City of San Diego passes homeless encampment ban

  • The San Diego City Council moved forward Tuesday with its final vote to approve the City’s “Unsafe Camping Ordinance,” which bans tent encampments in certain public areas of the city.
    Less than two hours into the meeting, public comment wrapped up and the new rules were passed with several city council members registering a “no” vote.
    “It is legally, practically, and morally not the right thing for us to do at this time,” said Council President pro Tem Monica Montgomery.
    She joined Councilmembers Moreno and Lee, along with Council President Elo-Rivera, in voting no. Councilmember Whitburn and four others on the dais, however, continued their support for the new rules.

    The last time I went to SD will be my last until this problem is solved. So sad because it is such a beautiful city, but this is happening to many beautiful cities in the US. Letting people live on the streets is not the answer.

      You’re correct, they should be given emergency housing and a social services system to help them maneuver the horrendously expensive system in order to move forward. Instead we just shuffle them from one city to the other and listen to shallow people put them down as if they are less than human. Late stage capitalism is great, ain’t it?

    What they really fail to acknowledge is that none of these people want housing... They just want to do drugs in a tent next to KFC. It's no secret that these people don't want help. They will straight up tell you NO if you were to offer them a job 😂 its quite pathetic how misunderstood this problem is...

      You can't begin to help them correct their primary needs like housing and getting a job if their problems aren't first corrected. For some that's mental health and for others it's alcohol or drug abuse. I tried to help a friend once and figured out very quickly that it's not worth it until they put the effort to fix themselves first.

      Doing drugs and eating fried chicken is less damaging to your body and soul than working more than full time and sleeping 4 or 5 hours per day for years on end while accumulating no savings, no wife, no kids,nothing! Fuck the urban job market until the cost of living drops low enough for average people to both do their work and get enough sleep and social/romantic interaction to biologically function and reproduce.
      Living as a single, poverty stricken,freindless and childless workerbee is a misuse of ones personal energy and resources at an animal level... it is the modern day equivalent of becoming a palace eunuch for a bowl of rice!

    I worked DIRECTLY IN THE MIDDLE of these homeless before, during, and after the pandemic in DTSD; 90% of these people are drug addicts who gave up on everything in their life to continue to use drugs. This is a drug problem, not a homeless problem. I literally had to work around these people, walking in literal piles of feces EVERYWHERE, piss soaked everything, needles EVERYWHERE, people literally shitting right in front of me in the streets and parking lots with zero discretion. Meanwhile, kids are walking around with their parents who just want to get to the bus or train stop, or just to get back into their apartment. I literally compared it to the Walking Dead, as most these people completely ignore their reality because they are so high they can't even compute it. Sad, but not acceptable at all. This is a DRUG PROBLEM, NOT A HOMELESS PROBLEM. Mental illness is second.

      Did they all come from that area or are they coming from other parts of the United?
      Where did they get the money to buy drugs?
      Why don't they go after the drug dealers?Why are they not building more mental health hospitals ?

      I will side you on this one. You are indeed correct! I have volunteered in a few places like The Rescue Mission LA.
      While there, i noticed that those waiting at intake were given a list of policies and rules that the facility had in order for them to have a bed there. The reason why many would rather camp outside of that building was because they could get free food and sometimes clothing, without having to leave their addiction behind.
      I honestly believe that mental insitutions need to be brought back. I know it may sound cruel but gathering up all the homeless and putting them in one would be a big step in beginning rehabilition.

Shanty-towns should have never been allowed by these corrupt cities in the first place and now that the problem is completely out of hand it will be fascinating to see how they're going to clean it up.       Lmao to be fair I think there should be a law against charging 2k for a one bedroom apartment as well. The older generation was much worse they just didn’t have boot lickers letting landlords run wild with prices. If you have kids it’s highly likely they will sleep in a tent city in your life time.

