung hanggang kelan namin pwede iserve ang preventive suspension?

      Yup, discretion nyo po yun. Hanggang makatapos lang kayo ng investigation. You can make it as long or as short as you want.

    Atty. Kailangan pa ba mag issue ng NTE si employer before magpalabas ng preventive suspension. Kailan ba ng incident report or initial audit report as basis para mag issue ng preventive suspension?

      Nope. Preventive suspension can come before NTE. It's usually based on an incident/audit report. However, if you already have information about the incident even without the formal report being written and there is an imminent threat there, then preventive suspension can already be applied.

      ​@@julietaopeno5369 tried looking into cases, wala specifically on this situation. But would like to point out that the law: 1. Does not require the NTE before the issuance of preventive suspension and 2. There is no prohibition on issuing a preventive suspension without an NTE. So this should be good.
      Generally, in 98% of cases I've encountered, simultaneous ang issuance ng NTE and preventive suspension. But, let's take into account that in some cases, wala na time gumawa ng formal NTE and you need to preventively suspend na. If that's the case, go ahead and issue it.
      Ex. Nag away sa workplace. Magsasaksakan na yung 2 employees. And alam mo pag nagkita uli, hindi malayo na maulit yung encounter. A few minutes after the incident and naawat, you only have an incident report on your hands. In this case, if you ask me, I'll encourage you to issue a preventively suspension na agad based on what you have at that point. No need to sit down, draft nad print out an NTE. Baka magkapatayan na yung 2 employees by then. Hope this example makes this clearer for you.

      Puwede naman po mag resign anytime. Dadaan lang po kayo sa turnover period kung sakali.

      You van ask your employer to credit if papayag. Pero generally speaking, turnover is for TURNOVER. kailangan po pumasok para maka turnover. But again, pwede naman pagusapan yan. Just open it up with your employer.
