8 years and some parole for manslaughter, what an absolute joke. That woman was sentenced to death for the crime of walking outside in her own neighborhood and the man who killed her gets a hard slap on the wrist for it.
Or, maybe, *_speeding_* should be punished more severely. Are you going to pretend that had nothing to do with this situation? Most of the time I hear about a DUI fatality there is reckless speed involved also. Between DUI and speeding, only one of the charges is treated with anything resembling severity. A DUI, even without any accidents occurring, will typically alter a person's life rather significantly. Really, increased penalties hit the point of diminishing returns somewhere in the 90s or 2000s. Speeding, on the other hand, is still almost always a slap on the wrist. Even if they're going 95 over 55 or 50 over 25.
@vals_loeder you said "dui." You didn't say "speeding." You didn't say "speeding and dui." Of the two, speeding is really the only one that still could have increased penalties without diminishing returns. It follows that you believe the only operative component to this was the "dui" part.

I think you meant someone with the level of his crime shouldn't get 8years. Drunks/Druggies usually get rehab or 1 day--2 years if any time-served. "Simple Possession" rarely gives 1 year.
First, understand that this is the kind of case felony homicide is made for. He was engaged in a felony, I am assuming from his disorientation, as most states consider very high BAC an aggravating circumstance, that increases charges/penalties. But the 8th amendment is not meant to be a pre-incarceration fine prior to you being convicted of the crime. And that's what it has become in most states with bail bondsman. The purpose for bail is historically (like the newish Bruen factors for 2nd amendment cases) to guarantee your appearance in court. Period. Anything else is current practices being used to validate unconstitutional laws that have gradually eroded our rights. There is nothing unconstitutional. The federal Constitution in denying the accused bail, just that IF bail is granted it must be affordable. Now the court system typically requires a good reason to deny bail, which can be general criminal history, how often they reoffend, and the danger they represent to the community. So with a first DUI you get some pretty draconian punishment. But the second one is the one that's going to put you in prison. If you are caught driving at all after a second DUI with your license suspended, now there's a very good case for denying you bail. Once is a mistake, but this is now a pattern that is dangerous to the general public. His addiction to alcohol is tragic. His inability to control how it affects others is criminal.
“I will make it up to you,” he says to his wife. Ugh. What’s he gonna do for the dead lady’s kin? There is NOTHING he can do to make it up to them. Except spend his life in prison.

My older brother, who was 62 at the time, got a 10yr sentence for “distribution of pot”. The extent of his distributing was buying an oz or 2 and splitting it with his friend. He had no record and was a total homebody who smoke grass to relieve anxiety. He only served a little over 3yrs, but it was awful. Less than a year after he was released our State legalized it….
And this guy is gonna get out after 8.yrs???? Wow.
Such a f'ked up system. Not sure why common sense is so rare in society.
I know it’s horrible, but they’re 2 different judges. We know what seems to be right, but it’s hard to compare unless you’re dealing with the same judge. But with that said, if you don’t do wrong, there’s no sentence to worry about. We know the system is fucked up. Best thing to do is stay out of it. Sounds like your brother shouldn’t have gotten more than probation tho
That's insanity, that should've been 12 months supervised probation, and maybe mandatory drug counseling at best.
It just really sucks that marijuana was illegal and sent so many people to prison for so long. I’m sorry your brother had to pay that price because of what the manipulators who came up with Reefer Madness in 1936 started.
Unfortunately some states used to value the possession of pot a greater crime than 3rd degree homicide 😢.

A horrible example of why DUI should be punished way more severe.

Having an aunt and uncle who were both paramedics, I hope these first responders take care of their mental health. My uncle ended his life a couple of years ago. Responding to these type of calls can take a toll on one's mental health
I’m so sorry.😢
@@catalina1968 It's alright. They're both recovering alcoholics. My aunt has been clean for a while, but my uncle fell off the wagon. PTSD is a serious issue for first responders that doesn't seem to be addressed all that well. But I guess the same can be said for anyone with PTSD. There really isn't an effective treatment for the disorder, except for psychedelics. But access to that is very limited. At least for right now
It disgusts me how he tried to sound innocent because he 'didn't remember a thing'. He didn't remember anything because he drove high on drugs, the rest of his excuse making is irrelevant.
He had ZERO sympathy for the last poor woman he killed
It broke my heart when they said her throat was completely gone there was no chance of saving her or final words she was literally ripped away from this earth and silenced forever and no one even had a chance to save her or be with her in her final moment