      I understand. The hypocrisy is so disheartening.
      A friend of ours used to serve in a church in a bad neighborhood during the BLM riots in STL. At a protest, where protesters walked down the streets of their bad neighborhood(North STL), she asked them if they would come live with them in the neighborhood, that their community is good but everyone needs help. All she got in response were stares and shocked faces. Why would anyone want to live among impoverished people, but are willing to protest for cameras? No one really cares, but the ones that do are the ones that are present.

    One of my spouses relatives is homeless and went into a shelter. He has no substance abuse issues and doesn't steal and was quickly moved from crappy shelter to a family type shelter and then to a one bedroom apartment in a monitored building. He said there is plenty of space but most people are on drugs and not willing to get off so opt to stay on the streets. Society should help people on drugs get help to get off, but we shouldn't let vibrant downtowns being turned into drug infested tent cities full of crime by people unwilling to take steps to improve their situation. CA does have the issue that they have tolerated homelesses to the point where they became a magnet for it and now doesn't have the shelter capacity to deal with it or more importantly help the ones that are actually not drug addicts or dealing with severe mental health issues.

      Umm going to break your idealist bubble here about society should help people on drugs. HEre's a reality: there are MULTIPLE places private and state or local govt funded centers for substance rehabilliation!!! If the druggie DOESN'T want to change, it doesn't matter how nice or fully staffed those centers are!!!! Many of those druggies don't want to change!!! (yes, I work in the MH field for nearly 2 decades)

I was saying the programs are there in most places and that we can't allow those opting not to go into them to destroy society with their behavior. To protect society and really help those we need to keep those programs in place going.     You have no idea how many “neighbors” think I’m over exaggerating about the tents popping up all over San Diego, let alone across the block. Some people are so dense and so politically charged, that they refuse the reality they’ve created. I literally, walked up and filmed a small tent “village” and brought said evidence to one of my neighbors. Guess what? They claimed that I plucked it off the internet and called it fake. Second time, I do a complete voice over, filmed the actual street corners, and framed myself in the shots. Guess what happened?
    They refused to watch it. They stormed back to their house and just laughed about how I’m so easily mislead by fake news...
    Strange how karma works though. Their Telsa got broken into while they parked outside of their garage, which is against our HOA policies... welp!

      I have housed homeless freinds 2 or three times when i was in my 20s, and even got kicked out of one of my apartments for doing so! I dont believe that being homeless should be illegal! 50 % of americans are a paycheck or two away from becoming homeless themselves... you may be the one who is next if your health goes bad or your boss is downsizing...

      … There use to be a homeless shelter in the town I live at. Homeless folks had to be inside by 10pm, but they would come in drunk or high, causing problems. The shelter changed & people had to sign-in BEFORE 6pm, if they wanted a meal & bed to sleep - the doors shut & locked up at 6pm. If someone was drunk or high, they were refused shelter. If fights broke out, got kicked out. That was the best rule - it worked w/positive results.

      when your income is less than your rent, you have no HOUSE. It directs the attention to the housing situation, rather than HOME which suggests "belonging" and non belonging, and has historical meanings that make society make judgements about a person, rather than the fact that they need a house.

      It's mental health and drugs. Some of these people are worst not on street drugs. They'll get in frequent arguments, can't live anywhere, etc. If it's funded by public aide the mental health system abuses them all over again. The mental health field have a hard time seeing them as people at that point. I can see why they refuse help. There really isn't any. I give them credit for still wanting to stay alive. It would be hard for me.

Most champagne socialists are like what you describe... but there are a decent amount of people who have compassion for the homeless because they know what it is like to be down and out.     Those dissenting council members probably don't live near an encampment. Businesses losing customers, unsafe passage on sidewalks for pedestrians, public health concerns...sad, but the general public deserves some consideration too.

      People need to have some place to sleep. But the fact that they think they can't sleep anyplace they want at zero cost, even prime riverfront or beachfront property that I can't afford to live on, sort of pisses me off. Camping on the side of the freeway doesn't really bother me, I just don't understand how anybody can sleep with the noise, and they probably should have portapotties and dumpsters.

