Can VA Doctors Write a Nexus Letter?

  • In the video Leah addresses the challenges veterans face in getting assistance from VA healthcare providers for filling out forms such as DBQs, Nexus letters, and aid and attendance forms. She notes that veterans often encounter reluctance from providers who cite reasons such as conflict of interest or lack of time. Leah aims to empower veterans by discussing the VA's own policy, VHA Directive 1134, which mandates VA healthcare providers to assist in form completion. She highlights key sections of the directive, emphasizing that VA providers are required to provide medical opinions (Nexus statements) and complete DBQs as part of their duties, contrary to the common belief of a conflict of interest. The directive also covers the completion of various forms, including those for benefits claims and handicap parking. Leah urges veterans to approach their providers respectfully and provides guidance on how to request form completion, particularly for mental health DBQs, where she recommends a neutral provider to maintain the integrity of the patient-provider relationship.

The VA said I didn't seek treatment while active-duty. I was so angry when I received the letters. My trauma is so bad, the judge had to cancel my SSDI hearing because my panic attack was so bad. I do have my hearing later this September and I am appealing the VA's denial. Will also request my VA psychiatrist for my Nexus letter. They were nice enough to write in my medical notes that "x condition in service is most likely the cause of X condition today". This is a game-changer. But there’s something to the “consistent with other VHA policy” issue.
Neither of my VA podiatrists would write a DBQ or nexus letter. One told me he was told not to (internal policy for specialists, maybe?). But my primary care doctor has written one and has recently offered to write more. That message came as I was looking for a doctor to write a nexus.

Simply having a DBQ completed by your healthcare provider does not equate to your requesting evaluation for consideration for disability. That is what the claims side is for. Hello fellow vets. So, I asked my PC doctor at the VA to assist me with paperwork in filing a claim. She immediately refused stating they were not allowed to get involved with that process. I mentioned VHA Directive 1134 but, she advised me to take it up with her CMO (Chief Medical Officer). I’ve left a message both at the clinic and over the phone for the CMO, have not yet heard back from her. I contacted the Patient Advocate and he was no help. He only regurgitated what my doctor said. I offered him to look up directive 1134 however, he didn’t seem interested and said he’d refer me to the CMO.

I went to VA Director because it is Director's responsibility per 1134 to enforce 1134. Director refused to see me. New rule. Patient Advocate has to handle all Director complaints first.
