I have 40 years of motorcycle and driving experience, and I’ve never caused an accident, ever. I’ve been hit before, but it wasn’t due to negligence on my part. We certainly live in a selfish society now, most people just don’t give a crap about others.

A woman did this exact thing to my wifes uncle in Pennsylvania. Said the sun was in her eyes while turning left and hitting him on the crosswalk. No charges. Not even reckless driving. Rediculous. But that's how it goes it seems.

i recently moved from southern california and as a motorcyclist able to split lanes and see into cars as i passed i can tell you EVERYONE is on their phones,its a real problem..,zero excuses for this to happen.
That's not true, I live in SoCal and I'm NEVER on my phone while driving, I even have my "do not disturb while driving" feature turned on and my phone is in my purse. Many drivers yes, all drivers, no.

That man was walking in broad daylight in a crosswalk. The driver didn't slowdown or yield in any way and just ran him over. Anyway you slice it, that driver killed that man. It is not a tragic "accident". It isn't like it was a blind corner and the pedestrian was jay walking or darted out into traffic.

He hasn't apologized or offered to help with funeral arrangements because that would be considered an admission of wrongdoing (at least within the context of a civil suit). Trust me, his lawyers have told him to keep his mouth shut and keep his distance. They'll end up settling and he won't get any jail time (chances are likely that it will be charged as a misdemeanor since if they charge it as a felony they will have to prove beyond a reasonable doubt that he had a wanton disregard for safety).
I drive a lot. My job. I see countless drivers distracted by their phones, every day. I’m surprised that accidents like this don’t happen more frequently. This is why I always keep an eye on oncoming traffic when walking across the street. Pedestrians aren’t always easy to see, even in daylight. Appears he was probably more focused on traffic coming from the right. Looks like he was in too big of a hurry, as well as possibly being distracted by his phone.
A woman i used to work with killed someone with her car in a similar distracted driver case. I figured she was finally gone for good. Nope.. She got weekend jail and company bent over backwards to accommodate her and stacked her work on top of me. Felt so bad for the family's and their loses. Fast forward a year or so after and she finally gets fired for medical paperwork fraud. The company wasn't having any of that. It's the victims family that matter. Not this idiot.

Because of where this happened (California) coupled with his celebrity status, I'm fairly certain nothing is going to happen to Josh Klinghoffer. The judges and lawmakers in California don't actually enforce punishment for crimes anymore. Sadly, the only thing that will happen is a lawsuit and even then, it probably won't be for a lot.
it was probably distracted or impaired driving. But i will say, the frame around the front windshield has blocked my view before, to the point where i have to move my body to try and see around it, to make sure i don't hit anything. This could have just been the worst blind spot timing ever...
It’s the A-pillar blind spot and SUVs (vehicle here) are notorious for having thick A-pillars. The way the accident unfolded in the video is exactly how the blind spot fools the driver. It’s mimicking a roundabout turn. Having said that if on his phone throw the book at him.
Huge Josh Klinghoffer fan here, I've listened to several podcasts, talk shows he's been in, listened to a large majority of his Pluralone, Dot Hacker, and RHCP stuff. This is my standpoint, in no way did Josh act in malice. Josh was clearly distracted while driving (seen clearly by the street cam footage). Had Josh been acting out of ill-intent, he absolutely would have sped away to avoid persecution. Regardless, an innocent civilian lost their life and that is not acceptable. However, Josh is not this devil that many seem to believe he is from this. This was a fatal-accident, not a malicious and intentional murder. With that being said, even as a fan of Josh Klinghoffer, I absolutely agree that consequences must be administered. This was a wrongful death indeed.
The same goes for every post about any celebrity. I still care to hear about it because RHCP is a band I regularly listen to and thought about seeing. I'm definitely interested in knowing how Josh is treating the situation he got himself in.

Is there anyone out there NOT playing with their phone on the road?? I drive trucks and higher profile vehicles and I would say about half of the people I see are talking, texting, or watching a screen while they drive.

I see people with their back turned to traffic on busy roads, stupid these days. One time I was turning left at a light and that blind spot got me. Didn't see the dude at all crossing the crosswalk. Luckily he jumped on my hood. I felt terrible and was not distracted. He was pissed. Rightfully so haha
I'm amazed by all of the interesting excuses being made on the driver's behalf. People will come up with excuses for anything. A few commenters had the balls to say the pedestrian was partially at fault for not being aware there is a car approaching him from behind. I hope these people apply the same excuses if this happens to someone they love.

ZERO! I can 100% say with absolute certainty, that I’ve never texted or talked on the phone while driving. I saw that problem coming during the early 90s, and I wanted no part of it. Phone is turned off while I’m driving, I love driving, more than talking, and I plan to keep it that way.

A couple of weeks ago I literally had to put my hand on this lady's hood of the front of her car crossing the crosswalk because she was on her phone.

He hasn't apologized or offered to help with funeral arrangements because that would be considered an admission of wrongdoing (at least within the context of a civil suit). Trust me, his lawyers have told him to keep his mouth shut and keep his distance. They'll end up settling and he won't get any jail time (chances are likely that it will be charged as a misdemeanor since if they charge it as a felony they will have to prove beyond a reasonable doubt that he had a wanton disregard for safety).
I drive a lot. My job. I see countless drivers distracted by their phones, every day. I’m surprised that accidents like this don’t happen more frequently. I wish everyone would just shut their damn phone off while driving.
I’m a huge fan of PJ, and I like The Chili Peppers too, but he needs to pay the consequences for his actions. It wasn’t intentional, but it certainly was negligent. To what degree is going to be for a jury to decide.

