Hi Bilal, hi Carmen, thank you for this video! I was injured almost 2 and a half years ago. Payments stopped March 2023, I still had a few illness days at half pay and some vacation hours that provided some money. I told my attorney immediately when payments stopped. He said no they haven't, the doctor just has to send in his final report. We'll Bilal, they did stop and soon after that I was out of sick days, separated from my job from running out of those sick days and have not received any income at all in over a month! I had a QME last August where he found additional injuries that I had not claimed but were a direct result of my employment. I've tried to file for SDI but the doctor my attorney picked out for me, had my paperwork since May and has not processed it yet! I also had a functional capacity evaluation in February 2023 and it came back saying that I could not work right now. The QME i had in August of last year had requested a couple more additional tests to be done. Those were just barely scheduled last month or June actually of 2023! I have been emailing my attorney several times that I just want to settle. This has put the biggest Financial strain on me and my husband and as a result we have to move! Then last week out of the blue I received a notice for an appointment with a brand-new doctor scheduled at the end of September as well as an appointment scheduled in the middle of October! I never agreed to starting this whole thing over again! I feel like I'm someone's meal ticket! Also I recieved a notice for an MSC on July 19, but my attorney said he will be present but I didn't need to be! He also said that the appointment with the new doctor in September was scheduled by the defense as back up? I think I deserve real medical attention! Please advise me...thank you so very much
What does it mean when they’ve denied your claim, and then out of the blue the day of the appeals hearing you’re called and they want to settle? I also have an EEOC charge being investigated as well for retaliation and discrimination regarding my disability. Does one affect another?
What about if they turned your benefits off stating that you denied modified work but you can prove that you didn't deny modified work and you have a follow-up doctor appointment that gets you cleared for state disability, plus multiple qme reports stating I'm TTD. When should I finally goes to trial for the benefit portion is that going to make them liable from that point forward plus penalties
My case has been closed, but I left the medical open. They have been denying a much need surgery for three years. Excuse after excuse causing more pain and possibly like term issues. I'm also considering a medical buyout but want and need an attorney to do this. With CA laws of not allowing a new attorney after settlement, what are my options of getting an attorney to help with buyout so I can jist pay for the surgery.
And what happens if after going to the primary care physician and they order another going to orthodontist I then get sent to the orthodontist that they say is in their Network and all that but they never approve of the work and now they no longer provide with that dental place what happens now
So i have a question Does the ttd someone has collected throughout their case get deducted from the final settlement amount? Example: A settlement for 100k and you have received 30k in ttd throught your case Would you only get 70k? Or does that ttd not count on the final settlement?
Hi Alejandro, TTD is meant to replace your lost wages while you are recovering from and injury and is not deducted from settlement. If it was Permanent Disability Advancements or if you were getting TTD and SDI Benefits at the same time, yes they can add those to the settlement.
