    Thank you both for all your input. I have an attorney. I've been dealing with work comp. over 8 years. I really get a lot of information just listening to you two. Hopefully soon I will settle, but because of you two I know what to expect. Thanks.

    You guys are so dope to me you guys explain the California work comp system to a T to wear I understand that’s wuz up i’m going through it now. I’m scheduled for surgery in like two weeks but I’m low-key indecisive. What do I do? You guys keep it up wishing you guys prosperity and the best in 2023 you guys really know what you’re talking about for sure.

      Hi again Frankie! there is no standalone decreased earning capacity benefit. Depending on the case, this could be something to evaluated by a vocational expert. Generally, a stipulation (open medical settlement) is an agreement to the permanent disability rating and permanent disability benefits are paid over time.

    I just got a judgement on my comp case and the judge approved the settlement. I know they have 30 to pay me my money but will they take the hole 30 days or dose insurance companys typically mail out settlement checks asap. I know there is no telling but im wondering if its a tipacol thing to have to wait the full 30 days or do they jump on it and get you your money asap. Anyone out there can tell me from experience or because they have saw or hurd about a case?

      Hi Monica, thanks for reaching out. They usually jump on it right away and don't wait the full 30 days.

      Usually they pay in one to two weeks. Technically they have 30 days, but usually the adjuster will get the check out ASAP so they don't risk being in a penalty situation. Also, some insurance companies actually have contractual rules in place for their defense attorneys that require settlement payment instructions to be transmitted to the adjuster within 24 hours of judicial approval. This is to ensure that checks are sent on time. Hope that answers your question.

    If I'm fired while on comp , when my case is ready to settle , is my only option a cnr?

      No, you can still do a Stipulated Award type of settlement regardless of whether you are employed by the same employer.

    What happens even after the facilitation you end up going back to work do you have to pay the lawyer

      In CA, the payment for the lawyers only comes into play if you are awarded a settlement via Stip or C & R. The amount comes from the award, never from your pocket.

      No, it’s very common especially when it's regarding the same case.
