From 5 minutes of Googling (I am not a laywer, etc.), I think there actually are serious penalties for bogus copyright takedowns: you have to swear under penalty of perjury that it's your work, and perjury is a serious crime. **Edit**: Strike that, it's only perjury in really specific cases; most of the time it's only a monetary penalty (damages and legal fees) which probably wouldn't mean much to a big company. **Edit 2**: and even that penalty apparently applies basically never. So it probably does need a more serious penalty -- but even then to actually _get_ the penalty you'd probably still need to go to court, which isn't much consolation for most of us.

Well, after watching this video. If I was ever called to court for one of my fan made trailers infringing on copyright, while I don't really know what I'd do. I do know now that saying they are parodies would be a reliable defense, right? Also, with the way I structure and treat my channel, I don't mind Hasbro using my videos for money. They already use two of them for that anyways.

Was definitely interesting. Regarding the Let's Play thing, as far as I know (I didn't start yet) Let's Plays technically count as copyright infringement since footage from the game is used. I'm not too deep into the topic but from what I read is that (at least in Germany) you need to ask the publisher (or creator for indie games) to record the game and (what most want) monetize the video. Technically you even need to ask for both separately because some companies are okay with recording and uploading the content but not making money out of it - 2k Games, Bethesda or Blizzard had a policy like this, even though it could vary and might have changed over time (just ask and see how they decide for you).

Find independent musicians who aren't owned by anyone or anything available to work directly with you OR use UA-cam's hand-picked list of copyright free music.

Even on my videos, sometimes people claim their song is a Creative Commons license, but it turns out they stole the song or they've enrolled in content ID. Art, writing, scripts, dialog, etc. It's a gray area, but essentially you just can't copyright a character. Ergo, on a stylized piece of work, fair use actually isn't even an issue because the only thing 'infringed' upon is a concept--the character itself. That said, characters can still be protected through means other than copyright (eg trademarks) and that becomes a different can of worms. Unless you live in Canada. Or Japan. edit: You actually did mention characters, saying the copyright applies to them. :V That's actually incorrect, though (unless you're in one of the aforementioned countries). Common misunderstanding. As I said, it has to be some piece of media. It IS possible to copyright a character but that's a hugely complicated process that not even a lot of major companies have been able to go through. It'd be kinda f'd up if you could copyright a concept. It's open to abuse, and does often get abused in countries where copyright can apply to concepts and characters.

What I mean is, if I have enough money, and want to remove someone's commentary or critique of of my work from someone else that used even if a tiny portion of my work, all I would have to do is say that I would have done it myself in order to draw attention to it (via drama) and voilá, nobody will be able to critique my work because I can do whatever with my work and someone else did some whatever thing that I could have done just didn't do yet.

The legalese is that the creator has the right to exploit their creation to make money, and you don't have that right. Actually, blocking people from critiquing your work is censoring and gets into free speech problems (in the US). And while the law won't do anything about it unless someone with enough willpower and money sues you, you'll sure as heck get internet people breathing down your neck about "this person takes down anything bad that is said about them."

You don't need to be big to enroll for content ID, you just have to have 100% original content. I know some companies like Valve have policies where you can legally use their stuff no problem, but UA-cam's staff won't care. Plus you can still remove a video that was stolen without content ID. I've done it once with this parody of mega evolution in pokemon (the obvious digimon joke) using footage from an offical trailer. Then again, it might just be that the guy took it down himself when I yelled at him... but really UA-cam doesn't actually review copyright claims so it probably doesn't even matter who you are as long as you uploaded the video to your channel first.

I am learning adobe flash cc and I am not good at all. I am good at Cinema 4d 3d animation though. I also cant draw what so ever..... I've posted several pieces of music that I didn't add anything to and were just copyrighted pieces of music and I haven't gotten caught yet. Mostly because I use audacity to turn them into mumbled pieces of terrifying garbage that people would only think were from 20 year old indie horror games.
This is a good video, (as my being a furry fan) this goes back to 2004. I met MaxBlackRabbit at Anthrocon who had a character I liked. I pulled Max aside and asked him politely if I could use his character ZigZag in a story that wasn't porn involved, and wanted his permission face to face. He was pleasantly surprised and said sure. I met Max a year or 2 later and he remembered me and asked how my stories was going. I said things were fine, but He also said he remembered me because I was polite and up-front with him. ^^ (And my being Canadian as well as he was helped too I bet... ) ^^ The point I'm making here, is always be polite when asking. Sure the stories were finished, but I never had them published. I might make a web comic or small animation later. And when that happens, i'm sure his (MBR's) permission still stands. Doubtful. They also look a little like Starfy, and Kirby's Warp Star. Some concepts (such as the shape of a star) are too generic to copyright or trademark.
Even with like original or free music, companies will still go "Nah that sounds too close to X" and take out down or they'll just take it down for the plain reason of they can.

