10 yrs on work Comp ask for a knee replacement in 2017 now getting it in 2024 and IME said nothing wrong with my back mild L1-2 bulging mild L2-3 facet injury L4-L5 minor degenerative changes what's with this minor/mild BS no sex and pain all the time after falling downstairs WORK COMP hates me!!!

Please do a video: police officer heart work comp case moved to the east coast. Cannot find a doctor I like. Upset I cannot just use my original medicare and choose any doctor. How about switching to a medicare advantage plan and not have to deal with worker's Comp.

So for instance you guys brought up going to the gym. My doctor has given me no no restrictions but I am totally and temporarily disabled but he is telling me I should go to the gym and exercise that I need to build my strength back up so that I can go back to work. That's a problem if that's what he's telling me to do cuz it's not in writing he just tells me

For instance I'm on workers comp. I've been on workers comp for 7 months. I fell from 10 ft high. I have PTSD from the fall. My workers comp doctor keeps requesting behavioral health and they keep denying it. I need help. So I finally went to my own doctor and he's authorizing behavioral health. I got to get help. It's serious and they're not taking it serious
This needs to change! I'm currently dealing with a WC insurance company that didn't pay me for a month, denied surgery at 1st, then denied physical therapy at 1st and is now withholding my check for no apparent reason. These pukes need to be held accountable!

What happens if I accepted a new job offer online and signed the job contract online, but I have not physically started working yet? Does this count against me in my workers' compensation case? I’m under pressure because I have no other source of income, no EDD assistance from the government, and most of my savings are gone. On top of that, the workers' compensation insurance carrier denied my case, and I’m still waiting for the state-appointed QME doctor to evaluate me.

Okay so I was recently denied treatment for psych therapy. I recently got the letters in the mail for what they did approve which was today and I'm looking for the denial and I do not see it but yet I know they denied it cuz they emailed it to me. I told my attorney they denied it. She said they need to be notified. Do I need to request this form?
Okay so I got a question. I was recently denied psych treatment from my injury from falling from 10 ft high which I'm suffering from PSD which the doctor understands and ordered. I should be getting this form along with my attorney or what happens next? Or should I request this form cuz I want to appeal it. This is a real thing that I'm suffering with. I can't even drive. I'm scared of driving over the mountain cuz I think I'm going to fall again

Hi , I’ve had two surgeries elbow and rotator cuff the same time.I’ve collected Workmen’s Comp. checks for a little more than a year I had my final doctors visit and all I am working without restriction it’s been six months will they offer me a settlement
Have you seen a QME yet? Normally your Primary Doctor (PTP) will say that you are MMI at some point. This means that you have leveled off medically. Given what you describe it doesn't seem like you would be discharged from care without future medical. When you are MMI, you are typically assessed permanent disability for functional limitations. You can have permanent disability and return to work without restrictions. Once you have leveled off, the adjuster may offer a settlement based on your PTP, but usually you can do better with the right Qualified Medical Evaluation (QME). Sometimes the PTP will write a good report for you, but we can't tell without seeing it. We would be happy to take a look at your case and give you a better answer with specifics. What happens when you have reached MMI and had an IME do you reach a settlement?
When you are MMI you are given "ratings" of permanent disability, permanent work restrictions, and future medical (provided the doctors feel you need it). If you have permanent disability and your work cannot offer you permanent modified work, then you are also entitled to a supplemental job displacement voucher, which is a reimbursement for education/job training. Once you are MMI for all body parts, you are in a position to settle your case. There are two types of settlements that may be offered, Stipulated Award (usually means periodic payments of permanent disability with open medical care) or Compromise & Release (Usually this is a lump sum payment to close your entire case including closing medical). The value and which option you choose depends on what is going on with your case.

Each employer/insurance company can have a different MPN. Sometimes there is overlap in providers, sometimes there isn't. I know this isn’t legal advice, just curious? Waiting to hear back from my attorney and I’m not in California. Had my second IME in 10 months judt yesterday and I got an email today my “seasonal job” has ended. So I’m being let go after 11 months. Clearly something happened at that IME, what are some scenarios if you don’t mind throwing a few out there. I know it’s not legal advice and you don’t have the answer, just hypotheticals would be awesome. Thank you!
That is a great question. We are a California based company so we can't be sure the laws here are the same where you are. In California work restrictions are the most common reason for being released from your job in connection with a workers comp case. In connction with medical evaluations you are typically given work restrictions. If you are provided work restrictions, employers are obligated to make a good faith effort to accommodate. If they can't, then technically you can be let go. Sometimes, employers will say they can't accommodate work restrictions, without even bothering to try. So in that sense, accommodations can be an unlawful pretext to retaliate against individuals that have filed workers compensation claims. Just something to be aware of. If you feel like your job was mischaracterized as seasonal work, when it really wasn't, you may want to talk to your workers' comp attorney or an employment lawyer to see if there is any funny business going. @@WorkCompTalkPodcast Thanks so much! After I posted this I saw it was actually dated the same day. They did make a good faith effort, it’s a physical job and I’ve been taken off of work completely. So I have even said logically it makes sense because I cant do it. Just wasn’t sure legally. Still haven’t heard back from attorney, waiting on the MRI and also my attorney in one of his videos said he’s not an expert on job loss. Although, I know he would know about this. State disability allows you to work. Retirement disability allows you to work. Look into it. You have missed spoke.

I did want to let David know there are situations where people are on state disability and still work. We have one at our job The state allows her to work 20 hours a week and they send in a work coach a couple of times a week to help her with her job, hers is not so much a physical disability but a mental and she's been employed with our company over 20 years
Why do we accept being the only developed Nation ON EARTH to still retain private Healthcare at the cost of WORSE health outcomes compared to countries with fully socialized medicine? An insurance company may as well be a vampire
Insurance has both increased the cost of medical care and at the same time reduced access. On top of the normal struggles people go through with private health insurance, workers comp laws largely require preauthorization for medical care requested as well. This adds another layer of complexity for injured workers. It's not fair.
