    Thank you for being so comprehensive in your discussion.I am currently awaiting a response from my claim for presumptive bladder cancer(no agent orange exposure). The VA sent me notice that they were reviewing my previous claim for bladder cancer( no complaint while on duty), if I get another negative review from the VA,I will be on your doorstep for consultation.Again,many thanks!

    I received a SSOC and was denied for sleep apnea. I served in the Army from 1973 till 86 .Sleep apnea was not mention in my service medical records because I never complained about sleep apnea matter of fact had not even heard of sleep apnea back then. The examiner stated It is unlikely that the condition of sleep apnea would be related to an incident requiring hospitalization for shortness of breath , fever and dizziness. they went on to say those symptoms bring to mind a response to a viral or bacterial condition as opposed to being a causative factor for sleep apnea. I did some research on my own and found that shortness of breath fever can be a result of sleep apnea.

    Exactly what happened to me. Messed up back in service. Claimed 10 yrs later. VA aknowledges it happened in service. Denied because of no continuity of care even though personal statement explained lack of health insurance.

      This is a very common occurrence and one we assist with frequently. Please let us know if you would like us to look at this with you in the future. Maybe check with your regular doc who may write an opinion as well. Also a good claims agent or attorney may be beneficial. Do not give up sir!

      @@mariomario.. well I hired an attorney. Because I refused to let them get away with messing me up and not being held accountable. That was hogwash to me. Man they told me the same thing that they told you. As if it was a template.

      @@d0x5j0 Thats awesome. I was almost paralyzed and they still tried to screw me over. I gave up on that one but I started to educate myself about this stuff and was able to get some much bigger claims later on so it kinda backfired for the VA. I would have been happy with a small 10-20% rating.

    Nexus letters are the keys for VA claims. The VA will consider a private medical opinion more favorable than a C&P examiner's opinion or a VA Doctor...Cheers!

      That depends upon the language and knowledge of the the individuals writing of that Nexus letter.

      Not true, all veteran's know the reality of that incorrect statement. She has personal knowledge and experience on the subject matter having been on the "inside" she's one of us, but most VA outside contractors are not. The VA will always give more weight to its own team, not ours.

    Thanks, for your genuine medical opinion. For me personally, I was injured in a LOD M-16 Firing Range Accident, with diagnosed sc low back strain with degenerative spondylosis and radiculopathy and lower extremities. I understand that there are many terms for low back terms that are used inter-changeably; including herniated discs, degenerative disc disease, musculoskeletal injuries, sciatica, and PTSD.
    I understand, that injuries are primary and secondary, also. Is it possible that a secondary condition was used as a primary diagnosis, thus coming up with a 20% disability for back strain? Consequently, omitting the secondary issues of sciatica pain throughout my lower extremities from the nerve root of my disc? This is complicated and I wish to speak with you on this, if you could?

    If I request a letter for Flat Feet (Pes Planus) Foot Pain ( Plantar Fasciitis) and Athletes Foot all as econdaries to a primary military ankle injury

    Would that be 1 payment of 600 or 3 separate payments of 600?

      I am glad you found the information helpful. We are generally able to discuss pes planus and plantar fasciitis in the same letter but it just depends on the specifics of the case. I am not sure about athletes foot we would just have to review the case

    All good but most important to many is the cost. Also can more than one symptom be addressed in a single document. Many people with whom I have spoken want to know up front what expense they will insure.

      Well it depends on the person writing it. For example your primary care doctor may write it for free and write an unlimited number of conditions in one document.

    Veterans Administration called twice told me to ask for examination through vamc doctor as vba workers found cue 3.### + cue 3.### both ladies from vba one from DC plus another from Chicago said third party Dr. did me wrong on depression mst-ptsd examination and that they wanted to get me rated and told me what to write how to write it and what form .
    It gave me a shred of hope, the message they relayed was they do care ,they don't like to deny veterans but they need a medical opinion.
    Clean for 15 years and at a breaking point.

    Super informative video as always! I can't find information regarding whether you need a Nexus letter for a service connected 0% rated migraine condition that you are trying to increase. Can you shed light on the need for a nexus letter in this situation please and thank you! 🙏😁🇺🇸

      Hey sir I do not believe a Nexus letter would help much for that as these typically show a link to your service and if you are 0% that is already established. A DBQ may be helpful or simply requesting the increase from the VA as the examiner will fill out the DBQ at your C&P. Your private doctor can fill these out as well

    I was diagnosed with depression. I've had dealt with severe digestive issues since the military that caused depression and anxiety. The VA diagnosed me with depression and sent me to a therapist. She agreed to write the Nexus letter after seeing my military medical record and treating me for 4 months now. What is the most important information to have on the letter? Linking my disability to my depression?

