The war is declared by Laufie when Odin arrives, before that, it would mean Loki and the other characters were trespassing into Jotunheim and also breaking a peace treaty. Any frost giant killed during this time, i would argue, could be considered first degree murder.
By technicality, Loki standing against the Bifrost guard is the equivalent of going to area 51, and telling the guard you dug an entrance into it. Which for being a government agency(the gatekeeper works for the throne) will demand for the truth to be told or just kill you for violations. This charge would most likely be trying to incite riot or an aggravated harassments.
This does not apply because Loki was the ruler of the nation, and had free reign to go where he pleases. If anything Heimdall committed both assault with intent to kill, and grand treason as he attacked his king
@@patricknathan5805 Exactly! It's more akin to the President telling a guard that he's been sneaking in and out of Area 51, then firing the guard. Loki is technically/legally allowed to do all that.
You're not allowed to "kill someone for violations" because 1. The guard didn't witness a thing, so there's no evidence of it, 2. Trespassing, even onto a location like that, is not a de-facto capital punishment crime, 3. The guard was not acting in self defense.

Loki, as a Prince of Asgard could probably claim sovereign immunity/diplomatic immunity. Stane's lawyers would get things reduced or get him into a facility due to diminished capacity or some such. Red Skull, definitely war crimes is the biggie and technically, he did end up in a prison of sorts.
We all know Loki was tried and convicted on Asgard under Asgardian law, though considering his ridiculously long lifespan and the fact that he has cheated death at LEAST 4 times so far...it could be argued he's already served out most if not all of that. Also the "death penalty" sentence would depend on where and when each villain committed their crimes...because you know...there are more places out there than just America. Each of these villains committed at least SOME of their crimes internationally (and in Loki's case, intergalactically), so the charges for crimes committed in those jurisdictions would be subject to the laws of said jurisdictions.
@@HOLDENPOPE ...Which doesn't have a death penalty, so the comment still stands. There are other places than america, most of them don't have a death penalty. Why not appeal to the wider audience? If its just based in american laws, any first degree murder charge could be 'Death' instead of 'life', or a 20 year sentence, depending on the judge. For Loki, we’re looking at the 2011 Thor and 2012 Avengers. Also, Loki freezing Heimdall is technically in a grey area between self defense and first degree attempted murder.
Since no one has said it yet (from what I can tell) everything Loki did during the Avengers movie could and probably would be pardoned as it was later confirmed that Loki was under the scepter's control until Hulk smashed him in Stark Tower. Not only that, but he was tortured by Thanos until he broke meaning that even *if* he wasn't under the control of the scepter, he still did those actions under duress/unwillingly. Duress wouldn't likely result in pardoning, especially for the murder, but the sentence could be greatly lessened
@@justhair17 I mean... They pardoned (presumably) Hawkeye after he killed multiple government agents and destroyed government equipment worth millions of dollars because he wasn't in control of his actions at the time
It wasn't "confirmed." It was made up many years after the movie came out. The movies themselves never said he was brain-washed, and the devs only made that shit up after Loki became stupidly popular with fangirls.
I'm not sure if it's ever confirmed, but it is heavily implied that Loki was tortured and brainwashed after he fell from the Bifrost and that everything that happened on earth was done under brainwashing, including the invasion.
What would Thanks have wanted from the Battle of New York? He had the mind stone in the sceptre he gave to Loki, and Loki captured the tesseract in the first act. The battle of New York was entirely unnecessary for Thanos’ grand plan. (Unless you plan to argue that his attack on the curry was to steal the time stone, but that feel unlikely). I think that Loki was mind controlled when he captured the tesseract, but that the attack on New York was done by him as revenge against Thor.
@@duskfinger6799 Loki needed another portal to get back, since the portal that he came through was gone. So opening a really big portal so that Loki can deliver the two stones to Thanos, as well as leading an army to help bring "balance" to Earth is a pretty good strategy.
