It takes a good prosecutor to convict an accused but it takes a great prosecutor to convict an innocent man.

I was assaulted in a drug rehabilitation facility. There is video evidence but I do not know if said evidence has been destroyed. The facility did not report the assault to my parents (I was a minor) or the police which is both illegal. This happened 3 years ago and I am finally taking legal action because of my counselor there who said that nothing can be done because consent was tricky. I found out later that coercion (the type that happened to me) is illegal. I hope that my case will have some justice being served.

It's really a civic matter not a criminal matter. The odds against having an opportunity to deal with it in either arena are slim because of the unlimited statutes of unlimited opportunity whereas the accused has no ability to effectively provoke or invoke a legal action take place. It's an impossible situation and it's one sided argument.

@@17thdoctor My girlfriend got raped by my best friend and we don't have proof. Only how he's been acting, things hes been doing, text and calls after it happened. It's really stressful for both of us. He's just trying to lie his way out of it. I just can't let him because my gf has already been through too much and it really did happen. I dont care what happens to him if he dies or not. If you allow yourself to rape your best friends girlfriend then you shouldn't be allowed to live.

If the victim has psychological problems after the event then that’s.a huge indicator the crime actually happened. You should look into cognitive dissonance and see if you truly are innocent.

people can create all kinds of constructions in their head after the fact and every person reacts differently. So not really.

This is so dangerously untrue. I spent 22 years as a defence solicitor in Scotland and can tell you that in every single case I came across that went to court the complainant always claimed "psychological problems".
I had one case that sticks in my mind even to this day that makes me truly believe the MeToo movement has RUINED the CPS and Police's decision-making. In the complainant's original police interview, she used the words "None of what we did was consensual except for kissing" We the defence obtained text messages sent after the alleged incident where the complainant not only confirmed that she had undressed consensually but also got on top of the accused as well as did other sexual things with him. The complainant also alleged that she didn't want to go to a hotel room with the accused but again we uncovered text messages that not only did the complainant fully know she was going to a hotel room with the accused but also that she refused to go ANYWHERE ELSE other than a hotel room.
Cases like this are damaging to REAL victims of Sexual Assault and the fact dangerous ideas like that go through people's minds is actually horrifying.

@@TheDirtyREMF I wrote that in the height of my PTSD so it was definitely emotionally motivated. I agree that psychological problems aren’t the end all be all for sure. I would say tho that in the cases you listed. That even if one consented to some things one can always withdraw their consent. So I would argue that undressing and agreeing to a hotel still means that you can say no after that point and that it SHOULD be respected. But ofc the victim made choices to that point that would blur the lines more.

Most SA claims are bogus. She cannot PROVE it. Her word alone is not enough.
She cannot PROVE she did not give consent either.
Burden of proof is on HER, not you prove your innocence.

    • @crazysquirrel9425

@Basketcasebrian Not under the presumption of innocence requirement.
If you accused someone of a crime, YOU have to prove it, not them DISPROVE it.
A mere claim is not proof of a crime.
Our justice system is awfully screwed up.
Oh and her word alone is NOT worth 2 cents.
Presumption of innocence means the accuser is AUTOMATICALLY a liar.

Canadians CAN effect changes to their governments and judicial systems.
