    I work for dpd provided q uniform told when to start when when i finnish, providee a van, got too adhere too all there rules no time for dinner. Works out less than minum wage. If someone dont show up we get more work for set rate still. We take risk in losses aswel missed parcels come out of ur wage damage too the van. Seems like these big companys just robbing us. Please answer appreciated.

    ur right about everything but i work in construction and if i dont work RCT i dont get the job .iv no choice but to work this way . .

    Can a contractor take the agency to the employment tribunal for not paying the contractor fee during the notice period? if not what are the other options for the contractor?
    The contractor terminated the contract because the end client breached the IR35 regulation. The contractor agreed to work during the notice period but the end client gave a written statement that they don't want the contractor to work during the notice period.
    The contractor claims that he shall be paid for the notice period because he agreed to work during the notice period and it was the end client's decision not to take the contractor services during the notice period.
    The agency argues that the contractor didn't work during the notice period and therefore is not paying the contractor fee for the notice period. "The Employment Business is not obliged to offer Assignments to the Consultancy and the Consultancy is not obliged to accept any Assignment. Both parties acknowledge that there is no intention to create mutuality of obligation during any Assignment or between Assignments. The Employment Business shall not be obliged to pay the Consultancy for any periods during which the Consultancy Services are not provided, whether this is due to the Consultancy being unable to provide the Consultancy Services or where the Client does not require the Consultancy Services or otherwise in respect of holidays, illness or absence of the Consultancy Staff."

    Contract type: Outside IR35
    Agreed contract notice period: One month both sides. (written in the contract)
    Breach of IR35 by the end client: end client controlling and treating the contractor as an employee. (This is not the main issue here but is the cause of contract termination).

      I am in Ireland, not the UK. Different country. You might as well be comparing Canada with the USA.
