Sir I have taken Italian nationality in January my children under eighteen in Pakistan can they apply Italian passport in Pakistan Consulate under the law 91/1992 art 2 ?
Se il marito cittadino diviene straniero, la moglie che mantenga comune con lui la residenza, perde la cittadinanza italiana, semprechè acquisti quella del marito; ma può ricuperarla secondo le disposizioni dell'articolo precedente. If the citizen husband becomes a foreigner, the wife who maintains common residence with him loses her Italian citizenship, provided she acquires that of her husband; but can recover it according to the provisions of the previous article. This solution could not be applied according to Art 11 of lay 555/1912
Art. 11 was declared unconstitutional since 1975 as it’s based on the discriminational concept that “women follow their husband’s citizenship because women were inferior then man. “ Those discrimination was also remarked since 2009 but the Cassazione High Court (and still now). So it’s not an argument anymore. Women can always pass Italian Citizenship, that’s why it can be one (of the various) solutions to the minor cases. Keep following us as we will post soon new videos about the minor cases. Sincerely The team -
Thank you for this. Do you have any idea how a court might look at a minor case where one of the minor’s Italian citizen parents (mother) naturalized while the minor was a minor but the other (father) died before naturalizing and before the mother naturalized?

Hello, I’m interested in getting Italian citizenship by descent but in the line of descent, there was a common law marriage with children born out of wedlock. Is there any legal precedent for this type of Italian citizenship by descent case or would this be new in Italian law? Has your firm handled this type of case? Thank you .
Hello, yes we already had cases with common law marriage, as it was typical from Ohio per example. we should better check your case. Please reach us to book a consultation call on your case and advise you how to proceed. Contact: mbersanilaw.com/contatti Sincerely, The Team
Can this apply in this situation: GF naturalized in US in Oct 1922. Married Italian GM in Italy in 1926. Father born in US in 1929. GM naturalized in 1938 (while F was a minor). Any chance GM technically passed Italian citizenship back to GF because of the marriage, thus eliminating the minor issue?

Hi! I was wondering if you could help me in my case. I was born in italy from filipino parents but I did not grow up there. Basically i arrived in italy when i was 18 and currently on my 2nd year of residence. My mother recently got her italian citizenship and i was thinking if this will affect my case if i were to apply too. Will this reduce the time of residence I need? Or does me being born in Italy also help with that? Thank you!
