Exactly, I’ve known this for years...
I have a friend that works at the doors of my local Walmart often & back at Black Friday 2019 they had a great deal on a 50” 4K UHD tv’s - I bought one (he was off that day) I went through the cashier closest the exit door (although the self checkout were between me and the doors)
I paid & headed to the doors, of course I have this BIG ASS tv box sticking out of the cart 🛒 and the woman asked to see the receipt,, I ignored and kept going.
(Now as I was between the two doors - the place where the store the carts) She than said something else along the lines that I need to stop & shoe it (again) - I replied something like “no I don’t, it’s not a law”
She yelled something to another staff, and they got on the radios... calling for managers or security (loss prevention).
I’m out side just standing but the doors for a few minutes & I heard her tell others to make sure to get my licenses plate (I laughed inwardly - because I had already planned this out & called a taxi)
Next as I was a bit further from the doors now... waiting for the taxi, I noticed two men over by the doors watching me... they both had the hip radios so I knew it was loss prevention - they just stood there talking among themselves & managers for like 5-7 minutes & just walked back inside...
Next one of the managers came up to me & asked it they could just verify the purchase - I basically said to him, “you know better, there is NO LAW that states I need prove my purchase by showing a receipt... if I am suspected of theft the two loss prevention officers that were standing over there (pointing to where they just were), can/should go and follow my movement on internal cameras - where they will verify that I just paid for 1 item at cashier #1 - and you can clearly see I only have 1 item in the cart.”
He than tried to make a point of its unusual for people to just walk out with BIG TICKET items with out showing the that the purchase actually happened...
Where I than replied “that’s on those people for not knowing there rights, or the laws”
      Taxi arrived, loaded, left!

@@Alien_Highjinx The Walmart where I used to work required people to pay for electronics in electronics. Then a sticker would go on the box to show that it was paid for. When I worked at the door, I only asked people for the receipt if I didn't see them at the cash. It was a small Walmart so unless they paid at electronics, I could see them at the cash registers.
We had to ask for the receipt for the date for people who had a bag or big box.coming from electronics though. I would see the sticker and look at the date because people were using receipts from with other dates and grabbing tvs and leaving. Some people were also doing returns with empty boxes until the courtesy desk was told to look in the box. People were leaving with hundreds of dollars in the carts before we started asking for receipts. There were a couple of guys with loaded carts waiting for the greeters to leave to walk out the door. That day they went out the security door. Once someone didn't check the dressing rooms and a woman tried to slip out with big laundry basket full of stiff and tried to leave, but the doors were all locked lol.
Someone asked me why we started checking receipts and i told them the actions of a few mess things up for other people. We didn't have security so it was easy for people to steal.

There are actually police departments that believe it or not do not require annual physical tests. You have to take them when you first start and sometimes the first few years you're on the job. But once you've been a police officer a certain amount of time you no longer have to take them. I can understand lowering the bar a little bit for an officer who's been on the job for 20 years. Because a man who is in his forties isn't going to be likely to be able to pass the same physical test as a man in his twenties. But they're still has to be something right?

      john milner Not My Problem.
Once I've paid, we are done. Surveillance, lost prevention, whatever. But once I pay, it's "Thank you, customer," and goodbye.
This is why I do not show my receipt. Have some dignity, and self respect.

    • @thxman1968
      @thxman1968 6 років тому +3

Jack Crow Sure it's your problem, we all pay for it on a daily basis. I've seen it myself many times in the self checkout line. You scan one item, you bag the next one, scan one, bag two. What idiot could not see why a store would spot check? If you don't like the policy, don't shop there.