Thoughts on these arguments as the hypothetical supervillain lawyer? -The first frost giant Loki killed in Thor is self defense as he was attacking Loki with intent to harm and kill. Loki could not have been expected to know he'd be fine given he didn't know he was a frost giant. -Loki is a foreign royal, regent king for part of Thor. I wonder if that would give him sovereign immunity like the UK royal family or diplomatic immunity (not sure on this one) for crimes off his home world. Unlike Thor he wasn't explicitly stripped of his titles as prince when he was presumed dead. -Laufey declared war in essence after Thor's retaliation -Coulson lived so that would be attempted murder. -One could argue Loki's actions as regent king can be claimed out depending on the laws of Asgard (On that note have you been using estimated charges in the location that would most likely have jurisdiction where possible or just 1 nation? Though I get not being able to go into heavy detail for other realms, I assume some jurisdiction goes to Germany for Stuggart) Given it is a warrior realm with an absolute monarchy I can see him getting more leniency. (except in crimes of years in jail given life expectancy) -In general acts as a country actively at war don't exactly line up with the person on the throne as much as one taking them of their own will. My thoughts going to nukes and WW2, I am p sure the president didn't get murder charges for those? Specifically for when Loki is king, before and after, not his call on the nation, different story. -I assume we are ignoring assault charges across the board for convenience? I don't blame you I don't wanna count every punch each villian throws either. -No way in hell that push dagger woulda killed Thor and I think they both know that. Def a crime but prolly not attempted murder -I know this goes against em but property damage across the board I am an engineering student not a lawyer so if any of these are off, thats why
Well considering the fact that people from Asgard (including Loki) have been to earth before (See nordic mythology) some leader might have made some sort of peace agreement with Odin at some point in history.
With Loki, instead of murder for Phil Coulson, it would be attempted murder because Phil survived, as shown in Agents of Shield. Edit: okay I get it he’s a clone.
The Canonicity of Agents of Shield isn't exactly stable, mostly due to the fact that it doesn't react at all to snap or the sudden reappearance of people. basically, Phil Coulson could easily still be dead.
It would also be self-defence, because phil was pointing what was clearly a gun at him. Edit: Yeah he was escaping from prison and armed thats a good point.
Given that Loki is already about 1500 years old, I think he would likely survive the years of the sentence, and they'd probably have to come up with a new way to kill him for any death sentence, as he's likely immune or resistant to all the current methods given his ice giant/godly physiology. I would also like to point out that the events of the avengers happened while he was under duress, as The Other and Thanos were essentially bribing and forcing him to do it using threats of violence and pain. Yes, he was getting something out of it, but he was also being threatened at the same time. I think he should be able to make a deal there to reduce his sentencing a bit, as he was under duress and we saw that the Other was able to cause him pain even from far away. Even Thor knew Loki was being used by someone else. He was also tried on Asgard and sentenced for his crimes there, as seen with his imprisonment in Thor Dark World, so he's served a small part of his sentence.
@@j.pnewcomer1069 he's about the same age as Thor, and he's 1500 years old give or take, from what he said in endgame, and Laufi lived at least double that to have died in the first Thor movie
Loki killing that frost giant that grabbed his arm should also be self defense because that was supposed to hurt him but because loki is also a frost giant he was immune but he didn't know it at the time so frost giant intended to assault loki and loki stabbed him in self defense
I'm not sure but I think that Loky yeeting Thor off the helicarrier wouldn't count as first degree attempted murder because he would realistically know that Thor could survive that, rather he was trying to slow him down. Don't know what crime that would be tho.
A list of crime sentences for the heroes would be interesting. Tony Stark created Ultron and should carry its sentence. Captain America assaulted police officers. Spider Man and Daredevil are guilty of being vigilantes. She Hulk destroyed a car park. Wanda killed some people from Wakanda. Wolverine killed a lot of people.
Question: Would the charges and sentences for Loki in the Avengers be slightly different if it's taken into consideration that he was being influenced by the mind stone for the entire movie? Not trying to make excuses for Loki whatsoever, this is simply coming from a place of curiosity.
The answer is unsure, there’s a chance it could fall into a similar area as plea of insanity due to them not being mentally in control while doing the action, but as far ad i’m aware, there’s no direct legal distinction for things similar to mind control
There is no in-universe evidence for that. It was just thrown in to appease the fangirls. And, even if it was true; the fact that Loki shows no remorse for his actions (even acting proud of them) would suggest that he wasn't acting entirely against his will.
