    As a CPA I have asked people who receive 1099's if they are really an employee or independent contractor. This is true of house keepers, live in nanny's, or others. The main question I ask is "how important is this job to you?" and "do you want to pay the employers portion of the taxes for them?" I knew there was a way to pass the taxes back to the employer by completing specific IRS tax forms.

    If I’m an employee and I’m being misclassified as an Independent Contractor and I’m given a 1099 come tax season will I get in trouble? Or, am I just responsible to pay my taxes that I owed the government that wasn’t taken out of my pay throughout the year? Including Self employment tax. I’m a Truck Driver and a lot of small companies are doing this.

    Hi, great video! What recourse does someone have if they're currently working as an IC, though they obviously fall under an employee/employeer relationship? Many people stay in this situation because it means a paycheck even if they know they're being taken advantage of, what would you say to them?

    Great content! I know that this is an old video now, but I had a brief question... If only 1 out of the 6 points you mentioned in the video was relevant, (Providing of tools/equipment) does that definitively create an employee situation? Or could you still use the independent contractor status from an IRS standpoint?

      You can still call it an independent contractor because that’s what taxi cabs that’s what they do they provide the equipment but the driver is steel independent contractor

    Hi aiden,Im the owner of a business with 350 employees. My competitors use independent contractors for their sales people. They train them:they have managers they work with;many of these independent contractors have been working with them for upwards of 7 years;they cant work with any other companies ,yet , the company feels they are protected because this company doesnt set there schedules. Are they correct?

      No that’s an employer type of relationship that’s not an independent contractor type of relationship they are doing it wrong and if the IRS hears about it they could be in a world of trouble

    If you’re independent contractor under 1099 and you have a card for a security guard. Do the company you work for take out general liability and workers compensation?

    Hi very informative! Question.... I work for a driving school and I have only worked there since 1/20 I was told I would get a 1099 at the end of the year
    Well.... i have to file for this pandemic unemployment I don't know how to file for i employment. I have no income for 2019 and I don't know what to put for my job

    How about majority of the work? A worker that does mostly contractor type of work, like 95% of the time. Can I just label them as a contractor?

    I want to know the legal diffence between the IC and the Employee:
    1. Can I use the Employment contact as an IC with this LLC compnay as leagal Contract that I'm wokrking on my country (I'm not askig you leagal question about my country), but mostly, I'm saying if the IC has the same Legal level of an Employee.
    2. Can I use the IC contract I signed to have a Visa to be bale to go to the US? I know that if some one sign a contract with a US compnay he can use it to go there? is this true or possible?

    Hello, I'm from Tunisia and I'm not a US-citizen nor located on the US or ever been there. I'm working with an LLC Company and I want to sign with them an "Employment Contract". I'm very confused about this as I'm watching your video because I don't know whether I'm an I.C or an Employee with this company? I have a monthly salary and the busness owner is welling to sign the Contract for me, so I want to know your answer about this please, thanks.

    My question.
    "If i register my business in December 28th 2014, will i have to file taxes for the rending couple days?"
    Should i wait till 2015 to get a whole year brie i have to file?
    I'm young, but my soul in a entrepreneur!

      If you absolutely zero income to report and no expenses that you want to deduct, then no. But I'm assuming you've had at least a few expenses (like registering the LLC), and those are deductible, so you may want to file a Schedule C for that purpose alone even if you had no income.     What about using a staffing agency???? How is that classified???

      It depends! To the employer, the worker, via the staffing agency, is usually a contractor. The employer pays the agency, agency pays worker. To the agency, the worker really could be either. It depends 🤷🏻‍♀️

    Hi Aiden, If I want to hire an "assistant" starting at only roughly 5 hours per week, with potential and probability of increasing that and/or hiring an additional "assistant" where the "assistant" chooses when they are available to provide the services, however they probably will not provide the services to others because they do not have time as a stay-at-home mom, can I consider her a "contractor"? She would provide both household help (so I can work on biz to make more money!) and she would also do some tasks for the business. I would rather not have to deal with "payroll" taxes etc. I would rather be able to pay for the help I need in a contracting basis, though it may be fairly regular in nature. We have created an invoice for her to "invoice" me. Thanks, Amy

      It COMPLETELY depends on the details. Nothing wrong with dog groomers being independent contractors as long as they are actually being treated as independent contractors. The specific job/industry has very little to do with it.
