Hi Atty, the 2nd paragraph of art 26 FC. I thought that the capacity to remarry was if the marriage to an alien spouse happened outside the Philippines. Like a continuation of the first paragraph.
So my query, as long as the marriage between a Filipino and a foreigner even if it was solemnized in the Philippines and obtained a divorce abroad. The Filipino can remarry, correct?

Good day Atty. I have a question po. Art 14, does the parental consent here refers to the consent in the essential requisites? The absence of parental consent makes the marriage voidable? Or would it fall to absence of legal capacity because of the absence of arental consent to the 18-21 yrs. Old hence, marriage is void. Or would it fall po sa formal requisites, irregularity if the marrige license was issued by the local civ regstrar without the parental consent, hence, marraige is valid. Nalito po ako dito. atty, if ang contracting party bah, failed to secure marriage license and nakipagsabot sa isa ka solemnizing officer although he has the authority but has the knowledge na walang marriage contrac but still continued to perform the ceremony, void bah or voidable ang marriage?