      It's because it doesn't correct any issues. It just turns them into criminals. What are they going to do? Lock them up? Ticket them and they will never pay those fines?     Being a police officer when I speak with homeless people I always tell them find somewhere that’s out of site and keep it clean. I tell them we only get called on you because you’re in the middle of a trail that’s popular and your trash is everywhere.
    Even the hidden places they trash it up so messy and if they were clean they wouldn’t get bothered as much. Nobody wants to see all that trash especially when there’s needles laying around. The sad part is a lot of homeless people don’t want help and they like living the way they do.

    As a former San Diegan I knew the city would eventually act. I was actually shocked it took so long. They look to their bigger siblings to the North and saw the destruction and mayhem. They are still the best run city in CA

El Cajon is a good model on this issue, San Diego could learn a lot from their mayor who understands that sometimes tough love is the only love that works.       @@SS-yj2le It's expensive because of the demand. It's only 75 degrees here today in Socal in July, with clear blue skies and sunny. Sure, I could move to Austin, TX where housing is much cheaper, but it's been +100 degrees the past several weeks with high humidity and finally cooled down to high 90's this week. Austin night time temperature is much hotter than San Diego's day time temperature. You can literally run 10 miles out here in July afternoon, can't say the same for Austin.

    These pro tent people need to take people into their homes or apt. They can get rid of a dining room table and put a bed for 2 down, use the sofa for one, and if they have an extra room, put three in there. The homeless qualify for cash and food stamps so all their food would be free including the owner or legal tenant.

I've been homeless more times than I can count..i was never out in the open like they are..i was in the woods somewhere..i don't drink smoke or do drugs.. it's still on the back burner for me to be that way again..     San Diego just approved 31 million dollars to convert an abandoned office into 40 apartments. That's 750k an apartment for homeless people.     What is wrong with these people? It’s one thing to have a heart and another to have it replace your brain. Donate your own homes to the “unhoused” if you feel so passionately. Meanwhile it looks like most are afraid to speak up - silent majority, as the one speaker mentioned - why be silent?       As much as I love conservatives, many are too comfortable they forgot that they need to go out there and fight. I understand worrying about your family and safety... and I know you're too tired from work to participate, but for goodness sakes... get off your butt and do something. Pray, contact leadership and tell them how you feel, educate family friends and neighbors, protect your kids from indoctrination... boycott bad businesses... do SOMETHING.

    I like how the mayor finally understood that allowing businesses to fail by allowing homeless people to sleep anywhere they like was going to be a lose lose situation for everyone. It's not about showing empathy, it's about fairness to everyone, including business owners. And the people shaming the mayor just don't understand that equality is for everyone, not just for a single group. By only favoring one group of people and sacrificing another, that's bias either way. You have to protect everyone, not just the ones you deem personally more unfortunate than others. Everyone has a right to live well, including business owners etc. Destroying the entire village to save one group is never going to work. Save the city first, and then you can help the rest after.

      @channelofstuff6662 your immediate claim that they have no place to go sets up this wall that i believe won't allow you to dive deeper into more critical thinking and i think you are much more capable than allowing this "absolutism" to cloud your judgement. They all had or have families and friends at some point where they were allowed to stay and i believe those that are homeless now broke the responsibilities or promises that allowed them to stay housed. Whether it be drugs, mental issues, abuse, etc. At least for drug offenses in low security jails there are typically programs to help them get clean with numerous testimonials supporting that. If your main argument is cost, I would argue our taxes would do better having them in jail than on the streets where we have (arguably) better oversight and negotiations on the cost perspective than compared to NPOs that claim to help the homeless - in my opinion they have nice mission statements but zero proof to show their tactics can even make a dent into the homeless problem.
      If we look at these NPO programs now trying to house or help specifically those who are addicted to drugs outside of the jail system, you'll see that the millions and millions you and I contributed to in taxes resulted in even more homeless and more to the pockets of those that benefit to keep the population of the homeless high. And their budget increases every year without results. I believe that in the numbers, those who are homeless or live on the streets do so to be closer to drugs. The money we put into free needles and endless supply of narcan haven't done anything to help them get better and it shows in any statistic we try to pull up. We have to do the hard thing here of jailing because it is the right thing to do to save them from themselves. That's my 2 cents at least.