      She should list the documents she reviewed and discuss the likelihood of it being related and why. The terminology "at least as likely as not" "more likely than not" or "due to" should be used if possible when she states that she believes your issues are related to anxiety and depression.       @@MH-il1lk An LCSW is competent to write a nexus letter 100%. Typically when it comes to DBQ's Psychologists or Psychiatrists must do first time DBQ's. Re-evaluation DBQ's for increase can be completed by any type of medical doctor, psychologist, LCSW, PA, or nurse practitioner. In this case we are specifically talking about nexus letters NOT DBQ's so that does not even apply. Does that make sense?

    I had a prior to service injury before I entered the service, it had healed and I was fine when I took my pre enlistment exam. However, when out on a training exercise while in service I injured that exact same elbow. As it was aggrevated, and continued to bother me and after the X-Rays....The Medical Board recommended my Discharged. Yeeeeeeears later I heard about filing a claim, so I did and was denied because they said it was a prior to service injury. So for the past 4 years that did not make sense me. If I was injured while on duty, and they discharged me on a Medical.... Not sure why that was not service connected? I didn't have a nexus letter or anything, Never even heard of that. I wan't to re-file again but this time with the Nexus letter.

    As a National Guardsman of 16 years, I have been diagnosed with sleep apnea, had shoulder surgery and knee surgery… It is unknown what caused the issues… age related? Could be, Guard related? To a degree to be sure…. I have not made any previous issues of this with the military, but with retirement coming up, should I be seen as I think at least a small percentage has got to be related to the physical grind over the years

    Having right knee problems. X ray results point pseudogout in layman's terms. Attacks more frequent. Have 20% left foot fracture with pes planus and 0% right foot pes planus. Underrated lumbar strain 10% due to never getting a c&p exam. Had physical therapy no relief. We will see soon what orthopedic says. Which primary claim would better connect my knee?

    I got denied for my back pain even its on my military medical records and I got records for treatment by civilian orthopaedics but I don't have a nexus letter thats on my denial letter too. You guys provide a nexus letter.

    I believe I was misdiagnosed while on active duty. I had abdominal pains and the doctor said it was Gastrointestinal pains. A stool sample came back positive for blood in it. Several more samples were done during my time on AD and they were all positive. Never did anyone suggest I get a colonoscopy. They told me it was from my hemorrhoids. This all started back in 1989. Fast forward 20 years later and I was diagnosed with ulcerative colitis. I’ve been on medication ever since. My gastroenterologist wrote a letter for me. He believes I had UC while on active duty. Is there anything you can. Do for me? It’s gotten worse. I get Remicade infusions every 8 weeks. Thank you.

    I filed a claim for skin cancer had a CP and the examiner never asked anything about how I thought it was military related. The VA stated there was enough evidence that I have sk I n cancer but not enough evidence to show it was related to my service can you help

    I got all of my doctors that I see on a regular basis besides the VA that wrote letters for me and they're all saying my medical conditions is that I'm fully disabled I cannot work on housebound and if there's any veteran out there that wants to help me do the paperwork please

    Awesome video I’m trying to figure out what my next step should be I had put in a claim when I was new so I didn’t know any better for sleep apnea connected to Gerd secondary to IBS unfortunately didn’t realize that Mcgirts wasn’t service-connected either way it came back tonight I got approved for asthma and I’m wondering should I go for China connected secondary to asthma or secondary to allergic rhinitis just wondering who I can contact about this thank you

    I was diagnosed with ms 8 years after separation......presumption 7yrs after separation. I started developing optic neuritis 1 year after separation. I just found out about the presumption around 7 years ago. No excuse but can I get your help? I'm a Desert Storm Vet.

    I've heard the VA won't accept them over the C&P examining professional.

    If your va psychiatrist gives you a good nexus letter, 51% as most likely that my depression is caused by my service connected tinnitus, how much weight does that carry? They still sent me for a c&p exam, and I'm waiting for a decision.

