Angry judge erupts during sentencing of convicted murderer

- If a judge could throw the book at a woman, he managed to do so on Wednesday.
Not physically, but certainly by his stinging words. He had a lot of words for 31-year-old Camia Gamet, the woman convicted of killing her boyfriend Marcel Hill in March. Gamet claimed it was self defense and showed no remorse.
A First Degree murder conviction by law meant she would get life behind bars. Still, while family members spoke she would only roll her eyes and laugh, but Jackson County Circuit Court Judge John McBain would have none of it.
"You're gonna shut your mouth or I'm going to have some duct tape put on it," said Judge McBain.
A jury convicted Gamet for stabbing and beating to death Hill. Her lawyer argued she acted in self defense, because she claimed she killed an unknown attacker in a dark room. The judge wasn't buying that and called it the worst cold-blooded murder he's ever seen.
The prosecutor argued Gamet's actions were premeditated and deliberate. She stabbed Hill 11 times and had a history of violence against him.
Hill told police in March of 2013 she hit him in the head with a hammer.
Family members say justice was served and they hope a lesson was learned about how abuse can come in all forms no matter the gender.
The fact the lawyer didn't do anything is amazing. Even the lawyer didn't care if she went to prison.

This is the first time I've EVER seen a lawyer verbally express his "fuck it, do what you got to do, judge" attitude in an open courtroom. This woman really was that unredeemable, jfc...🤦♂️
That’s the interesting thing about good defense lawyers. When it comes to clear cases like this, they really dread their job. They defend people because they stand for fairness in the American court- everyone deserves the right to let their voice be heard. But once a decision is final, they don’t B&M over it. They let the judge have at it since their duty’s now done.
I don’t know for sure about this as I’m unfamiliar with our legal systems regards towards court hearings, however if the person feels they weren’t represented to the best of the lawyer’s abilities can’t they redo the trial or something?
I don’t remember exactly what it is they can do, but I remember hearing something along those lines. Someone correct me if I’m wrong please
@@skellie4580 that’s correct but it has to be proven that the lawyer was either neglectful or incompetent. If they’re able to show some reasonable evidence as part of the defense, even if it’s unsuccessful in changing the courts opinion, then a retrial is unlikely. Basically if they had any reasonable argument formed for their defendant then they’re considered competent.
@@Flaming_penguin Ahh I see, thank you for clarifying

@@mylra4689 fair point but in the case represented in this video, there were no firearms or other weapons involved beyond the knife she stabbed the guy with. I should have provided more parameters in my question; if two or more people are involved in a hand-to-hand fight, and the individual claiming self-defense doesn't have a mark on them, how is that self-defense?
@@Tehstampede The idea is that an equal amount of force ought to be used as offered by the perpetrator.
If the perpetrator slaps you then you cannot pull out a gun and shoot him. The exception is if the perpetrator is a burglar in your house. Generally you do not have a duty to retreat, though different states approach this differently.
I represented a guy who was charged with felony murder. He and his friend was on the property of a small farm and in the act of stealing some things from the property. This was in the wee hours of the morning.
The property owner came out with a rather large gun with hollow point bullets and claimed one of the burglars lunged at him.
He blew him away. He died. My client ran and was later found by a K9 unit. He was charged with the murder under the felony murder doctrine.
There was never any marks on the property owner. And the story about being lunged at was probably fabricated.

Put it this way. Sure, it's unprofessional, but look at this form a personal perspective. If you have a judge who shames the killer of someone close to you etc., the first thing you would think is a bit of gratitude because he understands and wants to remind the killer about how everyone feels about them. If he just acted normally, it's like the judge is acting in a "been there, done that", attitude, like he doesn't give a shit about the outcome or how it transpired. Sometimes it's gratifying if the judge feels for you when you are at a grievous time, considering unlike you, he had nothing to lose since the killing occurred.
That was a mouthful, but I think this should clear it up.
I really hope that the Judge didn’t get in any trouble at all for being “unprofessional” or whatever people may call it, she deserved worse…

During sentencing a judge can pretty much unload as the case has been settled and they are rendering what they believe is the proper sentence based on the law in the state and the verdict by the jury. Judges generally have to be super professional during the trial portion of the case so to not prejudice the jury but once it’s done they can pretty much say what they feel with regards to the defendant if found guilty.

