I live in New Jersey. My brother was driving home after a long night of drinking at the local tavern. On his way home, a police officer saw him noticeably weaving in and out of his lane, and pulled him over. The officer noted the smell of alcohol on his breath, and asked him for his license. He then asked him for a Breathalyzer test which read 0.7. He was arrested and taken to the police station. Can someone suggest a good DUI lawyer?
So true - although it may still be a while before someone who has been drinking can legally get into a self driving car.....best bet for those drinking is to get a Uber or Lyft or just not drink like you!
@@mustanggang5.0 I have never gotten one, and I’m convinced I will never get one indeed. mainly because I’m responsible and I never touch a steering wheel if I have a drink.
Diversion in California is a bit all over the place with DUIs. You should consult an experienced attorney who knows if judges in the county have been granting diversion on DUI cases. If so judges are, then it goes to figuring out a way to convince a judge that diversion is appropriate in your case. Best of luck!
The main tip would be is to consult a DUI or criminal defense lawyer in the county where you are being charged since it really depends on whether it is a felony or misdemeanor and some counties are worse than others.
If you are in California, some things can differ depending on the county. However, a refusal to submit to a chemical test after being arrested can lead to additional jail time and even on a first offense, a 9 month DUI program. DMV typically suspends the privilege to drive for 1 year with no ability to get a restricted license. There are things a cop is supposed to advise an arrestee to add an enhancement for a refusal so best to talk to an experienced DUI attorney in the county or area you were arrested.
I got a DUI and spent that night in jail. My BAC was .31 After I go to court in a month what are my chances of doing more jail time or will I just lose my license and need a breathalyzer in my car after I get it back. From Washington state by the way. Thanks.
What if I didn’t get pulled over but someone called the police in a public parking lot and got charged with a DUI. What are my chances of my case being dropped? I blew a .13
Really depends on whether someone saw the driving, whether an arrestee made an admission, other evidence of driving, whether proper procedures were followed, and other things especially when a cop didn't pull someone over or see the driving. Best to consult with an experienced attorney in the area where the arrest was made.
Laws vary state by state, but pretty sure you are not going to get a DUI if you were not in control of a vehicle. Do the police believe you were in control of a vehicle when you were arrested?
Sometimes when someone says "CDL" it means a commercial driver's license. Not sure what state you are in, but in California, walking after drinking even if really drunk, is not a DUI. In California if the DA can prove that an individual was driving earlier and at that time the person was either impaired to drive or had a BA of .08 or higher even though the individual when contacted by cops was not driving, it could lead to a DUI conviction - perfect example is an accident. Best to consult with a DUI attorney in your area.
@@staypositive1040 Don't disagree w/ anything the attorney said. Just want to emphasize to you that the State prosecutor must prove beyond a reasonable doubt that YOU were in control of the vehicle at the time of the DUI.

Sorry to hear. A lot depends on where your arrest occurred. Here in the Sacramento California area, you can't do too much before the court case as it relates to jail time and it really depends on if it was a first DUI or not. The best thing to do is to consult an experienced attorney who deals with DUIs in the area where the arrest occurred. In my area, there are things that can be done for DMV purposes so there is no actual loss of the privilege to drive, but each case is different and I only know about California.
@@okayisee2550 Best thing to do is to contact a good DUI lawyer there and don't forget to contact DMV Driver Safety if you don't hire a lawyer before 10 days go by if the cop took your license and handed you a pink DMV temporary license!
Except Utah, the legal limit for alcohol is .08 for those 21 years and older. In Utah, it is .05. Laws vary for those under 21 years old. There are laws for driving impaired even if the blood alcohol level is less than .08 and for driving impaired due to drugs or a combination of drugs and alcohol.
My brother had a DUI and hit a Water Barrel but didn’t hit anyone. It was his 2-3 time. He wasn’t speeding. Will he do prison time or jail time? I’m a veteran and I was wondering if my presence at court would help him and give him hours of community service at out local church. This is Danbury, Connecticut
It can be very problematic since it will result in a violation of probation on the old case, DMV will suspend the license including a 1 year no drive (no restricted license), and if there is a conviction on the new case, harsher punishment.
