Executive cannot control who the three senior most would be therefore, it would not always be possible for them to pick judges of their choice. However, I do think that formation of constitutional benches by the parliament is too much of an excess into the administrative working of judiciary. That should not have been done. I do agree with taking away the sou moto powers of judiciary. Judges like Iftikhar Chaudhary and Saqib Nisar have caused tens of billions of dollars worth of losses in cases like Riqo Dik etc. I do agree with privatization of state owned enterprises (I know you disagree) and these judges should not have the power to stop that process unless something illegal is happening.

The elected Governments were almost rendered dysfunctional through the Suo Motto exercise of authority. Iftikhar Choudary took 104 Suo Motto notices. All the notices were based on unsubstantiated and unproven Newspaper reports. 26th Amendment has reigned in those elements among the Judiciary with Bonapartistic tendencies. 26th Amendment was the need of the hour.

Historically, parties come into power with establishment’s backing but later on differences arise. There is nothing wrong with legislature appointing Judges or legislature having some oversight over judiciary via Judiciary Committees - checks and balances within the 3 branches of govt exist all over the world. The 26th amendment isnt particularly unbalanced in terms of how much power it gives to parliament. The parliament is supposed to represent the will of the people in a democracy. The real problem with the 26th Amendment is that the legislature passing the Amendment, and the one that will be executing it, is not the one people elected in Feb 2024. Pakistan is not a democracy. It never has been. The only way to make things semi-functional is for all political parties to come together and negotiate some boundaries with the civil-military bureaucracy, instead of creating perma-crisis. Or just convert to an autocracy - it would be better than the current very expensive circus.
Mr Taimur the analysis drawn is good enough but the ultimate point is who will bell the cat. The army institute may hv supported IK but he never surrendered to them. This PAK institute is so strong and only one pakistani challenged them who is suffering in the jail. It is he who is trying to make it a public movement not any leftist. There is nothing wrong with legislature appointing Judges or legislature having some oversight over judiciary via Judiciary Committees - checks and balances within the 3 branches of govt exist all over the world. The 26th amendment isnt particularly unbalanced in terms of how much power it gives to parliament. The parliament is supposed to represent the will of the people in a democracy. The real problem with the 26th Amendment is that the legislature passing the Amendment, and the one that will be executing it, is not the one people elected in Feb 2024. Pakistan is not a democracy. It never has been. The only way to make things semi-functional is for all political parties to come together and negotiate some boundaries with the civil-military bureaucracy, instead of creating perma-crisis. Or just convert to an autocracy - it would be better than the current very expensive circus.