@@siobhannoble8545 There is absolutely evidence for that, but mind controlled is the wrong word. He was being influenced by the mind stone. And aside from the obvious evidence that Loki is more violent and sadistic in Avengers 1 than in any other of his appearances, there is the scene where the mind stone starts affecting the Avengers too, especially Banner, to act more aggressively and hostile
@@HappyMatt12345 Loki wasn't mind controlled he was influenced by the scepter, like corrupted by it. So he became more evil while weilding it, he had no empathy because it was playing off his negative emotions. There's a scene in Avengers were Thor punches him and he kind of wakes up for a second. Also after Hulk smashes him, he wakes up and acts jovial cracking a joke instead of all evil and smarmy.
Does doing crimes while under the influence of brainwashing count? If so, Winter Soldier. But Tony doesnt really give a shit about property damage, so...
What crimes does he commit? He kills terrorists, he kills evil alien combatants, he kills robots, he kills robot aliens, and he kills Nazis. Correct me if I’m wrong, but Tony Stark never kills civilians or anything. He only protects people from villains, who half of the time aren’t even sentient beings.
When Loki killed Laufey, that frost giant, he wasn’t just saving Odin but also killing his father, so it should be counted as Parricide. (because laufey is his dad)
Killing in entire population is not only considered genocide. It’s also considered populicide as Loki attempt to kill the entire population of frost giants.
Loki as king also relieved him of his duties, which is binding. Therefore at the moment he did it he no longer worked for the crown. how he said that he was no longer oath bound.
Nearing the end of the year, I would like to see a top 5 or 10 biggest fictional criminals covered so far. Who has the largest sentence, largest number of deaths and/or violent crimes, largest sentence from petty or non-felon crimes, largest sentence from non-violent crimes, and maybe a few more I haven’t thought of. I would also like to see hero’s and Anti-heroes on this. I am sure that the likes of Deadpool or Punisher would have a long list of crimes but you could probably dig up something on Superman or Captain America.
I'm going to argue against the attempted murder charge for dropping Thor out of the Helicarrier. Loki had been trying to kill Thor for a long time; he knew perfectly well that Thor would survive the fall.
Love the videos, and that you add the sentence and fine at the end of every cut. Keep it up! Also, would be cool if you could do Lord of the Rings next. I know this is unreasonable, but would be really cool, as well as good clickbait!
@1:54 you have completely forgotten about all of the things Obediah Stene destroys, including a reactor, and many cars, which only adds to first degree attempted murder charges.
Did anyone else hear the lego star wars lightsaber ground stab sound effect at 7:28 Edit: Natasha Rominoff also stated he killed 80 people in 2 days, so he would get a death sentence for mass murder there, or 80 life sentences for 80 counts of first/second degree murder
I feel like Loki should be pardoned for the first instance of second degree murder along with the pardoning for the assault charge with the ice blast, due to the fact that it was in self-defense Not like that'd do anything though, because he commits so many other crimes, but still
The first trip to Jotenheim in general isn't technically his fault in law as he was told to go by the crown prince. Even as his brother, Thor has higher power and only Odin would be above. And after that, Loki is king so technically Sovereign immunity til Odin wakes?
You could also throw on a wrongful termination for iron monger since that line would technically be wrongful termination "your services are no longer required"
At the end of the year or something, I’d love to see you make a tier list or maybe just top 10 of villains you’ve done and ranking their crimes amongst each other I just wanna see you comparing the likes of Titan and Vector to Loki or Red Skull

Loki in the first Thor movie would have been let off for the majority of charges due to his royal status as king in Thor and Odin’s absence.
monarchs can't be charged if we know their laws are so loki's crimes still count
Couldn’t the murder charge at the beginning for Loki be considered self defense? If someone was grabbing my arm and giving my what looked like massive frostbite/hypoxia/necrosis I most certainly would fight back
I think yes, he isn't aware that he isn't being harmed by that, for all he knows the Frost Giant is trying to kill him via freezing.
@@nikkiofthevalley I guess we can't tell really though because since Loki is Jotun he might not be affected by the cold/pain Lauyfey was trying to inflict.
Also aren’t the Frost Giants and Asgard at war. Therefore its not a crime to kill an enemy soldier.
They weren’t at war at the current time. Thor had invaded and Loki went with.

Red Skull, definitely war crimes is the biggie and technically, he did end up in a prison of sorts.
the ultimate sentence of community service.