    • @jackcrow3477
      @jackcrow3477 6 років тому +10

john milner You're correct in that we all pay for the theft, as it must be factored into cost. I get that. True.
But unless I've paid a membership, signed a policy, like a Sam's Club, that store policy ends when I have paid. At that point, we are done.
Up to that, do all you like.
It is not spot checking. Wal-Mart for example, will try to have a line and have everyone comply.
This is absolutely a waste of time, mine and theirs. They do not check anything anyway, they just like the illusion of security.
I've worked loss prevention. You're looking for the guys stealing a pallet of baby formula, not a person grocery shopping.
And fyi, if I ever saw someone stealing like you described, as an individual I would call them out immediately. Where I live, theft is considered extremely dishonorable, and no, I do not see that. There is usually security there, cameras, etc.
I would perhaps concede that this was justified IF it stopped theft. It doesn't.
I walk past these people to my car, and if challenged, I tell them, "No thank you," and I leave.
It's a total waste of time, and not the way to treat a customer.
It is their policy, not a law. Once I've paid, our relationship is at an end. If they don't like it, call a cop.
I refuse to submit to being treated like a thief.

I’m a Police Officer. If Walmart calls me to assist them with a customer who does not wish to allow them to look at their receipt and items in their bags, then they will first have to explain their reasonable suspicion of him/her stealing from them. Without that reasonable suspicion or probable cause, then they’re wasting my time.
It’d be a lot easier for customers to just show the receipt to avoid conflict, but their policy is a slap to every good customer who is simply minding their own.

    • @billlupin8345
      @billlupin8345 5 років тому +5

If you're a cop, you know walmart doesn't call the cops for people who refuse to show their receipt. That would cost AP his job. To call the cops, they need to have proof of selection, concealment, and intent to steal. Policy also only has them make apprehensions for thefts of more than $25, which is why the guy in this video was let go. Had he refused to go, he would've been trespassed.

    • @thechief5437

Bill lupin - Walmart obviously called the police without proof or reasonable suspicion that this man stole something. That’s why he was allowed to leave. That’s the point I’m making. They would have to explain to me why I’m being asked to investigate this matter before I go there. This was a complete waste of law enforcement’s time, and they should’ve questioned the loss prevention employees before questioning this man.

@@thechief5437 Go back, and read my comment again. I don't think you did.
In order for your comment to be true, the AP would have to go against all of his training, opting to lose his job, and open the company, and himself to lawsuit, AND every last one of these cops would have to have decided not to follow basic police procedure.
And you're thinking that they did this because they thought MAYBE all of this, plus the PR fallout, would be worth MAYBE catching someone who MIGHT be stealing two tupperwares and a box of cinnamon toast crunch?

    • @thechief5437

@@thechief5437 The APA followed this guy, saw him steal something by putting them into bags he brought from home, followed him through the store to make sure he didn't put anything back, saw him go around the registers, called the cops, and made the stop. Guy refused to come with him to the security room, and decided to argue. Cops show up.
While all this is going down, the APM is rolling back the footage, and telling an assistant manager what he took. She checks the prices, realizes "oh, hey, he's only stealing two tupperwares and a box of cereal, policy says we don't have to apprehend him," she goes and tells one of the cops that she just wants him out, no charges, and the cop tells him he's free to go.
You can observe the video closely for clues. Case in point- this store uses white bags. The carts going by in the background? All white bags.
      Bags in his hand?
...Mostly white bags. He's using the two white bags to carefully cover the grey bag in the back.

I asked him why he needs to see my receipt and was I suspected of stealing anything. The guy says no. It's policy. I said who's policy, yours or Walmart. He said Walmart. I said go get the policy and show me where it says that a greeter can act like a security guard and randomly stop people and ask for the receipt before they walk out the door without any suspicion of theft whatsoever. I also told him. That if Walmart's policy is for him to play the role of a security guard, he should get paid Security guard wages.
I could have walked out right then cuz I won the battle of wits. I told him to go get his manager I want to speak to him. We had a discussion about this is America and Americans have the right not to be stopped randomly buy Walmart greeter needing to see a receipt when of course there was no suspicion. He apologized but he said they're not going to change their policy. I told the manager. Then you need to pay your greeters more money if security guard is also in their job description. Yes I know it would be easier just to show the dude my receipt and 10 seconds I am out of there. That's not the point. The point is, this is not Soviet Russia

There's also laws to protect businesses' right to detain suspected shoplifters for a 'reasonable' amount of time. If I had to give an opinion, I'd say the 2 minutes we saw him detained was a 'reasonable' amount of time.

