[LAW SCHOOL PHILIPPINES] What to Expect in Law School - Legal Ethics

  • Legal Ethics is that branch of the law that treats of the lawyer’s relationship with society, the client, the bench and the bar. It is a bar subject into itself, and counts as 5% of the results you have to produce for the bar exam. It is usually taught during your first year in law school Philippines, typically during the second semester.
    Madalas hindi seryosohin ng prototypical law student ang Legal Ethics dahil madalas ang mga nagtuturo nito ay mashonda na, boring pa. Proud pa si ma’am-sir na kaya niyang mag-operate ng bago niyang Macbook Air. For what it’s worth, mahirap din na nasa estudyante ang sisi, dahil madalas lunod na lunod na tayo sa mga kaso ng Constitutional Law II at ng mga dapag sauluhin sa Criminal Law II. Kaya madalas, Legal Ethics ang sacrifice.

    Yes..as a lawyer it is your duty to accept the client regardless of his bad reputation in the neighborhood. In the eyes of the law he is innocent until proven guilty. And as his prospective lawyer you need to see him with the utmost objectivity. Thank you sa video atty. Lex, first year student here.

    This is the last subject for the bar exams. I remember since the coverage for remedial law is too damn long and pagod na ako sa last weekend (kahit sino naman yata), I just gambled in this subject by mastering two things: (1) knowing by heart what quantum meruit is, and (2) memorizing the lawyer’s oath. It turned out to be okay since nasa lawyer’s oath na mostly ang sagot tapos ang fee quantum meruit lang lagi sagot ko haha fun times. Nice video attorney.

    I may accept him as my client. Under 1987 Philippine Constitution said person still has the right to be presumed innocent until proven guilty beyond reasonable doubt. And as a lawyer, I have a duty to not immediately refuse my services to the needy, except for some reasons, one is a possible conflict of interest between my existing clients and the said prospect client, another is if I found myself not the competent lawyer to carry out his defense before the court. If that is the case I will just instead render legal advice in order to inform that person about his rights and refer him to another competent lawyer.

    Oo, dapat pa rin siyang tanggapin bilang kliyente dahil ang isang sundalo ng katarungan ay hindi humuhusga sa labas na anyo ng isang tao o sa opinyon ng nakakarami. Ang isang abogado ay walang kinikilingan at laging handang tumulong sa nangangailangan maging sino man ito. Kinikilala at inuunawa muna ng hustisya ang isang kaso bago ito makapaghatid ng nararapat na hatol.

    Great overview sir! Ive found so far this semeseter that Legal Ethics is a thorn of a subject that shouldnt be underestimated. The bevy of cases assigned definitely surprised me.

    Yes. Based on on the Code of Professional Responsibility, Rule 2.01 of the Canon 2 A Lawyer shall not reject client except for valid reasons the cause of the defenseless or the oppressed . Rule 2.02 States that In such cases, even if the lawyer does not accept the case, he shall not refuse to render legal advice to the person concerned if only to the extent necessary to safeguard the latter' right.

    Not a lawyer nor a law student, but my answer is yes. First hindi buo yung kwento we can not assume that he did the crime malay mo kasama pala sya ng na tegi at nag seseek din sya ng abogado againts dun sa pumatay. If sya naman yung pumatay malay mo self defense lang ang peg. And also lawyers job is to protect the rights kineme. Nabasa ko rin sa case ni larañagga may part dun na PAO ang naging counsel nila nainis yata yung korte kasi nag papatagal sila d lang ako sure.

    Yes. He has the right to be heard and it is encumbent upon the lawyer to aid the man in the exercise of such right.

    Yes. If im not mistaken, as stated on the constitution, parts of the rights of the accused is the due process of the law and be represented by a counsel.

    Yes, a legal profession is a public service profession. A lawyer should not refuse his service to someone who needs legal help, regardless of his appearance whether bloody or with clean hand, lesbian or gay, rich or poor. I am enrolling this year, wish me luck! hehehe

      Hi, sis. Thank you for the question. I cannot recommend a degree for you because that will be four years of your life, trying to study materials that you may or may not have the passion and the inclination for. If I were to do it all over again, I'd still pick Political Science because it has helped me round out my education. It has given me skills I use in my employment almost on a daily basis. Second place would be Accountancy and Legal Management. 😊❤️🙏🏻

    Yes. A lawyer has no right to reject a client except for valid reasons. The guy deserves to have a lawyer, fair trial and is presumed innocent until proven guilty. Hehe. Try lang po. 😊

      Good answer, kapatid. As you will later learn, a lawyer is free to accept clients. What he cannot do is to refuse to give legal advice. He can reject a client based on conflicts of interest or lack of skill.
      He must, by law, advise the person of his rights and refer him to another lawyer. This is why we keep in touch with our law school classmates. 😊❤️🙏🏻

    It depends kung ano yung nangyari. Basagulero nga siguro yung lalaki na kumatok sa bahay pero yung time na dumating sya sa bahay at kumatok, eh, sya pala ang biktima. hahahahaha :D
