  • If you saw my unboxing and first impressions video of the Talaria XXX, you know that one of my concerns was whether this "E-Bike" is legal and if I would get in trouble for riding it on the streets. In this video, I go straight to the source and speak to Officer Martinez with the California Highway Patrol.
    I hope this video helps clear up some of the same questions you may have regarding the legality of Surron and Talaria type bikes.     I’ve been riding my Surron in town for a year and a half. Have gone past numerous bpd and sheriffs with no issue. But I also don’t go wheelie in the road and go crazy through traffic.

      I’m in Canada and want to get the new E-ride pro SS. But I’m nervous about taking it through the city. Id rather not put fake pedals on it either..

    Mostly comes down to common sense, if youre blowing through town at 50mph and riding like a dingbat youll prinably get stopped. If youre respectful, have some swlf control and commmon sense youll likely be fine.

    This is a joke. I find it hilarious when cops say it's not safe to ride or drive because it's modified meanwhile they have police vehicles with souped-up engines and flashed computers with stock suspension( which is very dangerous ) and drivers who have no idea what they are doing

      The law is clear federal law mandates class 3 28mph. Class 2 can have no pedals but only 20mph.
      This thing can do 45-55mph how is that not a motorcycle. It's clear on the website it's not street legal.

I’ve even been chased twice by the police on my non electric pedal bike for doing wheelies which is a little bit absurd but I’ve gotten away both times because when I was respectful and stopped for them they would always find a reason to give me a ticket… 😅

    Add pedals, mirrors, horn, head/tail lights and register by mail in CA as a moped. No inspection required. Cost about $25 and they mail you plates good indefinitely. You do have to have at least an m2 license to ride a moped in CA but a relatively easy way to make these higher powered "ebikes" more legal. Could theoretically still get ticketed or impounded if you are caught exceeding 30mph, but police will probably allow it if you are plated.

      You cant claim this is an ebike. Ebike are 750watts at motor up yo 28mph.
      This is an electric motorcycle and you need to go to school at least.
      Registration is another thing and you can say you don't wanna pay the government that's fine.

      Please do not follow his advise, my nephew did not stop on his Surron and the police motorcycle officer caught him. Now he is faced with a misdemeanor with up to 1 year in jail. Now my brother has to retain a lawyer and we are waiting for the court date next month. Already facing I believe $1,500 for the 30 day impound of the Surron and also was charged for not having a motorcycle endorsement, no insurance (could not believe the fine is close to $900), and not registered for use on a public road. I could not believe the Surron was 5k, I told my brother just buy a used motorcycle for him since he is 16.

      @@geneg6343 sorry to hear about the arrest. The good news is they have street legal electric dirt bikes. Heck if he loves electric they have zero motorcycles and kawasaki has there new electric motorcycles. But under no circumstances should anyone buy a sur ron and act as its an ebike without checking there local laws. Where im at they will not make it street legal with out a proper Vin, mirrors, lights, turn signals, reflectors. The sir ron was always make for offroad use and never ment to go on public streets.

    28mph is too slow to be riding on the road, you will get honked at or road rage from drivers when there are no bike lanes. Ebikes should be able to keep up with the flow of traffic. 28mph restriction is stupid and will actually cause more danger to both riders and drivers. As more and more ebike riders are becoming popular. The speed is going to be an issue on the road when traffic wants to go 45mph and you are riding really slow at 28mph causing traffic jams and angry drivers.They will yell at you and tell you get the f*** off the road. Or worse swerve into you on purpose or cut you off.

      It goes 28 in Eco and 45 in sport, its still a bit risky but at least you can stay with the speed limit in town

      Battery tech has to improve, we get 30-40 miles at most with speeds like that.

      Doesn't stop road bikes on the road going less then 28mph. If you wanted to go fast you can get electric mopeds that look like a honda grom. There's a lot of street legal options.
      A sur ron can be made street legal then registered as a moped but you need to follow what the DMV says but even then you cannot go faster then 40-45mph

    Well i got a question now.. Some "Ebikes" come with controls that have a street and off road mode. So you can set the street mode for 750W and off road to max even if the "Ebike it's self has 4k watts. So as such would it be legal on the street in "street mode" while limited to only 750w and kept under 28mph ?

