RAID: Shadow Legends (From Plarium Games) is a lot of things, but creative... might not be one of them. It seems that through a design competition they have created a highly sought after derivative champion without credit, prize or recognition for the original artist.
What might have been a completely legal maneuver is complicated by a claim that this miraculously similar champion was created in a vacuum during 2019, and that they do not want any "reputational damage"... while ignoring and cutting off communication with the artist.

So as a cyber forensics major this case is pretty cut and dry for legally investigating this as a theft of intellectual property. This is because you can track the metadata of the artwork done by clarian games and see exactly when it was created, edited, and by whom. It is not something easily faked and has legal ramifications if it is.

to be fair, that's a normal thing to do before calls between dev teams. The management/marketing dept who will be on the call, most of the time will need to ask other depts for the answers to questions. So questions are sent days in advance so there'll be time to gather up answers, or ask the experts to join the call if needed. Getting onto calls only to get all of your questions answered with "I'll check with the appropriate dept and get back to you." is pretty frustrating, especially if it's a call between time zones.
After the 2nd e-mail is where it starts to look bad. The pressure should've lessened after the artist stated he just wanted an open ended discussion, since it shows the call would be informal. And most questions could be answered just by bringing one other person (either the Plarium artist, or team lead, or art director) into the call. Depending on the company culture (which I have no knowledge of), no further communication could be because the contact person didnt want to be the fall guy for a crime he didnt do, or because the contact person brought this up the chain and got instructions to keep silent.

This is similar to what happened to me when i won third place on a character creation contest on a game named Lost Saga (online brawler by Kreon, korean dev, Indonesia server). It happened when I'm just starting college 7-8 year-ish ago. The contest more or less have the same terms that i knew going in and the prize for first place is that their character can be made and put into the game and after they got released then the winner cannget it for free (with extra premium cash currency that's not really that much, equals to buying 3 premium heroes if i recall). So the character/ hero got made and it was a hero named "Pentjak Silat", As the first place winner while the others, mine included aren't. Things went as usual for a while and then out of the blue my character who only lands on third place got made by the dev, with 1:1 comparison to mine, design wise and mechanic wise, the hero name is "Hacker" (Same name, design, movesets, gears etc)
i was shocked beyond belief and surprised because they never say anything about it but happy nonetheless because I'm just a sociology minor student at that time that does art for a hobby but in the end when the character got released on my server and i have to BUY MY OWN CHARACTER its just feels wrong.... I mean even though it was a popularity based contest and a forum exclusive one and the prizes aren't that good in the first place, heck i can say that it's horrendously low for a p2w game like Lost Saga that demands you to buy these heroes and gears using irl money and such (you cant grind them out) i still think that at least i can get my character of my own design for free. I'm an average spender in that game and kind of regretted it and i just think they didn't really appreciate my efforts or credited me properly.
In the end while i do feel kinda shitty I'm not really mad and extremely happy seeing my design that didn't actually won the contest have been brought to life. It also implies that the devs likes my design, more than the 2nd place winner at least, but if i have the knowledge back then i might do things differently.

This reminds me of a story from Sears. An employee came up with a wrench design where you could easily switch the socket and direction of the turn without having to take it apart and he submitted that idea to the company expecting them to do the right thing. They told him that they would not use the idea and then months later he saw it in an ad in a magazine. This wrench design is the one we all know of today. He complained and they responded by giving him like 20 grand or something. He pursued legal action and the company fought so long and hard that the original man's lawyer died and the case was taken up by his son. This is a second generation lawsuit that cost so much money to Sears said it would have been cheaper just to pay him what he was owed years ago

What is an even bigger shame is that they took the very original design (sure the Mesoamerican Lizardman is nothing new, but it brought some fresh things to the table) and turned it into a generic fantasy design, even dumbing down the name. I actually really like the Mesoamerican Lizardman aesthetic because it uses a fantasy race with no grounding in Tolkien (as other fantasy races tend to originate from) and it showcases a really vibrant group of cultures (I specialise in Mesoamerican Studies so perhaps that's just my bias) that is normally ignored or ridiculed in popular media - but the corporation, surprise, surprise, went with the safe mainstream option. No credit and no respect for the artist or their original vision.

@@TheCrimsonSporkA fair point, but I would dispute that somewhat by saying that Raid has also got orc and elf characters which Blizzard, Bethesda or Games Workshop could sue over if they could - but I don't think anyone actually has any real rights over fantasy races nor can they claim to possess cultural aesthetics otherwise the Tolkien estate could sue three-fourths of the fantasy genre. The Elder Scrolls also portrays the Argonians as Mesoamerican, and yet they have seen very little trouble from GW.
This is something you'd have to ask a lawyer of course, but I think most Judges would just scratch their heads saying: "What's a Lizardman? What's a Mesoamerican?" Although I'd love to be a fly on the wall listening to two professional lawyers battling using deep lizardman lore.

A long time ago I read a book or article about interrogations, and it said that people who tell the truth are often vague in their responses or misremembers things, while people who lie often have rehearsed a story and in the hopes of being believed they tell an almost too perfect story with too many details. Here's my thought about this. The "official lizard" would have been done long before the second contest but they put the original artist's concept in the that contest. That to me is a nail in the coffin.
That sounds super early but let's look at it. Before the official release of Ramantu it would have been over a year to conceive the character and get its finished. Not knowing how many people are employed or actively working on new characters that still seems like a long time. Now a four month period seems more likely to make a character and if the concept was basically done by the original artist they just need the visual and skill tweaks to make it an "original character; do not steal" situation, like changing Sonic's color and name; boom! Sonic oc. To me this is clear as crystal they are guarding their asses.