Mousait is British.
@@HOLDENPOPE ...Which doesn't have a death penalty, so the comment still stands. There are other places than america, most of them don't have a death penalty. Why not appeal to the wider audience? We all know what death means, but whats the difference between a death sentence and a life sentence when your government doesn't execute people?
If its just based in american laws, any first degree murder charge could be 'Death' instead of 'life', or a 20 year sentence, depending on the judge. If its already not simplistic, why not make it accurate too?
@@rawr70101 you're arguing against a point that doesn't exist. I wasn't saying that Loki would get the Death Penalty for all his crimes, I was saying that Mousait is British when the commenter seems to think he's American.

Yea but can you find scriptures of Odin punishing smuggling of illegal immigrants? Loki got off easy fr
I think, but I'm not at all certain, that these crimes are all charged per UK law. The US and UK common law systems are similar enough it doesn't make a lot of difference, though.
@@princesscrystal6410 I wonder how attempt to destroy the reality itself would count (as in omniverse scale, entire timelines). Or literal genocide of an entire planet population. Shredder is beyond the scale of law, tbh.
@@princesscrystal6410 I want to see how all of the TMNT villains crimes measure out tbh. Honestly doing all of the different adaptations would be cool, but 2012 Shredder particularly because he is my favorite human interpretation of the character (emphasizing human interpretation because my favorite adaptations are the 2003 shredder and Rise shredder who are both inhuman)
For Loki, we’re looking at the 2011 Thor and 2012 Avengers. Also, Loki freezing Heimdall is technically in a grey area between self defense and first degree attempted murder.
I think you can argue knowing heimdall is a god too that he knows heimdall won't die from that. It could be false imprisonment.

Loki was also confirmed to be controlled by the Mind Stone/Thanos
It wasn't "confirmed." It was made up many years after the movie came out. The movies themselves never said he was brain-washed, and the devs only made that shit up after Loki became stupidly popular with fangirls.
I'm not sure if it's ever confirmed, but it is heavily implied that Loki was tortured and brainwashed after he fell from the Bifrost and that everything that happened on earth was done under brainwashing, including the invasion.
Actually, Marvel did confirm that he was under the control of Thanos/ The Mind Stone.
Hm good to know
That's the most retconny retcon I've ever heard
I always wondered what the purpose of multiple death penalties were until you said it makes it far less easy to appeal.
-Laufey declared war in essence after Thor's retaliation
-Coulson lived so that would be attempted murder.
(except in crimes of years in jail given life expectancy)
-In general acts as a country actively at war don't exactly line up with the person on the throne as much as one taking them of their own will.
Def a crime but prolly not attempted murder
-I know this goes against em but property damage across the board
I am an engineering student not a lawyer so if any of these are off, thats why
Wouldn't Loki's assault on SHIELD carry a harsher penalty considering it's a federal agency?
Probably. Same with killing Coulson and attempting to kill Fury, as they are very high ranking feds
With Loki waging war, wouldn’t he not be violating any peace treaties as Asgard never signed any of said treaties?
Well considering the fact that people from Asgard (including Loki) have been to earth before (See nordic mythology) some leader might have made some sort of peace agreement with Odin at some point in history.
Well… yes but… fucking hell you got a point there.
With Loki, instead of murder for Phil Coulson, it would be attempted murder because Phil survived, as shown in Agents of Shield.
Edit: okay I get it he’s a clone.
He was "dead" for about a week
The Canonicity of Agents of Shield isn't exactly stable, mostly due to the fact that it doesn't react at all to snap or the sudden reappearance of people. basically, Phil Coulson could easily still be dead.
It would also be self-defence, because phil was pointing what was clearly a gun at him.
Edit: Yeah he was escaping from prison and armed thats a good point.
Nah he actually died but was brought back to life
@@m.douglas8492 Is it self-defense to attack and kill the guards who are keeping you for previous crimes?
Definitley, I think it was said that Odin was about 30,000 years old, assuming Jotun have a similar life span.
@@j.pnewcomer1069 he's about the same age as Thor, and he's 1500 years old give or take, from what he said in endgame, and Laufi lived at least double that to have died in the first Thor movie
The fact that out of all the villains on the list the only one who could possibly serve out his sentences is loki due to his slow aging.
