I found around $1400 once in the middle of the street outside my apartment. The next day, I heard my neighbors talking about how a guy lost his rent money and was crying on his porch because he was probably going to be evicted. I asked him how much he lost, and he had it down to the dollar, so I gave it back to him. Biggest hug I have ever received.

I had $2,000 put in my account that I knew wasn't mine. I called the bank right away. It had to sit there for a week or two while they investigated it. Had I spent it, I'd have owed any of the funds used.
i would want to get into trouble for 2000 but over 1mill thats to tempting life changing. i would take it if its a bank error

Bank Fees can be outrageous but dont bitch about them because you agree to them upfront and it's not hard to avoid them. An iPhone is outrageously priced but have no problem selling and people are still getting fat on fast food which is also overpriced.

This is a case of theft and she can go to jail for up to 10 years if she keeps it. It is a federal offense, so it will be federal prison she is headed to. I guarantee you that the bank has already placed a negative charge on her account for the missing funds.
It might be tempting, but she should have left the country gone somewhere without extradition and moved the funds to one of those Cayman Islands banks the criminals use.there are some beautiful places you can live that the US cannot get to you.

I had an unce who went to get 80k to buy a house from his account. They counted out 80k... twice. But only wrote down that they gave him 80k. When he left he realized what happened. Later that day they contacted him asking about 80k missing. He told them he had no idea what they were talking about. He finds out they took 80k from his account to cover what they said they gave him. They later had to put that 80k back after his attorney contacted them about the theft of his clients funds. He never gave them the 80k and later closed his accounts at that bank. This happened in Florida in the 1980s. You try and get 80k in cash from a bank now and they are asking you a million questions. Hell they might not even have that cash on hand. Normally he would have given it back but they had jerked him around in the past and he was basically like .. fck them. Such is life.

After digging around. Not only was she fired, but she was later found guilty of bank fraud and illegal monterary trasnmission of funds. She also has closed all her social media accounts due to harrasment. She still currently had not been able to find a job lol. Karma at least.
I didn't think to look into her, thinking it was a newer case. But I found a story about a Georgia couple who was convicted for doing the same thing with a $120k error. Yes, it's theft.

I would have high-tailed it to a country that doesn't have a law that would require me to be returned to the US! I'D BE SAYING CUBA, HERE I COME! And the cost of living there is cheap. That 1M would last past her lifetime if she didn't party it away.
There are 15 countries in the world that do not have extradition treaties with the US, and you don't want to live in any of them.
BTW, Cuba isn't on that list...
Also, there would be no way for you to transfer that money out of the country without alerting the authorities.

It's theft. Plain and simple. She quickly withdrew that money because she knew it wasn't hers. Sorry, but I see people who do this as thieves. I wouldn't want to be a friend with that person.
It's not a tricky question. It was obviously an error. If she went to a Fast Food Restaurant and got the wrong order she would make noise.
You are correct. You don't legally have to return a wallet full of money. You are also not legally entitled to keep it. Catch 22. This is where morals kick in.
Either way, I would demand a letter from the bank stating the transfer was a mistake, and was returned, because we all know the IRS will only see the transfer in, and there will be a huge battle over taxes later.

Everything I’ve read online about this says the money is not legally hers and it is a crime for her to keep it.
I worked with a guy where the IRS added some extra digits to his return, this was back in the 90s. He told me when he saw it that he knew it was an error and expected them to find out about it so he did nothing. Months went by, nothing. Eventually he built a house paid for by the IRS, and ultimately the tax payers
Think about this....if we the little people.....make a mistake and send too much money thru Zelle or some other company .....we are out that money....we are asked to double check what we are sending and to who....WE would be out those funds.....
It's a tragic amount to lose....but I bet they are more careful going forward!!

one time I got a credit for 2000 something dollars and I did the right thing and called the bank and it took them a few to figure out what happened. I guess someone else's payment went to me instead of the bank. I got NO REWARD NO THANK YOU NOTHING...

*Also want to edit it to say also that she is spending the money wisely (aka buying a house and car) so she hasn't blown the money, she helped her future. I don't even consider her to be a bad person. I see someone who got a blessing from a companies mistake and she used it wisely.

I know someone that did serious time for an overpayment. Before he spent it he tried to return for months. The bank kept denying the mistake. Somtime after he started spending it he was arrested and charged. I think he was living in Michigan at the time , and this was probably just over thirty years ago.

Honestly, I'd pay all my debts, buy a new car and a house, hire an attorney and then apologize for the mistake and offer to pay back over time what I had spent, interest free. 😉
If I received a large amount of money accidentally by bank transfer I would put it into my highest interest earning account until the bank asked for it back so at least I earned a little bit of money before returning it.

I mean there is a law that says you have to give back the wallet. Well more so a law that says using what is inside is stealing. Assuming you get caught. Which is why I hope said criminals would ONLY use the cash and not card as cash isn't trackable. Small amounts at least.

I would try to hold onto that money for as long as I could. My reasoning is that if my bank account got drained due to an error on the bank’s behalf, I would not be getting my money returned to me instantaneously. Because of the bank’s greed, they would do everything they can to justify keeping my money away from me. In that time, I become delinquent on paying bills, etc while they are trying to find a way to keep that money and not give it back to me. So, if they screw up and I get a substantial bonus on their behalf, I’m gonna keep it for as long as I can. Although I am surprised the let that woman transfer all of that money out of the bank and no one thought that maybe something isn’t right here.

Banks have way more power than you think. They have all these legal means to get the money back since she signed those disclosures when she opened the account.

I'd make a new law keeping money from an accidental transfer can get you prison time and you would have to pay a ton of money. This would help those morally indecsive people choose the right path lol.

Schwab made the mistake, not this lady, who received the money but did not take the money. She should sue Schwab, and she should sue the sheriff's department for wrongful termination. In florida you do actually have to return it. I lost my wallet with $400 in it and the woman who found it in the Walmart parking lot got arrested for not returning it. That was down here in florida. I have the police report and everything lol
The only back error that was ever in my favor allowed me to collect $200 but I still lost. Really if this happened to me the way my parents raised me i would give it back but I damn well would demand a 10% fee for doing so. It would cost them far more in lawyer fees and bad publicity.