I wholeheartedly agree with the judge. Bad/abusive relationships going towards the man are never taken seriously. This should be how its taken.

Honestly, I think he was a bit calmer than I could've been.
The fact that she acted like it was funny, treating this like a school-esque punishment, makes it even worse.
The judge did good, and had a right to get angry.
I couldn't be a judge. I'd be done hauled off and got myself arrested trying to sentence some of these people. I'd have prolly thrown my gavel at her when she laughed.
I know abuse can come in all forms no matter the gender, but what about athletic status? What about age? And what about occupation?
Bro im dying at the end, "Now after hearing all that, Gamet herself suffered no injuries during that attack."
Love seeing a judge not being a robot! Thank you Judge Erupts!
He would've put Simpson's sorry ass away in 1995.
He would’ve put Chris Watts on death row.
He is like Darth Vader
They have to act unbiasedly so that everyone is treated equal no matter how serious the crime, that would be an infringement of so many rights the way the judge acted I would appeal the shit out of that case.
Judge throwing a tantrum
I like to see a representative of the justice system show emotion in a trial. The judge is a good man who expressed his outrage of this murder. I am sure the family of the vicitm was greatly comforted in that he further expressed what they felt.
Tony63909 yeah. She committed a heinous crime.
I'd rather not because he/she might be biased based on emotion
Hell nah. Emotion DOES NOT belong in the courtroom. Decisions should be made on facts, not feelings.
@@EastonWest1211 The decision was already made, he just handed it down.
@@talleywa5772 yes I understand that, but it is still unprofessional and should not be happening in the court of law.
I'm sorry. Judges are supposed to be more composed and neutral regarding their personal feelings. Are not supposed to show "Like" or "Dislike" toward either the plaintiffs or defendants. Not saying the verdict was wrong or right. I'm just going ny the emotion shown by the Judge. That's not good.

_I'm pretty sure the guy wasn't in love with that Golem. He may not have had any other choices out there or he may not have thought he did. Amber Heard also rolled her eyes when audio was played of her admitting to hitting Johnny. Seems some women think them abusing men is some kind of joke.
Most women think that.

@eeheh i mean the comment is right there. no need to repeat it XD
most women think that- people literally laugh when they see or hear about that.... especially police
That’s because there’s infuriating double standards in society regarding gender
Stabbing someone 11 times is not self defense, and that judge...wow, he's no one to mess with.
Unprofessional, also grounds for a sentence appeal. You could quite easily claim the judges emotiins clouded his judgement. Likely wouldn't change the sentence but waste millions of dollars

This is probably the most human reaction I've ever seen from an Officer of the Courts.
As a non-American, I am a little taken aback that the judge showed so much emotion and shared, on record, his own personal views towards the defendant and her crime.
It makes me wonder if her conviction and sentence were based purely on law and evidence or if some of the judge's personal feelings about the case were a factor.
I don't consider it at all wrong, if that is the case. In fact, I find it refreshing to hear the judge is still fired up about upholding the law and showing he is on the same wavelength as the rest of society.
(I hope she has a really bad time behind bars, too. Absolutely reprehensible!).
Well, is English commonwealth law so the judge only presided while the jury, 12 of them, issued the verdict and sentence. He only spoke after the sentencing phase.
@@hikerguy3895 This isn't in english common law dummy this is in the US.
I’m sure it was based 100% on the law, the reaction is a human reaction though in regards to his words. I don’t feel it was personal, instead his empathy for the loss and their family, including the woman’s lack of empathy and remorse is what orchestrated said reaction. He cares for human life and it’s that care and love that drove him to react this way.
The law and the evidence is the reason hes so angry because it shows that she really did that. He wouldnt be angry at her for doing nothing wrong.