    Whether its legal or not is not the issue, its whether or not the cop decides to enforce the law. A fedex truck parked in a red fire lane blatantly breaking the law probably wont get a ticket even tho hes clearly breaking the law, some laws get enforced and some dont, if you're not being stupid you probably wont get pulled over, but always remember, the smaller the town, the more attention you will receive from the popo. Ive been riding my surron on san diego streets in front of hundreds of cops and right by the downtown police station for 4 years now and 6000 miles and have never been bothered, i also dont ride foolishly tho. A bored cop in a town of 4000 people tho might want to investigate your new toy but i dont have any experience on that note. Be safe boys and girls. By the way, ebike laws are stupid, hows a cop going to know what your top speed is if you were doing 15mph? And hows he going to know what the wattage is and so forth, imagine if you couldn't drive your sports car on the road because its capable of breaking all speed limits. Just because its capable of going over 70mph doesn't mean you will. But if your ebike is capable of going over 28 its automatically illegal, wow. Is the cop going to hop on your bike and test the top speed to verify lol. So dumb. How about pull the rider over for being dumb, not the bike for being an inanimate object subject to the riders inputs, much like a ferrari. FAFO.

    You should of ask the officer if 28mph is safe speed. It is basically too fast for the bike lanes and too slow for traffic lanes. Ebikes should be able to keep up with the flow of traffic on the road. And if they want to ride on the bike lane then keep the speed down to 28mph. That would make a lot more sense. Who makes up these law? Also 750W motor law does not make sense either. It also depends on wheel size, tire size, hub driven, chain driven, dual motors, rider weight, bike weight, battery voltage, all plays a factor in power. You can have a 750watt motor go 28mph or 50mph by tuning changing controllers, sprockets, wheel sizes ect......

      True, manufacturers switched to gear hubs just to get enough torque out of 750 watts, now we have more parts to fail, nylon gears to strip, no regen!
      Not sure I'd want to go 40 on my bike regularly, though. The Chinese products we usually deal with tend to skimp on the things we'd need to go that fast, ie brakes, thru-axle, double crown forks, so weight is brought down. Direct drive needs bought 3000 watts to hold 40 mph, and needs to be rated for more so they don't overheat the windings with reasonable, real world use.

      Its a carry over from Moped laws. It is not meet one restriction its fall under all restrictions; 50cc limit + 30mph limit + single speed (in my state). If your 50cc but two speed that classifies it as a motorcycle, same with just traveling over 30mph, makes it a motorcycle. These are relatively arbitrary, but a line had to be drawn somewhere and you already pointed out exactly why its about where it is: it doesn't allow for direct use of the roadways and keeps the vehicle relegated to the shoulders. IDK about California or many other places but these aren't deal breakers in my area it just changes what you need to ride it because it just becomes a motorcycle. To play devils advocate a little, anything capable of 30+ mph doesn't belong on sidewalks and then should obey traffic laws as well.... its in traffic, so making it comply (registered and licensed) with the law isn't illogical.

      If you want to keep up with 50 mph traffic then you should be registered, insured, and licensed like everybody else. It takes years of training and expertise for a road cyclist to go that fast, vs a 14 year old kid first time on an electric motorcycle with the flick of a switch. Just think about someone other than yourself for 30 seconds and you'll realize why these laws exist.
      Btw where I live ebikes are limited to 20 mph and that serves me just fine, I stay in the bike lane and don't mix with traffic.

    Personal Electric Vehicles (PEVs) is another avenue where I live. You are allowed to operate any PEV on any road with a posted speed limit of 35 mph and under. This goes for scooters, golf carts, one wheels, electric skateboards and the like. I personally have never had an officer take a second look at me when I ride, though I keep it pretty chill. Fellow cyclists on the other hand can be terrible. I just expect it now.

      Skateboards, onewheel, unicycle, scooters are not regulated. Only electric bycicles, moped, motorcycles are.
      That's why cops don't bother you.