    Mrs. Leah, I have a question. Basically, I've done all of my own research and submitted my claims. I claimed ptsd & they rated me at 70% and then I claimed IBS and it was bumped up to 80% and they were presumptive conditions from the Gulf War. But here's my question I have 3 more things that I've submitted and they were not denied they were deferred. The first, after the Gulf War I got stationed at Ft.Drum and while being there I had this reoccurring skin rash but no one could tell me what it was and throughout my life I continue to get this rash. I use the VA now and they still can't tell me what it is. And at one point I had to go to the emergency room because the rash got really bad but still no diagnosis, it eventually goes away but returns periodically. Second, I tore ligaments in my ankle and I have problems with it where it always feels like I'm going to roll my ankle or I get a sharp pain in my ankle. Lastly, it's for unemployability I can't hold down a job because of my ptsd and I've been a delivery driver after my service and I couldn't do my job because of the ptsd and because lifting boxes I never felt comfortable lifting heavy things because of the instability of my ankle as well. Again, none of the three were denied just deferred. Hopefully you can give me some advice?

    Just out of curiosity, I have been being seen at the VA for combat related PTSD problems for a while now. Do I still need a medical nexus or should this be an obvious case? I have a long list of problems that I have never claimed that could probably be attached as secondaries, than you for your educational videos.

      You know every case is different. Nexus letters are never needed but can at times be helpful. Often, veterans will attempt to connect their ailments without one and if that fails they may seek a letter. Sometimes veterans get one up front anyhow. It is always best too consult with a legal expert like a claims agent or a VSO or an attorney for further clarification. I am so glad you are enjoying the videos!

    Doesn't the Nexus Letter need to be written in the state you live in ? A friend of mine paid for one and the VA turned it down because it was not written from a doctor in the same state . So he lost 1500 dollars. Do you write them from the state I live in SC ?

      Hey sir that is a personal choice. You may want to discuss strategy with a legal professional to see what works best for your case. It takes us about a week to complete them I cannot speak for other medical professionals of course their times may vary

    I suffer from headaches. They come and go and I have recently been keeping a headache log. . I am rated at 10% for tinnitus but what I don't know if this is related to other factors. Ive read that it could be secondary to tinnitus so my question is, can this be actually diagnosed to see if they are connected? Do they take where I was stationed like contaminated bases too? How do I go about doing this without making it seem like in trying to get va money? Thank you.

    Ma'am, much appreciate the great info! Question: Must I obtain a Nexus Letter if my Vertigo diagnosis was made by an emergency room doctor WHILE I was on active duty? In other words, is the in-service diagnosis for this particular disability sufficient for establishing nexus?

      I forgot to add that my personal statement describes my Air Force job as having me work routinely on the flightline (where the aircraft are parked and taxi) and routinely near diesel-powered ground equipment eg. forlift trucks, fire trucks, power generators, aircraft refueling trucks.

    If a veteran is diagnosed with depression for example, can the vet possibly use a negative mark on their DD-214 as rational to connect their depression to their service if the mark proved to be unjust years later? For illustrative purposes, veterans who were discharged during the Don't Ask Don't Tell era were commonly given a statement of "Homosexual Admission" under the Narrative Reason for discharge. Unfortunately, that could be a problem because that statement could cause those vets to be discouraged from applying for government jobs or applying for a VA home Loan due to the possibility of outing themselves publicly for the fear of being ostracized, harassed or assaulted by someone. One could reasonably believe those fears could cause a vet mental and emotional health problems for years. What do you think?

      Every case is different and really just depends on the specifics. I have seen veterans with DADT discharges get connected for a mental health condition as a result of their discharge and their experiences.

    I was in Vietnam in 1966 67 i got agent orange i have had blatter cancer sence 2009 and just recently had it taken out for the 6th time the cancer got in to my blood stream where as i had to have one half of my left lung removed i have a racing heart beat for long time two congested heart failures and blood clots to mention a few problems was given 100 per cent disability now they took me off and I still have same problems i served in the army and navy.what do you think ajm.

      Hi sir we have experts in Washington, Texas and Colorado however medical opinion letters based upon records review can be preformed by experts outside of your state. The VA once had a policy that prohibited telehealth examinations when conducted by non-VA providers however they have since reversed this policy (you will want to get clarification from this by a VSO). Either way we never performed that type of service and traditional records review and medical opinion has been widely accepted for decades regardless of the state of the expert. I hope that was helpful and again for further clarification you will want to follow up with your accredited advocate.

    How do challenge 2 inadequate C&P exams that are now closed/final?
    I injured my right ankle in service... its documented and diagnosed.

