    There's no point of a jury if the judges get to sit in the room with the jurors while they deliberate...

      It could be worse, they could have a Western legal system where the more money a person has the more likely they are to go free.

      I'm afraid that in a system where lay jurors and judges deliberate together, you will get something like the Soviet "people's courts": In those courts, the ordinary citizens invariably voted with the Soviet judges because they were afraid to offend the government.

    I thought of Japan as being a civilized society. When you discover that there really is no justice at the core of a legal system, it makes you rethink calling Japan civilized.

    • @deadbutmoving
      @deadbutmoving 4 роки тому

      Japan is definitely more Civilized than most of the West. Westerners try to stand on the moral high ground with their endless debates and moral posturing. As if mere words and moral positions somehow translates into a more just society. It doesn't. There is value to the fact that pragmatically speaking, the Japanese have far fewer in prison and thus far less people being falsely convicted or executed. Just look at the long list of men that were wrongly executed in the American justice system.
      I don't know what happened to the Western world where intentions have become more valuable than results. The intentions of the Western legal system may be better than the Japanese, but the end results cannot match Japan's legal system.

      @@khav11 Does it make you sad that Japan is just a much safer country than the West? Women and children are much safer in Japan than America. And the prison population in America is horrendously huge. Americans often say China and Russia are police states yet America's prison population is way more than those countries. America has as much people in prison as China but China has 5x their population. Not to mention the amount of ass raping that happens in American prisons. There is a long list of innocent American prisoners who were executed. America dominates the world in miscarriage of justice. That's not even including racism and discrimination which as of late, has really reared it's ugly head for all the world to see.
      For Westerners to criticize Japan for it's crime, judicial, and prison problems is laughable. Westerners are definitely not on the high ground on this one. I dare say they are inferior to Japan in so many aspects. Japan does not have ultra fucked up major cities like Detroit, Baltimore, or LA.

    When I hear 99 percent conviction rate im hearing a fuck ton of innocent people being convicted it's completely unjust American justice isint perfect at all but I prefer being judged by people than a 99 percent conviction machine

    • @benw-l7k
      @benw-l7k Рік тому +1

      If this was true that innocent people were being locked up Japan would have a much higher prison populations. The reality is that in Japan people only get tried in court if the government is 100% sure they will get a conviction. If there is any doubt they just wont be tried in the first place. Theres no "we have a bit of evidence, lets see how the jurers decide" its either, they have enough evidence and proceed, or they just don't.

    • @smzig
      @smzig Рік тому +1

      They are very selective about who they actually go through with charging; only pursuing cases they can significantly prove and win. However, even accounting for that fact there would still be innocent people charged and deemed an "open and shut case" which is why the trial and judges need to be vigilant in due process. It's my guess why they've become so lax during trials is because of that selectivity in how they charge people.

    It's about time.
    Japanese in their nature, so submissive and obedient to the authority.
    They'd take anything that the government gives to them.
    Questioning the authority is unwritten sin. You'll be criticized and criminalize for it.
    Having said that, other countries like US is becoming Japanese-like lately.

    Do your research. Judges deliberating with jurors is not different from the Western system. We have it it Denmark. Germany doesn’t have jury’s, but lay judges deliberate with the judges. I don’t agree with our system here in Denmark, but you can find similar system in the West.