    I have no problem registering a Surron or Talaria as a motorcyle, especially if you have one already, M endorsement, registered, inspected , etc. The problem is: Most of the dealers, including Cali, Utah, and the east coast are selling China imported bikes with no VIN number or some do and some don't. It may have a PIN # on the headtube and is functionally identical for many purposes, like insurance identity, and the dealer may even say it's good for everything, but it isn't a 17 digit VIN number that the DMV will allow for some states to register your eBike. You may get lucky and the clerk that day lets it be registered, but it is unlikely. But then some states will let you substitute an MCO (Manufactures Certificate of Origin) for the VIN.
    So, you have a 1. Invoice,(Bill of Sale or receipt) 2. MCO 3. VIN and 4. Title Sellers (Chinese) can provide any mix of these (never all 4, usually 2). Your local Dealer can have any mix of these also (because they may not get an MCO or a VIN from their Chinese wholesaler). The local dealer may not have a Title for you because his state requires one of the certificates he didn't receive. Finally, each state has different rules for which of those 4 you need to register and plate your eBike. Not to mention whether you can get the Street legal lighting or not. Many of the overseas suppliers do, but only a few will have that factory lighting in your own country. (if you're handy you can get a lighting package .. if you have a major brand).
    As buyers (given that you need or want it street legal) we are faced with these 4 items and there is a random mixture of them between 3 parties. The Chinese suppliers, your Dealer, and your DMV. That's the problem. If you buy direct from overseas yourself, for whatever reason, the same obstacles will apply. It seems to me out of the 4 items, not having a VIN is usually the hardest to overcome.
    For instance, in my state, WV, I thought I had it pretty much together. I checked with the DMV and asked what they needed to register before I ordered. They said Receipt, Bike with VIN, and 'papers'. Great, I'm ordering overseas (to get the legal lights and horn), they said it had a VIN, and I'll have a Receipt when it arrives, plus I have the email confirmation and Invoice #. So I ordered. Just in case, I went back online on their chat and confirmed, "There's a VIN, right?", "Yes". "There's an Invoice with the bike, right", "Yes!" At this point I'm pretty much set, I thought. The DMV had said, "papers", a little vague, so I asked further, just in case. "There's a normal MCO, right?" (most overseas sellers have one). "Uh, no. Don't have MCO." Well, "There's a Title with it, of course, right", Uh, No!" Lucky, I said to him, I know I already ordered, but can you hold off shipping it for a few days so I can check again with the DMV? I'm just hearing now that I get a VIN on the bike and a Bill of sale when it arrives. That's it? Went early in the morning to the DMV and asked what exactly does "papers" mean? Now they said you need a VIN, receipt, and the Title. Mainly the Title. Uh oh. I tried everything. "Well, when I get my invoice, that's a bill of sale that has my name and the seller's on it and that's 'proof of purchase'. Then I will have the VIN on a newly manufactured item that is described in the invoice and can be entered into your system. Nope. "Need a Title". Well, "When I buy a car or a moto at a dealer, I just have a payment, I can call right there and get my insurance, they give me a Bill of Sale and some other papers. I come here with that and you register it and give me a paper tag until the plates come or give me the plates outright and a Title comes in the mail." "Nope, need a Title." I gave up. I went back home and asked for the guy from the seller who I talked to before and luckily he said, Yes I could cancel the order because it hadn't shipped. Whew. I'm going back to the DMV though and talk with a supervisor because I swear I've heard in other states there is a way, some way, to get a Title by applying with a certain DMV Title form and a Bill of sale and an MCO and get issued a Title for that vehicle. I'll find a seller that has an MCO and a VIN, or papers that can get you a Title if there isn't one already. So, for my state the Title was a must have. In another state it may be not having a stamped VIN on the frame that is the show stopper.
    Is there a way to register a Surron or Talaria going through a process to be assigned a VIN number? You would have a bill of sale and it would be a new vehicle, so there must be a way. Or, If your state takes an MCO from the manufacturer and your Receipt, isn't that enough to apply for a Title (and then be accepted for state registration), but many of the Chinese sellers do not give an MCO and after the dealer in the US has taken a shipment of them without that MCO, you aren't getting one after that. States want a VIN or secondarily an MCO letter from the manufacturer, or in my case a Title, to register a motorcycle. Is there any way for these 50 mph E Bikes to get a state registration without a VIN or a Title? More of these will be sold every day. It would be nice to have the same procedure in every state.