    There is no excuse for this at all, California is one of the richest states. The homeless are just going to move elsewhere in the area. You’re not putting them into housing, let alone giving mental health care. Instead, your stuffing money down your pockets, building luxury homes, and other things we do not need. If you had the mindset of Finland where they have a Housing First plan going on, then homelessness wouldn't be such a problem here. There needs to be some kind of class-action lawsuit for human rights violations, protests or something. At this point talking to city councils is a waste of time.

    There is no other feasible outcome. Compassion has not worked as it relates to this issue. How many times does one have to highlight the fact that (too many) contemporary homeless people aren't like the Okies in The Grapes of Wrath or like my grandparents when they were young. They are largely entitled, often violent, and most importantly, drug addled. I've ran from them, been nearly attacked by many, and I've given away money to them often only to be mocked and harrassed further. It's disheartening, humiliating, and unfathomable how far this state's policies have tanked a once great state...to the point of (almost) no return. To the idiots who just can't see that...what's your wish...more of this?

    We have this in Austin, TX. It works great. Most encampments are gone.
    Remove the few remaining idiots on your city council. Or even better, have the homeless go camping on their property.

      i also live in austin on the south side of town, the ban DOES NOT work great, the homeless people have moved out of downtown and are set up all over south austin along William canon blvd and under i35 , the rich people kicked them out into the neighborhoods where regular people live

    "in certain public spaces" where exactly does that mean? IMO, tents should be 100% banned from residential neighborhoods first and foremost as a matter of safety to the people living there. Banning at parks and beaches, so they're worried about the tourist populations seeing it?

    Wow - they temporarily tried thier tent city crapola at the City's 19th and B compound back in 2018 when we lived and invested 200K in our Golden Hill bungalow right off Broadway. All of a sudden, we had homeless druggers wandering our streets and relieving themselves everywhere! At that time, the City put out an RFP on the street to locate a permanent tent city at the 19th and B site and with one sentence in said RFP about respondents submitting a feasibility study (FS) - with no typical and necessary FS parameters specified. As a consultant and counsel, I nailed them to the wall, pointed out the RFP was flawed, told them that putting any such homeless mitigation center in any one San Diego hood would unfairly and disproportionately burden the hood and affect property values, threatened to sue the City if they didn't pull said RFP, and told them the only place the should locate such a camp is down on City property in the industrial area. And that's exactly what they did - back then! Fast-forward to now and the very corrupt City unilaterally bans homeless street camping but crammed this tent city right back into San Diego's most desirable urban hood! So glad we made big bank on our restored bungalow and property and got the holy hell outta there back in 2020! I feel bad that the rights of Golden Hill property owners have again been trampled on by Gloryhole and his pack of municipal criminals for propping up a never-ending supply of drug-ridden dregs who won't work, won't go into drug treatment as they should be forced to do, who want to live free doing their drugs and commiting ongoing crime to support their $100/day habits, and who will then forever burden the taxpayers. And to that end, bear one thing in mind - myself as having 40 years dealing with the homeless issue from an environmental consulting perspective, those who live on the streets are there because they want to be there, live free, and not dicated to via rules and regs. Those segments of the homeless population who want off the street do get off the street be using the available social service networks that are open to them. Conversely and in the meantime, both the City and their parasitic, in-the-pocket, 501(c)(3) nonprofit grant grifters pull in millions upon millions per year in federal and state grants to deal with (actually grow) their very own pet homeless industrial complex that doesn't solve but is geared to perpetuate and expand the homeless problem at the expense of the hardworking public taxpayers!