There actually was a case on fair use regarding reaction videos, the channel H3H3 was sued if their reaction video was fair use and the judge ruled in their favor, so now there is case law regarding that. I'm not sure about Let's Plays though.

That way if it does get deleted it's no great loss.
Maybe think of a way to change your idea so it's more "fair," or so that it's all your own original creation.

QUESTION: At 4:28 the line "or something that the creator could do with its creation"; well, the creator can do ANYTHING with its creation, so, how can ANYTHING fall into fair use using that argument?
What I mean is, if I have enough money, and want to remove someone's commentary or critique of of my work from someone else that used even if a tiny portion of my work, all I would have to do is say that I would have done it myself in order to draw attention to it (via drama) and voilá, nobody will be able to critique my work because I can do whatever with my work and someone else did some whatever thing that I could have done just didn't do yet.
+TemporalOnline When I say that, it's about them taking their creation and using it to make merchandise or spin off series' or whatever. The legalese is that the creator has the right to exploit their creation to make money, and you don't have that right.
The copyright owner couldn't respond with, "Oh, I could have critiqued my own work," because that's pretty silly. Actually, blocking people from critiquing your work is censoring and gets into free speech problems (in the US). And while the law won't do anything about it unless someone with enough willpower and money sues you, you'll sure as heck get internet people breathing down your neck about "this person takes down anything bad that is said about them."
I understand what you said and I also think it is silly, I agree with you 100%, but if this is the legal argument someone has to pass through, in a place were corporations are people, and money is speech, in my mind any stretch, no matter how far-fetched, can, will, and has possibility of being won in court.

You don't need to be big to enroll for content ID, you just have to have 100% original content. I know some companies like Valve have policies where you can legally use their stuff no problem, but UA-cam's staff won't care.
Plus you can still remove a video that was stolen without content ID. I've done it once with this parody of mega evolution in pokemon (the obvious digimon joke) using footage from an offical trailer. Then again, it might just be that the guy took it down himself when I yelled at him... but really UA-cam doesn't actually review copyright claims so it probably doesn't even matter who you are as long as you uploaded the video to your channel first.

I am thinking of buying a 60 dollar intous tablet off amazon though! My questions are How should I get better and who should I learn from? I've posted several pieces of music that I didn't add anything to and were just copyrighted pieces of music and I haven't gotten caught yet.
Mostly because I use audacity to turn them into mumbled pieces of terrifying garbage that people would only think were from 20 year old indie horror games.

This is a good video, (as my being a furry fan) this goes back to 2004. I met MaxBlackRabbit at Anthrocon who had a character I liked. I pulled Max aside and asked him politely if I could use his character ZigZag in a story that wasn't porn involved, and wanted his permission face to face.
He was pleasantly surprised and said sure. I met Max a year or 2 later and he remembered me and asked how my stories was going. I said things were fine, but He also said he remembered me because I was polite and up-front with him. ^^ (And my being Canadian as well as he was helped too I bet... ) ^^
The point I'm making here, is always be polite when asking. Sure the stories were finished, but I never had them published. I might make a web comic or small animation later. And when that happens, i'm sure his (MBR's) permission still stands.

Doubtful. They also look a little like Starfy, and Kirby's Warp Star.
Some concepts (such as the shape of a star) are too generic to copyright or trademark.

Even with like original or free music, companies will still go "Nah that sounds too close to X" and take out down or they'll just take it down for the plain reason of they can.

The most ridiculous thing a company could do is, to give an option to upload recorded videos to UA-cam, and claim those videos.

Also I'm getting my own animating "thing" that comes with a stylus for my birthday (March 20!) so I can do my dream cartoon I've been wanting to do for so long (*_*) (I said thing because I don't know what that may be) And also I've made stories about my characters 😀 but I need animation tutorials because I didn't start animating yet.... 😳 But I just need that practice and I have serious passion to make my characters that I worked on for all this time now into an animated cartoon!! >:3 Even if it takes like, some years to practice. Also I need to practice drawing my characters and adding more characters I wanna fit into the series because there are some characters that are the main focuses but I need more >:3 (Gonna have to create) And also I have these books I've written to back me up. :3

There actually was a case on fair use regarding reaction videos, the channel H3H3 was sued if their reaction video was fair use and the judge ruled in their favor, so now there is case law regarding that. I'm not sure about Let's Plays though.