    • @BestLittleStudio
      @BestLittleStudio 6 років тому +8

      Lagon78.
In this two minute video the police and wal mart employees both state they are not accusing him of theft. Since they are not accusing him of a crime, and he wants to leave and they are preventing him from doing so until he shows a receipt, and he is not legally required to show a receipt, we can determine, from this two minute video, that in the two minutes we see he was illegally detained.
I say he was illegally detained because they don't suspect him of theft which means shopkeeper's privilege does not apply, he wants to leave, which means it is not a consensual encounter, and they are refusing until he shows the receipt, which he is not legally required to do.
So in my opinion yes, in this 2 minutes video we can in fact see that he was illegally detained.

Actually all 50 states allow for shop keepers to request proof of purchase. You do not actually have any “rights” when purchasing from a private retail establishment. You do have the right to NOT shop there, and while I do encourage everyone to exercise that right when it comes to Wallyworld, they do have the right to request to see proof of purchase. Most retailers don’t ask unless they have legitimate belief that a crime was committed because it is poor customer service, however, they do have the right to if they choose to.

The store must accuse you of a crime (shoplifting) and then the cops can legally search you. If you did nothing wrong you have a slam dunk lawsuit. I won $23k lawsuit against Kmart over 20 years ago for this when I bought a battery and paid for it at the auto section cash register and they chased me outside. They stopped me and asked for a receipt. I informed them that I did indeed and started walking away when one of the guards grabbed my arm to stop me. I told them to immediately call the police (no cell phones then).
In the mean time they went and asked the automotive dept and found out that I had indeed paid and told me I could go. I told them that wasn't going to happen because they had detained me and not only detained me but did it physically by grabbing me. I filed assault charges (they were dropped) and I hired a lawyer and got a nice check for my troubles.
After that I worked security for tj Maxx and they knew the rules. They told us we could not stop anyone for shoplifting unless we saw them conceal something and we did not take out eyes off of them just in case they dumped it in the store before they left.

C Burkins, 'private property has a right to request" Yes, they can request but they cannot demand. One does not give up their constitutional rights when they enter a store open to the public. You DO realize that in order to be detained and forced to prove you purchased an item, there must first be a claim that you stole that item?
Barring that, everyone who shops at that store is automatically suspected of theft. The only time I get pissed is when the 'greeter' actually sees you pay for the item and walk towards the door. Kind of stupid considering they seldom even look at your items, its just a form of forcing the citizen to submit to authority. And if you give a private store authority over you, then you may as well give up any thought of being a free person.

Pineapple Jack, actually if you watched the video again, you will find out you are entirely incorrect. At the very beginning, the officer says 'when did I accuse you of anything?". That clearly tells me that there was NOT a claim of shoplifting made.
i have worked security for strip malls and believe me, police DO random patrols of those centers. Their job is NOT to investigate a non crime, in fact someone in loss prevention must witness what appears to be shoplifting, not just a hunch.
Whether the guy was a loud mouth or not, he was standing up for his rights. The courts have ruled consistantly that once you pay for an item it belongs to you. NO ONE is ever forced to prove their innocence especially if no crime has been reported to begin with and from the very beginning, it appears no one said shit about shoplifting or had made any such claim.

WAL-MART'S scared of the sensor making a false alarm, they search an innocent person, then gets sued. They don't search people randomly. They ask for receipts for customers with unbagged merchandise.
Also, it's not to catch thieves. It's meant to catch cashiers forgetting to ring up large items at the bottom of the cart.