I wish I saw this when it initially aired. What Raid does is extremely common place in the art world. The majority of these competitions by these large companies is nothing more than a way for these companies to get free art/art ideas. They not only take the "winning" images but the non winners as well. It's technically legal as they post (in like 10pt font) legal jargon that allows them to take an artists concept and adapt it to their liking with no credit/reward. It is important for artists to read the fine print and ensure that before entering a contest that they retain 100% ownership of their work with a guarantee said work will not be used in any way, shape or form.

The fact that they doubled down and insisted that it was a completely original piece of work is what I think is going to be the key point of legal contention. Like you said, if they had admitted to it, they could have relied on that disclaimer they put in in the initial Art Challenge. Furthermore, call me paranoid, but I felt that when they asked for which questions the Creator was going to ask, they were doing it to possibly prepare and come with fabricated documents to provide evidence of their suspicious timeline to prove that their character was completely original.

There is a faction in the game called Lizardmen. The artist created his concept based off that faction (I can tell just be looking at the concept art)so it's within the realm of reason that they could have already had a similar concept. Also, the listed abilities are generally similar in nature to abilities that already exist in the game.

  • @FunkyBaconArts

From an artists point of view the champion looks almost nothing like the submitted concept art.
    * Bipedal lizard man with wings - Hardy the most unique concept out there. Heck, mod some wings on an Argonian in Skyrim and bam, there you go.
    * Frilled neckline - This is something that can be common on lizard characters, and these two don't even have the same type of frills. (also the face is more small, pointy and birdlike on the in-game model, not at all like the bigger raptor head of the concept.)
    * Dagger tipped spear as a weapon - Not that unique of a weapon and I have seen that on other lizard designs as well, especially the more primal looking ones.
    * Tail and spike pattern - They are not even the same type of spikes. The concept has bony randomized spikes while the champion seems to have a fin-like kind of design to it's spikes in a more streamlined pattern.
    * Wings with spikes - Yet again this is not a very unique feature and the spikes are very different in styles and looks.
    * Loincloth portion of the armor - It's a loincloth, many characters has these. The patters on them aren't even the same or particularly similar.
It is very possible that they really did have that character made when they say they did, and only now brought it out after receiving a concept submission for a hero that would actually fit that character. Especially after considering how very similar the skills are and how that would require less work to implement that way, so to me this seems to be the most likely case.
So did they copy the visual design? I would have to say no to that. But did they copy the character's playstyle concept? That does seem very likely, yes.

I absolutely don't understand their response to this. It would have costed them absolutely nothing: "Hey, thanks for reaching out! This design is indeed based on your contest entry. Although you agreed on our terms to pass all rights [...] we moved ahead and granted the champion to your account, free of charge with all associated optional content. Thank you for being such an amazing and creative part of our community!" (And they could even have done this in advance before he had to ask…) But guess common sense isn't anything some corporations want to see…

I once created a champion design for Riots "Urai Jacksam", Bunny with katana who uses tornados, gapclose and slash ability as ultimate which knocked up target into the air. Sadly I lost this design art piece and internet archives from site where I posted it also didn't live long enough.
Now it's one of the most imbalanced and used champion in their game in a face of a human - Yasuo.
I know it was a fan made design, but still I would like them at least say something like "we took the idea and made hero from it". it would be as good as "work well done" comment.

I don’t know what people expect from phone games. I played some Raid a couple years ago and it’s fine. One thing that’s better about Raid than older games of its type (I’m talking 2012 era) was that the old phone games would have about 5 minutes of gameplay before you have to wait to build up “credits” to play more. So they were lame. When I played Raid, I could mess with it for a good half hour or longer before it needed to go into “cool down” or whatever to build back your available playtime. An uninterrupted half hour is pretty good compared to the old games.
Pay to win is on the player. Personally I would never pay extra for a free phone game. It’s a phone game, come on. It’s something to do while you poop.

I don’t like Raid, but it could be a Magic scenario with Colfenor. There was a custom magic card that came out for Colfenor months before he officially got a card in Commander Legends and the similarities are striking. The issue is, sets in Magic are designed about 2-3 years in advance, so Wizards probably had an idea for Colfenor before the fan did. But they’re so close it’s scary and funny.

But regardless, the few times I've tried to use it on my nuts, it's snagged or nicked my balls. Not great.

I'm sorry but i genuinely do not see it
I understand the similarities that were made between the guys' concept art and RAID's released character, but is that truly stolen content? What does that mean if this would win legally? Are winged spiky lizards with spears not allowed to be created anymore because this guy has done it? Could he claim copyright on any winged lizard because he did it first or something like that?
I am really confused because when i look at the two and compare, they just don't look similar to me at all. I understand the elements that are similar, but if two shooter-games use a similar ACOG scope is that copyright too or how does this all work? Is it perhaps specifically contextual in the fact that he did this for their contest and they then made something similar to it?

    • @HowlingDoom
      @HowlingDoom 3 роки тому +1

Yeah the designs are similar but they aren't to the point one looks like they stole it from another person, at most "influenced". They did basically copy thise two abilities like straight up but that wouldn't win him any cases.

I was a character artist, I wouldn't stay the design was stolen rather inspired. Everything we create even at it's seeminglt most orginal is simply a montage of everything we have seen.
The original artist should feel proud in the fact that not only were they inspired by his ideas, but that his design is so much better even when they had all the chance to build on it.

  • @dailytact1370
    @dailytact1370 3 роки тому +1

The problem here is that you can't rule out convergent design, especially if the two artists happen to have followed allot of similar media before.
It's a bit like how Star Citizen released a salvage ship that was almost identical to a salvage ship from EVE and while fans raged both companies chuckled about it. It wasn't a copy, they both just used the most logical approach to designing a small salvage ship working on the same type of resource thus ending up looking the same. It happens.