    There is NO court ruling that allows permanent encampments, period! The rulings in question only state that you may “sleep” in a public space if there is no shelter space available. It doesn’t allow for accumulation of junk, trash, stolen bicycles, pallets, etc. So roll out your sleeping bag, take a snooze, and move along when you wake up.

    Great step in the right direction. Tax payers should feel safe at public spaces like parks. No one should feel threatened especially children. Whether is a Junkie passed out in a corner or attempting to bath in broad daylight in a public restroom, tax payers, should feel safe.
    Also, housing should be for those who deserve it. The amount of junkies I have seen loitering at Liquor stores/Gas stations while having access to smart phones with data plans is ridiculous. Stop validating negligence and acknowledge the homeless who want change.

    It’s important to identify the homeless people and know their situations - addiction to alcohol or other deprugs, they can go to rehab that’s free. A friend of ours decided to leave the city and join a farm that helps addicts. By being i the farm, they get to work the land and take care of pigs and other animals. The produce from the farm help sustain the program. Our friend was able to kick the habit, return to school and get a job. So simultaneously, the government must identify existing programs in and outside the city and send the homeless there. We need to put a stop to living in tents on the sidewalk. That’s cruel. No access to toilets, Southey do their business on sidewalks and people step on them. Banning is the first step but not the last. Homeless people, some with mental concerns, some with addiction concerns, some are recently jobless must each enter distinct pathways to heal and soon can live on their own and integrated into a society of families, relatives, friends, colleagues, etc.

    Last week 11 tents suddenly went up near our Catholic Charities building, Lafayette, La. They were gone in a few days, the police removed them. Just passed by, 4-5 back up. This is a southern red college town.

    I was homeless in SF for two years after turning 18 and I think this was the right choice. Many of the chronically homeless people don't want to get off the street, esp in CA where they get everything handed to them on a silver platter. I know it sounds fucked but I swear to god its true. If you have been living on the street more than a few weeks it becomes very easy, we used to literally laugh about how people thought we were in dire straights but we were fine. A lot of these people have been doing this for decades and have no interest of stopping. Trying to house them all won't work either. The ones with drug and mental health issues are very difficult and will take the apartment but never be able to hold jobs, keep the place clean, etc. It's sad but true. The only way to help them is to make this lifestyle very uncomfortable and difficult to the point that they WANT to find a way out. If they don't WANT to, they WONT.

    as a san diego native and citizen, I AM GLAD THEY ARE DOING SOMETHING. for all the people complaining that they have no where to go, that its cruel what they are doing, I INVITE YOU to take some homeless to your place of residence and see how you like it. it’s not only that encampments are dangerous and filthy, it’s the mental health that is out of control. violent outbursts on the mts bus and trolleys, it’s ridiculous.     What is actually cruel is to allow mentally ill and addicted individuals to just rot away in their own filth on the streets. They are incapable of getting themselves out of that situation without forceful intervention. They need to be treated, provided job assistance, and only released when they are in a position to support themselves financially. Any costs involved would be more than offset by what we currently spend ignoring the problem.

      I don't think I'm insulting your intelligence by telling you that you dont know what needs to be done, because there is a clear lapse in judgement on your part for what you advocate.
      Yes it is cruel to let the "mentally ill" and "addicted" to their own devices, because these are disability groups that are protected by the Americans with Disabilities Act.
      However, when you ask for stripping the disabled of their self determination, you are asking for a very dark future that most think we left behind in 40's Germany.
      You have to understand that reality isn't about extremes of letting them be independent when that leads to poor oitcomes nor stripping peoples autonomy and forcing what we think is good for them.
      There are many contradictions that don't exist without each other. You have to understand there is time and place for things. That's what the scientific epistemology of dialectical materialism is about.
      What you should advocate for is assisted decision making. Let's them make decisions for themselves with guidance of course.