      so i live in California so I'm going to state a similar issue i had in the past. I had a 1964 vw beetle and it only had one vin number on the whole car. Unfortunately it didn't pass my states vin verification. I then had to go to California highway patrol and request them to do the vin verification. They were able to add a vin number to my car so that there was two identifying spots with a vin number. Id assume that if you had a Chinese bike with no vin that you would be able to do a similar process. i also only had a bill of sale on the vehicle and it was out of state title transfer as well however this was also an actual vehicle. No idea if this helps or not but perhaps can give you an idea with the vin issue? Id call your local highway patrol and see if they have any ideas for you. however no vin and no title at all is definitely a challenge

      That's how they used to be shipped a class 3 ebike capped at 28mph. But get real why would you spend 4-5grand just to ride slow. Yes it's legal to use this offroad but most people are using it for streets.

    Sounds like he’s giving fair warning and alluding to not speeding in order to avoid unwanted attention. ( I have the Sting and ride routinely on the roads in San Diego County with 0 problems as of 11/30/22)

    Can you put a on and off switch on the brown wire so you can just flip the switch for max power and off if you want it cap to the lowest setting?

      The Talaria has ECO mode that you can turn on, which limits the bike to 31 mph

      You can switch the brown wire but if a cop sees you doing 50 he's not gonna care. Unless you're expecting some kind of inspection where they ride your bike it's probably not worth the effort.

      or you could like, let off the throttle and pay attention to your speed? I dont have a switch on my car preventing it from doing 135mph but I don't drive 135mph everywhere. It can do 135 fairly easily.

    Anaheim PD don’t care about my Talaria (mx3). I’ve ridden it to work for awhile now going 45-47 mph and lane splitting. As long as you don’t do wheelies and follow traffic laws. Install a street legal kit consisting of turn signals and working brake lights. Mirrors etc. Cops could care less. The bike is quiet. Wear a helmet and gear. The DMV denies registration for these bikes. Some got through and got moped plates but majority of the time they’ll classify it as off road use only. Although some smaller Police Departments are starting to crack down on surrons and talarias because of teens or younger doing stunts and getting into accidents. Huntington Beach PD is one of them.

I own a electric motorcycle that came from China. It's registered as a motorcycle has MC tags. I asked about sur ron and they wont let me register it as a moped in my state.

    I've been pulled over 3xs and haven't gotten a ticket yet. No pedal kit. I also respect the laws of the road and don't speed or wheelie on the roads
    My sur ron lbx has over 6k miles my Talaria MX4 has under 1k miles 99% street

    Could i ride the Talaria Sting R MX4 on the sidewalks ? but in eco mode ofc, and i'll soon get one because i always wanted a dirtbike like a gas one but i heard its illegal to drive on the roads or sidewalks and they pretty loud and its more maintenance u have to do, but the Talaria is the closest thing to a dirtbike, well the Surron Ultra Bee is but i perfer the Talaria Sting R over Surron Ultra Bee and Surron X and Talaria X

    Crazy how this differs from state to state. Don't exceed posted speed limits, don't bob-and-weave between traffic, don't wheelie in traffic, USE HAND SIGNALS, qear a helmet and gear, and you should be good.

    The 28mph restriction, and especially the 750w restriction is absolutely assinine and causes far more danger to riders and drivers than riding these things unlocked. 750w is not even close to powerful enough to keep you at 28mph on an uphill, and will definitely struggle on most inclines. 28mph on public roadways is significantly too slow, as most traffic flows up to 40mph on city streets. In my opinion, there should be a category other than e-bike, moped, and motorcycle. There should be the e-moto class, or if necessary, these can be classified as a class 5 e-bike. Even class 4 offroad ebikes are still far too slow for road use. This would make it most safe for all parties involved.The restrictions should be no more powerful than 8kw motor, electronically limited to 40mph, and should not require licensure or insurance to ride. It should not be considered a motorcycle, and thus will not be highway legal, and may only be ridden on city streets. They should also not be eligible to ride on sidewalks or on bike paths, and only on surface roads. The only requirements to ride are for it to be registerd as a non-licensed motor vehicle with the DMV, and a number plate showing it is considerd an e-moto or class 5 ebike. Any electric motorcycle that is more powerful or faster than the limits stated should need to be fully insured and licensed as all others are. We need an in-between classification for these bikes. Registering it as a motorcycle in most places is impossible, as the VIN numbers are not considered registerable as a motorcycle, scooter, or moped. The law needs to catch up, as the limitations placed upon street legal e-bikes are unsafe and increase the danger to all parties involved where there are not bike lanes or bike paths.