      @@prestigeveteranmedical I called a few of the well know lawyers from youtube but they won't touch it because I'm 100% P&T. They advised me to seek help with the DAV. If I were to get this claim reconsidered and grant i would get retro pay. I don't if this would be considered a CUE or what.

      its good to have your c-file but most of the time there not going to have your recent c&p exams in them. Go to your local VA affairs office in your town or nearest town ask for a copy of your 2 most recent c&p exams and they will make you copies, take those 2 exams to your private DR. and ask him or her to write you 2 nexus letters to rebuttal the negative opinion with a positive opinion then go file a SUPPLEMENTAL CLAIM.

    Hello thank you for the video. I was separated in 2006 after three deployments to Middle East. In 2010 I was diagnosed with afib and although I know for a fact I had sleep apnea prior to that I didn’t get a diagnosis until 2018 when I finally smartened up and swallowed my pride. Are these presumptive and would I need a nexus letter ? I received imminent danger /hostile fire pay while I was deployed and was in constant fear of attack. Thank you.

      We would never charge a veteran for a follow up letter however we generally are very comprehensive in our approach and if there is a denial it is generally not related to a lack of presented medical facts in the original letter. It is generally based upon the VA taking their examiners opinion over the alternative and in this case it is inappropriate for a medical expert to respond it is an administrative legal concern best suited for an accredited claims agent or an attorney. We will always look over the decision letter and if there is a specific need for clarification from the original expert we do so at no charge.

I'm having a rebuttal document done at the moment. And when the person doing it read my 2 denied claim letters. They where shocked and dismayed. And was all about getting me a rebuttal document done. All I was really asking is do you do the same.

      @@scrapguy6816 Sure thing I completely understand. In my experience if a medical expert simply reiterates their original opinion it is not new medical evidence. Often this type of response is kicked back as not new and material evidence as it is just a restatement of the original contention. I find this to generally be a waste of the veterans time when what they truly need is an accredited agent or attorney to address these matters. Again if there is something medically relevant that was missed then it is appropriate but in 99% of the cases these are truly just things that need to be fought administratively. I am also always happy to address any questions a vets attorney or accredited agent may have for clarification of an opinion. Again this is not due to lack of efforts. I used to write responses like this all of the time and if they were helpful I would still be doing it but they just really historically do very little and these denials have a much better chance of getting flipped around with representation as circling the drain at the regional level is often a fruitless endeavor with this approach (not always but frequently). Again I look at each case individually to determine if there is anything from my standpoint I can assist with and make a case by case determination.

      often obesity is related to a veterans mental health condition or there other service connected disabilities. Beyond that it is really hard to say because it just depends on several variables

    I have 0% service connected for actinic keratosis and nevi.
    Since being medical retired from Army I have had several more benign skin lesions removed and recently I have been diagnosed stage 3 melanoma. Is this new diagnosis considered a new claim or a claim to increase %?

Many veterans may be successful just asking their VA doctor to provide a letter or their own primary care manager etc. Also many veterans have positive opinions rendered from C&P examiners if all of the evidence supports a positive opinion.     I got a letter today from my primary care doctor I've been with him for over 25 years and I'm also getting a letter from my lung doctor November 2020 I stopped breathing in my house in my heart rate dropped down to 20 I spent the week in the hospital I'm on oxygen permanently the rest of my life and both doctors are saying it's due to my military service and they also have two line of duty from 400 from medical hospital Dr Mike wrote on the line of duties got my medical condition is due to my military service on the ground zero world trade center site location I'm handling the dust in the breeze when the buildings came down on top of me

    Those that C&P examiners who use the term “more likely than not” or terms like that … in my opinion are cowards! Totally afraid to make a solid stand or decide either for against! Most Vets are ok with the truth! Don’t need anything over or under inflated and certainly NOT a word salad.

      @Prestige Veteran Medical Consulting I was just denied theee conditions last week after waiting 11 months 1 week.Was awarded smc k though and all.the denials were favorable and diagnosed. Anxiety was less likely than not even though The emergency circumcision happened in service

    Just cause a condition wasn't caught while on active duty shouldn't mean a specialist shouldn't write an opinion for the vet. Some of these examiners just stare at our STRs and give an opinion without looking at the WHOLE picture! U guys rely WAY too much on just the STRs. If a vet has rated disabilities from OVERUSE and OVERLOAD without one singular "event" in service to point towards, it should be completely plausible for them to have other issues going on too