They had it, I'm sure. Thing is, they only apprehend for $25 and less, and eyeballing his bags there, I don't think he had $25 in 'em. Two tupperwares and a cereal box.
That's probably what the manager was telling the cop, when she walked up in the back there.
And no, they don't produce evidence right there on the sales floor. They'll ask the person to accompany them to the security room, and produce the evidence there. The fact that cops were waiting for him tells me he was doing all sorts of shady shit, prompting them to call the cops in advance of him walking past the POS.
(And no, if the cops are already there, and they have evidence of you stealing, they'll just provide the evidence to the cops in said security room afterwards.)
If you've ever worked in retail, you know the shady shit I mean. Pocketing things, putting them on the shelf a few aisles away, scanning the room for people, looking up at cameras, and making 20+ laps of the building to spot pursuers, lingering in spots with high value merch, and areas without cameras.

That way customers don't have to provide a service Walmart should be providing, AND Walmart gets to check the receipts when the cashiers hand them to the customers. As an added bonus, customers don't get pissed off having to prove they paid for items that they already own.

For you dumb shits that dont understand contract law. There is an offer, an acceptance, and consideration. Once the product is offered (for sale by Walmart), acceptance (picked up by you to purchase) and consideration(The payment for the goods offered), ownership of the goods transferred from Walmart to the consumer. Standing inside of Walmarts property means NOTHING. Walmart has no authority to demand anything. For the warehouse clubs, it is written in the agreement you signedthat you will show your receipt as a condition of the membership, but at Walmart, there is no membership. NEVER show your receipt. You do not have to prove innocence, or that the property is yours.

frank sullivan sr suspected is a vague term, since stopping people to check their receipt is part of Walmart’s policy, you walking away when asked to give your receipt technically gives them probable cause that you have stolen. I agree it’s fucked up but it’s how the law works

@@PPMOCRG finally somebody is on point! Wal-Mart employees and security have the right to verify receipts, especially if the items are high value items that are not in a bag. The customer can refuse, but Wal-Mart can record their plates, review the cameras, and call the police if necessary. Also, Wal-Mart can verify receipts under the suspicion that someone maybe stealing. Again, the customer has the right to refuse, but that means that they want their plates recorded by Wal-Mart.

So this is a common thing and I just like to share a little bit of information for my own experiences..
One I'm from North Jersey I'm white I'm overly tattooed big beard long hair so I'm very commonly stereotyped by the way I look I shop at Walmart with my wife on a very regular basis and almost 80% of the time while exiting they try to check my receipt..
Here's the deal if you're holding your receipt in your hand they could see you have it just keep walking they don't have the right to check your receipt and they don't have the right to put their hands on you..
Not even there supposed security has the right to put their hands on you..
    This is via the police..
If there is no posted sign saying they have the right to search your contents at exit then they dont have the right..

Is a funny thing I commented on something... I didn't need your comment on my comment this isn't a debate this is my opinion fuck off...
And and considering it has nothing to do with look on why they're stopping people at Walmart it's still against the law and this is what the video subject matter is of I'm just highlighting the fact that they stopped me a little bit more frequently considering my look..
      And that's a fact,.

There is no LEGAL or contractual requirement to show a receipt at Walmart. I. The case of SAMs Club you do because you agree to and have a binding contract when you got your membership card. The customer can defend his property.

    • @OverlandOne

Alien: Once again, you are an idiot making assumptions. I am a lot older than you are. Were you in school when JFK was shot? Didn't think so...I was. So, abide by Walmart's rules, or don't shop there. What part of this do you not understand? Personally, I don't shop there because in my town, they have a policy against carrying concealed weapons, which I carry all of the time. All they are doing is creating a "gun free" zone which is really another word for making the place a target. But, that is their right to do and my right is to not shop there. See? I don't go in and film myself arguing with security about carrying a weapon, and preach about the 2nd amendment...I just do not go. That is all I am saying. Please do not assume as you know what happens. PS I use my company name here and do NOT steal music or any copyrighted materials. I make hardware...duh.

Are you legally required to show your receipt after leaving Walmart? The short answer is no you do not however in places like Costco or Sam’s you do because that’s part of the membership agreement you signed. It’s up to you to determine whether or not you want to deal with the hassle of standing there and talking to cops about something trivial or just show them the receipt
