First off, nobody just gets to start an HOA. Assuming this all takes place in America, you need to register an HOA with the state. Which also means you need to legally register all current members, which requires a looooooot of legal paperwork. This usually means signatures; lots of signatures. You also need things to be registered because you can't legally levy fines or do, really, anything without that. Unregistered HOA and you just towed someone's car for a violation? Congratulations; you just committed grand theft auto and you can be arrested. Try to levy fines? Extortion. And even if you didn't get in trouble that way, the IRS could eventually be pointed your way since you'll have a loooooot of questions eventually coming your way. Like why all your neighbors are filing lost wages from HOA fees for tax purposes but you aren't. Interesting. Even if you're also declaring you're paying, well, people are going to say WHO they're paying. And if you're not telling the IRS about it, that's super illegal and they can, and will, destroy you for that.

First of all, they didnt just start an HOA. Thats why, in the end, they lost. They thought they'd just bully people into complying. It didn't work.

@@edswope28 Completely agree, but it helps to know how HOAs work, legally. Because, if the HOA isn't registered, they have literally no power. And no authority to ask for anything. You can, legally, tell them to get bent. But, even then, you might want to keep an eye out. Some people will still do things, like illegal towing, even when they know they can't do so. And while you can get your car back and all that, do you really want to have to go through that hardship? Especially since some tow companies aren't exactly legal themselves. You could wind up losing your car and while you can sue for damages, what're you going to do during the months, if not years, it takes to get a court date? I'd rather people be more aware of their rights and nip these problems before they get worse.

Not True! Wait til you hear my story in Grand Junction Colorado!!! The neighbors of 7 lots created a New HOA after 31 years of No HOA. I am now being sued because I will not join.

Plus they don’t want a person that has a disability living in their neighborhood.

@@user-sg4tn6lh4d Talk to a lawyer about ADA; The Americans with Disabilities Act. It's pretty strong when it comes to HOAs. If you're legally disabled and you can prove the HOA is discriminating against you for having a disability, that could work for you.

Yes…… they did start a New Hoa on August 3,2023 in Wedding Canyon Estates II. I bought my property my property in 2018. The Grand Junction City Commissioner ( aka. The New HOA Attorney) is suing me because I won’t join. The HOA Attorney ( and Commissioner of the city) illegally sold a section of my land to create a “Common Area” to creat a New HOA then filed an injunction against me to stay off my own land. The HOA Attorney & Commissioner is in cahoots with the judge on this case.
This is completely criminal want is happening to me! I tried to get Institute for Justice to help me but no luck! City of Grand Junction Colorado and County officials are all involved in this corruption. Attorneys are scare.

Blast the attorney and judge ECT info to be emailed and called online and start a campaign against them. I'll call and email every day. Heck, I own my own business so I can schedule it when I make my daily schedule.

HOA's are voluntary. Just dont volunteer. You do that by not buying a house in an HOA neighborhood. Ever. Even a good HOA, if there are any, can become a bad HOA with a change in management.

Lawyer up and go to court, on the HOA. To put a lean on a home it has to go though a legal process. If the HOA was not legal they can not put a lean on OP home.

I don't know if it's like this everywhere, but a family tried creating a home owner's association and charging people. The man of the family went to jail for theft over $500, grand auto theft for selling someone's car for being parked in the driveway, and something else about putting a lien on someone's house for refusing to pay after they (the crazy af family) had their chimney painted.

1st story: Why the hell do people think they can just start an HOA just because they feel like it?
2nd story: Why do landlords always think that they can get away with anything?
3rd story: Moral of the story, don't be an ahole
4th story: As soon as I heard the set up for this story, I KNEW how this story was going to go

Story 1: I have a weirdly strong feeling that the Wilsons wanted both power and money. They wanted to implement all these stupid rules and just use all the money from the "HOA" to fund their lifestyle. If someone moves into a house that is not part of an HOA. There is usually a reason they bought that house. And it may be because they did not want to deal with all the stupid powerhungry board members that HOAs usually have. The only difference I would have done is I would have actually have sued the Wilsons for the fraudulent HOA.
Story 2: OP did the right thing of going after the LL for double the deposit. And the reason the judge decided that OP's version of the lease is the legal version. It is because OP's version showed what the LL crossed out. The LL saw the clause after the lease was legalised. So the LL tried to cross it out to try and get rid of that clause. But OP's copy of the lease still had it. And since the copy OP had. Had all the signatures and the clause didn't look like it was written after the fact. The judge considered the lease the LL provided as not the proper/legal lease.
Story 3: Karen tried to unfairly win that item. But OP's mom showed that if you try to cheat the system. You may still lose.
Story 4: If I was the restaurant manager. I would have told those entitled, rude Karens that they came in less than an hour before their show, they ordered a bunch of NY strip steaks. That take the longest to cook by themselves. And they came in and ordered them when there were a ton of other people ordering them as well. That if they wanted to eat before their show. They should have came in at least 2.5 hours before the show. And they better leave atleast a 50% tip or I would make sure they never eat in this restaurant again and never take a cruise with this cruise line ever again.
Story 5: They were in a library. If you wanted your kid entertained. Either get them a book to read. Or connect to the wifi that libraries usually have and put something on a phone or something and have them watch it with earphones/headphones,etc.

@@barbiek3987 most cities have rules about fences in front yards , I always enjoyed keeping my front yard looking prestine and the kids had the run of the backyard behind a 6 foot fence and there's a big difference between front and back, I've seen cars swerve to miss something and wide up in someone's front yard.

    • @barbk1011
      @barbk1011 6 місяців тому +1

@@califdad4 Well then it all depends on where you live. Here, and in most cities in Canada, we can have a maximum 4' high FRONT fence. And if you have a back lane, there's no reason why a vehicle couldn't end up in your backyard like your front yard. I've never seen a vehicle crash through a front yard fence, but I do know of such fence crashes off the lane in the back. So again, it all depends on WHERE you live.
I don't know what you mean by "pristine", but there was nothing wrong with OUR yard even when our kids were playing in it.
