      Not really. They didn't actually prove he's the one that did it nor did the picture show when it was cut. There's not even proof it came from the plaintiff's car since it's just a piece on the ground without anything nearby. For all the judge would know it could have been cut by the other mechanic or was from a completely different car. The fact that the mechanic that actually fixed everything refused to take part makes me suspicious that the plaintiff was wanting him to lie and he refused. Between that and the fact that she was suing for nearly what the car was paid , it makes her fishy.

    A transmission from a mercury sable will work in a ford Taurus because they literally have the same transmissions in them. It sounds like she had him install a used transmission, probably out of a wrecked mercury sable. A mechanic that installs a transmission can’t guarantee it because used transmissions and even rebuilt transmissions can go out prematurely. The ladies car is on the older side for a car so it’s believable that it had its transmission replaced before. Her saying that it worked for the 9 months she’s had it doesn’t matter either. A transmission could be working fine one day and go out the next. Judge Judy was wrong in this decision.

      Taurus and Sable were essentially the same car mechanically, just had cosmetic differences (Ford/GM/Chrysler used to be notorious for taking a car, changing the badge and grill and selling it as a different model).

    • @davidholmes9874
      @davidholmes9874 Рік тому +4

      The Taurus and Sable are essentially the same mechanically with identical engines and transmissions. The Mercury brand is a Ford Motor Company product just like Chevrolet, Buick, Pontiac and Oldsmobile are General Motors products. The difference in these cars is the styling, trim levels and included standard features. They would share the same transmissions. Judy does not explain the reason for her decision. If she did not believe it had a prior transmission replacement she should have stated so. She frequently calls people liars. The woman knowingly got a used transmission but has a right to expect it will be a working one.

    In Australia I am pretty certain this case would have failed under consumer law, because she did not take it back to the first mechanic to rectify the problem or refund the money. Especially since she was only 5 min away and just had to call them to get them to bring back the vehicle. You have to give the retailer an opportunity to address anything that was not fit for purpose. That apparently never happened here and the first mechanic never got an opportunity to look at what went wrong.

    • @DesiAyala17
      @DesiAyala17 Рік тому

      Or maybe as she said, it was running well until it needed a replacement and even after the replacement the car still wasn’t running properly. How the hell do you put in the wrong transmission? I believe she did call the guy up and he probably denied anything wrong with the car. Just by his demeanor and attitude you can tell he just wanted a payday. It’s really not that complex. She had the evidence even pictures for underneath the car and a witness to disprove the work done by the defendant. The Defendant didn’t have anything, he just relied on his word.