@@MusicalPixels22 No, but since the victims body is just splayed in the middle of the road, it would be logical to have at least one or 2 vehicles shield the body from incoming traffic as police arrive at the scene. Drivers may miss seeing a body in the middle of the road.

This is why I always keep an eye on oncoming traffic when walking across the street. Pedestrians aren’t always easy to see, even in daylight. Appears he was probably more focused on traffic coming from the right. Looks like he was in too big of a hurry, as well as possibly being distracted by his phone.

A woman i used to work with killed someone with her car in a similar distracted driver case. I figured she was finally gone for good. Nope.. She got weekend jail and company bent over backwards to accommodate her and stacked her work on top of me. Felt so bad for the family's and their loses. Fast forward a year or so after and she finally gets fired for medical paperwork fraud. The company wasn't having any of that. It's the victims family that matter. Not this idiot.

Because of where this happened (California) coupled with his celebrity status, I'm fairly certain nothing is going to happen to Josh Klinghoffer. The judges and lawmakers in California don't actually enforce punishment for crimes anymore. Sadly, the only thing that will happen is a lawsuit and even then, it probably won't be for a lot.
it was probably distracted or impaired driving. But i will say, the frame around the front windshield has blocked my view before, to the point where i have to move my body to try and see around it, to make sure i don't hit anything. This could have just been the worst blind spot timing ever...
It’s the A-pillar blind spot and SUVs (vehicle here) are notorious for having thick A-pillars. The way the accident unfolded in the video is exactly how the blind spot fools the driver. It’s mimicking a roundabout turn.

Huge Josh Klinghoffer fan here, I've listened to several podcasts, talk shows he's been in, listened to a large majority of his Pluralone, Dot Hacker, and RHCP stuff. This is my standpoint, in no way did Josh act in malice. Josh was clearly distracted while driving (seen clearly by the street cam footage). Had Josh been acting out of ill-intent, he absolutely would have sped away to avoid persecution.
Regardless, an innocent civilian lost their life and that is not acceptable. However, Josh is not this devil that many seem to believe he is from this. This was a fatal-accident, not a malicious and intentional murder.
With that being said, even as a fan of Josh Klinghoffer, I absolutely agree that consequences must be administered. This was a wrongful death indeed.
Maybe John Frusciante will return to Red Hot Chili Peppers.....

🤦🏻♂️NOPE it wasn’t an accident the pedestrian had the right of way NOT the driver. The driver should have STOPPED until the crosswalk/walkway was cleared. The driver will have to live everyday knowing he killed somebody by his actions.

If he was actually driving with a fully functional brain, there would have been time to stop or at the very least slow down enough to probly prevent a fatality.

There is no such thing as “jail for 20+ yrs.” Jail is a temporary holding cell. Prison is a long term holding cell.
Is there anyone out there NOT playing with their phone on the road?? I drive trucks and higher profile vehicles and I would say about half of the people I see are talking, texting, or watching a screen while they drive.

It sucks that the guy was hit by a distracted driver, there should be charges filed. That being said I walk about 3 miles most days, i never assume someone is going to stop. I see people with their back turned to traffic on busy roads, stupid these days. I truly believe 99% of pedestrian accidents could be avoided if the pedestrians weren't so stupid and just as distracted.

The pedestrian had no chance here, he is looking right for traffic not behind. The driver is obviously paying zero attention, there is a big sign on the right that has a yield to pedestrians on it. How can you never ever see the guy until you hit him. Pay up big

I have made turns where I can’t see the person walking . The pillar on my vehicle blocks a moving person and I’m also moving. I’m not distracted. It was an accident. He stayed in the scene. That’s why he’s not in jail

People are not aware of blindspots until its too late. People with SUVs run over their kids on their own driveway
One time I was turning left at a light and that blind spot got me. Didn't see the dude at all crossing the crosswalk. Luckily he jumped on my hood. I felt terrible and was not distracted. He was pissed. Rightfully so haha

I'm amazed by all of the interesting excuses being made on the driver's behalf. People will come up with excuses for anything. A few commenters had the balls to say the pedestrian was partially at fault for not being aware there is a car approaching him from behind. I hope these people apply the same excuses if this happens to someone they love.
And these are the same people who probably complain about the "usual suspects" getting away with commiting crimes 😂

Before anyone passes judgment on Klinghoffer, ask yourself how many times you text or scroll while driving? I’m sure you are very careful, I’m sure Klinghoffer thought so as well
ZERO! I can 100% say with absolute certainty, that I’ve never texted or talked on the phone while driving. I saw that problem coming during the early 90s, and I wanted no part of it.
Phone is turned off while I’m driving, I love driving, more than talking, and I plan to keep it that way.

The fact is, although there are a vocal group of people who replied who claim they never text or scroll while driving, I see it every day from all types of people. Sometimes I do it myself. This is just manslaughter. It's a marked crossing, the man was slowly walking across it. There's zero excuse to be hitting him here if you're paying attention to the road. You should be scanning the crosswalk to confirm it's clear while beginning to slow down as you approach. There's zero reason for you to ever be hitting anybody unless you're looking at your phone.
