The Act was made applicable to the state of Jammu and Kashmir via Schedule 5 Table 1 Entry 57 of the Jammu and Kashmir Reorganisation Act , the said entry deleted the word 'Jammu and kashmir' from Section 1(2) and left the section 11 , but in effect section 11 now has no application on the J&K because the Limitations Act is applicable to it and the Limitation Act of J&K got repealed by the J&K Reorganisation Act (entry 77 Table 3 Schedule 5 of the J&K reorganization act)
hello sir, Thank you for explaining the topics so well. I just have a doubt regarding the J&K applicability after the Jammu and Kashmir Reorganisation Act, 2019
Sir sec 11 (2)(a) k according agar j&k m suit terminate ho gaya ho to India m sue kr skte h and 11(2)(b) k according dono parties ka place of birth agar j&k hi h aur contract b wahi hua h to bhi wo india m suit file ker skte h kya??
As per the exception of this section that the parties were domiciled in that state but section 11 m jb outside territories contract ho raha h toh party may be outside territories ho sakti h phir kaise yh exception h
Thanks for this session, I watched two to three different sessions of others, but I couldn't able to understand the same. I understand it after going through your video. Thank you so much 🙏🙏🙏
Sur sec 11 is lex foxi but it doesn't mean law of the land Lex fori is law of the court Therefore here when a suit is instituted it means the law of such court will apply in which that suit is instituted
Aisa koi pure u tube pe nhi padhaya hoga sir.. Example k through 🙂. Thank u sir
Excellent 👌! Thank you for the efforts 😊

Lex fori is law of the court
Therefore here when a suit is instituted it means the law of such court will apply in which that suit is instituted
Well explained
Lex fori means law of forum
Lex loci means law of land...pls correct it
It is by mistake n thanks for the correction