Regardless you really can't ride a bike drunk, balancing is almost impossible and you really wouldn't get more than a block without faceplanting so its not a huge issue.

      Technically no. Class 3 is pedal assist to 28 mph. With the throttle, you'd need to drop the speed to 20mph for Class 2 status.

    The problem is some dumb parents bought these bikes for their kids or some dumb rich kids bought these bikes and started doing wheelies on the sidwalk and cutting in/out of traffic while giving others the middle finger. So what happened is that these adults got pissed off and went to the mayors and elected officials and now got them to impound these bikes. Stupid kids messed it up for everyone.

    I hate catching buses and maintaining a car is just not in my budget so I’m hoping that getting a talaria will be more convenient and cost efficient it would really suck if I bought one and I get harassed by the police I already have a pedal e bike but want something that goes a lil faster or can handle a hill with out losing half your battery

      probably not. trails allow class 3 at most and doesn't this follow the guidelines of any class. Class 3 is 28mph max with pedal assist only. no throttle.

      You can only register this as a 50cc/moped. Meaning 40-45mph only and just a drivers license. Cannot be used as a motorcycle.

Now sur rons are considered motorcycles and California is rumored to buy tech from Europe that can dyno the bike. But we all know sur rons and talaria the base ones can do 40mph+ some companies are making street legal versions now. Example lights, mirrors, plate holders, turn signal, reflectors.
      It's not illegal to a talaria but you must check your local laws if you wanna ride it on the road every state is different.

      I live in Michigan 20 miles or so from Detroit and people ride around on quads and actual dirtbikes and the cops don’t seem to mind. I have a class 3 bike that does 40mph and I had a state cop pull up behind me and I got nervous though lol. I just want to cover my bases though if I’m gonna drop 3k plus on a bike. I’ve been eying talarias for a min and haven’t pulled the trigger yet. I’ll probably wait till spring to get one though so it’s not sitting in the garage for months. It gets really cold here.

      I don't care anyways I'm glad Niu made a street legal sur ron clone. I can take it on the freeway no problems with police as it has a motorcycle plate.

    The biggest issue I see right now is the ultra fast e-bikes being ridden WAY too fast and aggressive by underage/helmetless kids. Some adults too, are bending the rules. Mostly kids in my view. I spend winters in Newport Beach area and enjoy walking and biking on the local bike paths and board walks. The e-bikes, IMO, are out of control. I have witnessed people riding 30-40 mph even at night(with no lights), sometimes passing just inches from oblivious walkers with dogs/kids/etc. I am surprised we are not seeing more enforcement (and more accidents). E bikes make up 1/2 the bikes on the bike paths now, by my estimation. These bikes belong off road or on major roads as a registered vehicle, not on bike/walking paths. Speed limit on the bike paths is 8 mph, FYI.

      The wattage ratings are based on rated nominal power. The 6500 you quoted is just the maximum it can pull for short bursts and would only be used from a stop or when trying to get up a massive hill

    I'm going to glue some pedals to my Tesla so I can drive on the bike path. There's less traffic. If the logic is a vehicle with an electric motor is not a motorized vehicle then it seems like it should work. I'd keep it to 30 mph like the fat tired ("ebikes") motorcycles do. No, but seriously. I'm an old school human powered cyclist, and I have to ride on the road to avoid all the ebikes on the bike path. I wouldn't care if they didn't ride like it was their first day on a bike. They all have goofy smiles on their faces though, so I guess it makes them happy.