DUI and vehicular manslaughter; should be 30 years MINIMUM without parole!
It’s so hurtful knowing people are truly like this. One day, I was leaving work a little early. As I was turning onto a busy road in a bad area, I was looking left and right to turn onto the street. I saw a lady who looked either homeless or very low income standing on the side of the road. As I turned my head to the right, I heard a large banging sound and tires screech. I look to the left to see the woman in the middle of the road. I instantly screamed and burst into tears at the realization that the lady I just saw a few seconds earlier had been hit. I was heart broken. The car sped off and a few cars that were already on the street had stopped and people went running over to her. Sadly, she passed away after being hit so hard. I had to pass her body and seeing her condition hurt my soul but seeing those men, who rushed to her aid, standing around her body to preserve her dignity was beautiful. May that lady rest peacefully.
My wife was violently hit by someone running a red light. The cops literally did not charge the guy at all. I called the station and said I wonder what would happen if I did that to one of your cruisers. I probably would have a 100k dollar bail and 10 charges. These drivers should be charged way harder.
Was he running a red light or violently running her over? You can’t just describe something as violent if it was poor driving.
@@Danfrank24 he ran a stale red light at 50mph in a 30

A young kid on his phone rammed into him at 45 mph.
My son was the 15th car in line at the red light.
Horrible back injuries

8 years for taking someones entire life, what a joke...

@@benjaminharrisiv650 Taking drugs is not a mistake. And he is definitely old enough to know that doing drugs and driving is illegal, and knows the things that can happen. A mistake is not what he made. He made a poor choice. A decision that was thought out and planned. No mistake. Sorry, bud. You must be projecting in some way. That is the only thing I can think of.

8 years?! Absolutely ridiculous. He took an innocent life and should be sentenced to life without parole.
It could be longer, but this a blue state Minnesota, where the criminals are victims.
I hate to tell you this but he’s going to serve maybe 3 years before they release him. People don’t realize some states they only have to serve 30 or 40% then let go. One guy was sentenced to 25 years for a shootout with the cops and it was a huge thing. I believe they released him after 7 or 8 years and he got into another huge shootout with the cops. It seems like the more harsh the crime the earlier you will get released.
They are handing out 7 years sentences up in Canada now for 'hate speech'. Folks in Europe are getting 3 year sentences for protesting against the massive influx of illegals, child rprs in America get off with probation....the systems are fkd man.
It was a mistake. Mistakes happen.
@@pep590minnesota is a beautiful state. Better than most good ol boy republican states.
What's disturbing is the "no big deal" attitude they have about it all and how she is cool with just bailing him out and moving forward with his loser. Birds of a feather.

that 911 call was insufferable. Jesus he hopped over a curb and they're acting like he just shot somebody
He should never get out of prison

Right!!! Sick and sad.
Because its probably his money he has all the right to that. I have commited a traffic situation on benzos before, was sentenced for that too. It really is no joke but you are not really culpable in that moment. They should let him out sooner then 8 years.
i was a minor and hit two cars on a stunt scooter on Clonazepam. I redosed the day after and didnt think the dosage from yesterday would still be active not like with alprazolam /xanax/, I had a complete Blackout and woke up in the hospital, lost my glasses that day and i was trying to flee but i fell and cried..I have way crazier stories then that but yeah i have court on the 29th and i might get prison for stealing stuff. I live in germany btw
Clonazepam has a longer half life then most benzos 48hrs
My dear friend was also killed by an incapacitated driver. He only will be in jail for 8 years as well.
This judge, and judges like this one, need to go to jail for failing to protect and serve the community. Period.
He got a harsh enough sentence in Canada he would have gotten two years less a day maximum.
@@voldimmoral
Sentencing guidelines are set up to take emotion out of the equation and use facts to determine length of sentence. If he had been charged differently, there may have been other options. This isn't about the judge, most likely.
I did 5 years for a firearm you are lost about your own countries legal system loser. @@parkerbohnn
@@ostensibledichotomythanks for explaining this. Most judges would favor harder sentences but are unable due to sentencing guidelines.
You're mad at the wrong person. The judge can only hand out the maximum sentencing, which in MN is 8 years in prison and 4 years of probation. Get mad at the people who set the sentencing which is your legislator.
This is why I got sober from alcohol. I could never live with myself if I did this to someone. And take them from their family. I know what’s it’s like to lose loved ones. WE DONT LIVE IN THIS WORLD ALONE. CANT BE SELFISH.

Sadly in the UK it's the same - the sentences for killing other people whilst driving dangerously and/or under the influence are nowhere near long enough.
8 years!!!! Her life was worth much more than that!! I do not understand this justice system. He chose to get high on drugs and drive. He deserves LIFE in prison!!! She got a life sentence!
He took a life he deserves to stay in jail for the rest of his.
