  • The Bharatiya Nagarik Suraksha Sanhita (BNSS) is a law that aims to modernize India's criminal justice system. The BNSS was passed by the President of India on December 25, 2023, and will come into effect on July 1, 2024. The BNSS will replace the Criminal Procedure Code (CrPC) of 1973.
    The BNSS aims to improve the justice system by:
    Streamlining procedures
    The BNSS will use technology for investigations and legal procedures, and set timelines for investigations, trials, and judgments.
    Improving victim participation
    The BNSS will require FIR copies and investigation updates to be provided digitally and will ensure victim hearings in serious cases.
    Making the system more accessible
    The BNSS will introduce mandatory summary trials for minor offenses and streamline the magisterial system.
    Improving the use of forensics
    The BNSS will mandate forensic investigations for offenses punishable with seven years or more in prison.
    Making the system more efficient
    The BNSS will allow electronic communication for legal procedures and will allow the production of electronic devices for investigation.
    Making it more difficult for the accused to secure bail
    Limiting the scope for plea bargaining
    Giving police the discretion to seize and attach the property of an accused before a trial
    Mandating a preliminary inquiry by the police before an FIR can be lodged for certain offenses
