my coworker is still in the middle of her divorce. its not all that messy either. she's now 70k in credit card debt just to pay the lawyers. 2 weeks ago she told me everything is done, she and her ex just need to sign, but the lawyers keep bickering on their dime. its really sad seeing her go through all of this financial crap.

@@mikemac4458 The original case was filed as an NDA violation. When they realized that a potential loss had more consequences for an NDA suit than for a Defamation suit, they switched up. Pure risk mitigation. So yes, they can no longer file for "violation of an NDA" regarding only this matter, as this SPECIFIC matter was dismissed, but he can still file for "defamation."
TLDR: Dismissed with prejudice effectively means "no appeal on this particular filing"

If that were the situation, this defamation case would have been tossed, and It likely will. I dunno if it would work, but given that Jared was painting him in a negative light during divorce proceedings, they might constitute bringing a tortious interference suit, as weddings are legally contractual and Jared with interfering with the termination of it, but I don't really know.

I used to watch Crowder all the time. He used to seem like he was very passionate about what he was fighting for. Now it just feels like he's more arrogant than anything else. He's not near as fun to watch.

I'm not a lawyer so I could be wrong, but I don't think the message has to be public for it to be defamation. If you deliberatly send false information about someone through a private message to hurt their reputation with the recipient that probably still counts as defamation.
Except the statement they are claiming is defamation was him just stating a feeling that Jared had not a claim of fact

I'm not saying that this particular case is defamation though. In fact I don't think it is for pretty much the same reason you stated.
In their own legal argument, they claim specifically that the publication of the private text messages caused defamation. But Crowder was the one that publicized them. So by his own legal argument, he caused harm to himself by making it public. Crowder defamed himself basically.

I haven't kept up with any of this, so one part has me confused. Why tf is Jared involved in all of this anyways? Is he just jumping at an opportunity to dog pile or something? I don't listen to Crowder or anythinf, I just find it weird that Jared is even involved in the divorce.
He's not involved in the divorce. He talks with Crowder's estranged wife. They seem to be friends, which is not terribly surprising considering that LWC is a relatively small company. Jared responded to something she said by saying he's not comfortable with SC being around "those kids" (not even clear he means SC's kids) and that he'd be willing to attest to something (possibly in court) that she mentioned. So he told her he'd be willing to back up something she said, probably because he witnessed something relevant. That's it.

"With prejudice" does not mean what you said, I.E. that a case is baseless, it means a case dismissed with prejudice cannot be filed again. If it's dismissed without prejudice then the plaintiff is able to file again with amendments to get round whatever caused the dismissal. There could be truth in the lawsuit filed but if the judge finds cause to dismiss the lawsuit and make sure it does not come back they use the with prejudice clause. Normally a dismissal is with prejudice so if not specified it's assumed, it's only without prejudice that needs to be specified.
DISCLAIMER: This is from what I understand of the American legal system. I am not an expert and will accept any valid corrections.

Not a lawyer, but my understanding was that defamation didn't require publishing. I was told it could simply be false statements from one person to at least one other person.
Defamation requires damage to be inflicted to someone's reputation. A private text message would not inflict damage on someone's reputation unless it was widely dispersed (but it wasn't; LWC publicized it first), and if you (LWC) are dumb enough to publish the image, you don't get to cry defamation when the person who sent the text message retweets it. If that text message did damage to LWC's reputation, that damage was self-inflicted.
This is true it's also very hard to damage a public figure & again, Jared saying he "doesn't want him near those kids" is by definition an opinion. Could you imagine if drag queens could so anyone who expressed privately that they don't want them near kids? All of conservative media would be paying them until the end of time
In this legal context, "publishing" doesn't mean something like "printing in a newspaper." It just means "disseminating to the public" ("the public" being at least one person who isn't the subject of the statement). So, telling a third party, even orally, _is_ "publishing."
Technically, a text from Jared to Hillary would be enough, but not _this_ text. It's absolutely critical to a defamation case that the statement made is _false,_ and there is no reasonable argument that Jared was lying when he said that doesn't want Steven near the kids -- after all, as Sean said, it's an opinion.

I have had a massive issue with Crowder since he invited Laci Green on for her world apology tour where she neither toured nor apologised. He had an opportunity to actually hold her feet a little too warm next to the fire, instead he just let her smile and look dumb. Since then i have known how self motivated Crowder is.

I'm not a lawyer, but assuming Jared really is trying to sabotage the situation with the divorce for whatever reason, wouldn't the texts make a lot more sense as a "tortious interference" suit since the divorce filings are a legal proceeding. This text doesn't prove defamation, but it does prove that Jared was painting him in a negative light to his spouse DURING divorce proceedings. Not sure if this is actionable or not, or if it can even be applied, so feel free to fill me in.

I have been watching crowder for 10 years off and on... hes a canadian child actor whos mother is a french candian costume designer for the stars.. you can imagine what that early life does to a child. Personally i get weird vibes coming off him. After that dave landau talked about how crowder isi just think hes another egotistical little boy.

This is drama wholly irrelevant to his show, why should people stop watching? Someone’s audience isn’t just a monolith of people taking everything they say as gospel, they can disagree with certain things and still find value in a show. I personally have a wide variety of commentators that I listen to and no drama, barring illegal or unobjectionably immoral behavior, has or will make me stop watching. So long as the content remains factual, or at the very least gives an insight to what a certain sect of people believe, it has value.

I first noticed when she gave one of the most bizarre and incoherent explanations as to why National Socialist "nationalism" was bad. "Because it wasn't national" it was bad because Hitler had "international" ambitions. Murdering your own population, book burnings, political arrests, and asset seizure are all fine apparently if they occur within a nation's boundaries. That had to be one of the worst political answers I have ever heard.
Gerald has always rubbed me the wrong way. I can't put my finger on it exactly, but I just get the feeling he would stop at nothing to protect Crowder. Loyal to a fault perhaps.

Crowder is a weasel. I used to watch him and gave him the benefit of the doubt at times, but it’s clear he’s just a punk. No respect for him anymore.
