  • When we hire employees, they are normally on put on a 6-month probationary period. But sometimes, we disregard and don't put much importance on the probationary contract.
    According to Atty. Vic Mariano, Managing Partner of Mariano & Partners Law Office, if you are not clear on the status of the employment upon hiring, such that you don't have a contract at all, the law assumes that the employee is a REGULAR EMPLOYEE right from the start!
    This is something that we all should be careful about.

    Sir Ako ay nagtratrabaho bilang Isang constraction n hired po ako Nung nov7 2015 pero hanggang ngayn september2024 probationary parin .. Ang complain k po ay binigyan kmi ng kompanya ng notice n 30days nlng daw kmi KC tapos n po Ang area o Lugar n pinagtratrabahuan nmin .binigyan nrin po kmi ng COE para mk pag apply s iba at binalik n nila mga requirements nmin. Ano p pwdng ikaso s company. Salamat po

    Paano Kung matapos ko Po Yun 6 month probation at gusto nila ako gawin regular pero umayaw na ako pwede ba ang ganun Kung sakali.

    Ask ko Lang po isang araw na Lang mareregular ka na bigla Kang extend sabhin sau mababa evaluation mo sa kumpanya pumayag all para diretso Lang trabaho ung malapit na ulit isang buwan Ganon ulit extend na nman tapos malapit na ulit mag isang buwan isang araw na Lang saka ka tatanggalin .Tama po ba un di pa akp makokonsider na regular khit lumagpas nako anim na buwan sa pamamagitan ng extension na isang buwan pa Bali seven months po nako problem dahil sa extend

    sir im a courier of shopee ng lapse na ung contrata ng 6 months halimbawa sa feb 25 ayaw kami sagutin ng agency kung mareregular kami oh hindi matagal masxado ang pangko nila incentives at sabi nila mgresign kmi kung ayaw namin sa pantakaran nila paano poh gagawin namin

    Paano yung nka pirma ako sa contract good for 6 months under ng probationary ,pero di nmn ako nakaabot ng 6 months kasi nga force resgnation yung employer tintatrbho dahil lang sa performance ko ? yun dao sabi ng agency ko ano po ba yun ?? my right po ba ako ?

    What if po iniextend yung probationary for another 15days dahil di daw counted nung naquarantine siya nung nagpositive siya sa covid.. While yung batchmate niya naregular agad pero same lang din silang positive patient napaka-unfair lang po kasi, yung another 15days po ba counted na yun para maprobi na siya or pwedeng hindi na?

    Atty. gud day po na terminate po ako dhil sa trust and confidence ngkaroon ako ng issue with my co employee dhil nagsinungalin dw po ako dpat po by january 4 tpos ko na po ung probitionary period ko pero tinerminate nla ko by dec 28 withs is ilan days nlng po meron po ba ko habol sa labor in case na lumapit ako sa knla

    Pano po if during my first month of prabation (I meant month is not over yet, naterminate ako dahil sa poor evaluation tapos on that very same day na pinatawag ako while on duty, agad2 akong pinauwi dahil terminated na ako?

    Hi po, Ask ko lang po sir. If hindi na po ako papasok sa company na pinapapasukan ko ngayon.
    ito po kasi ang scenario (Nong September 1 po kasi sabi ng manager ko sa department namin na suspend daw po yong department namin for same reason, so hindi na po kami nya pinapasok tapos nong linggo po sir september 5 po nag chat sya sa amin na wala daw pong pasok ng dalawang linggo dahil may covid 19 cases sa company namin. tapos kahapon po September 13 nag sabi sya na pwede na daw pasok. Pag hindi po pa ako pumasok ng tuloy tuloy makakasuhan po ba ako ma'am? Probationary po kasi ako sir for 6 months nag start po ako nong April 26, 2021. mag eend po this October 26, 2021. sana po ma sagot.

    9 months na ako proby tapos i end na nila contract ko kasi bagsak performace, walang NTE, walang warning, walang performance review, walang papel na pinirmahan walang due process, tama ba yun?

    May tanong lang po ako,, what if kung nabuntis po yong employee tapos hindi na pinabalik, mahigit 2 years and 9 months na po siya tapos tatanggalin pa nila doon sa kanyang tinatrabahoan,pwedi po ba un??, tapos marami silang nabuntis sa companya nila mahigit apat(4), tapos sabi ng HR magbibigay sila ng Recignation Later para automatic hindi na sila employee sa companya,, may separation pay po ba sila,, pinaparesign po kasi sila ehh, hindi naman po sila na AWOL na BUNTIS lang,,

    Blessed and Safe day po ATTy.Vic Mariano, , Tanung ko po regarding po as probationary employment. Na hire po ako Nov.7 2019 with a probationary status. Mag end dapat and probationary ko this May 7 ,2020. Nag message po sakin nung May 4,2020 ang HR na extended po ang probationary ko po dalhil sa Covid 19. Nag message po uli ang HR nung May 27,2020 informing me na The management has decided to end your probationary employment effective June 1, 2020 Sir and I am attaching the letter in your email. May 29, 2020 nag labas po sila ng letter of Temporary Lay Off/ Retrenchment. Question #1 In my case po dapat ba ako automatic Regular employee even under circumstances like COVID 19? Question #2 If incase considering po na regular employee na po ako at nag declare ang company ng retrenchment, young separation pay ko po or computation will be the same with the Probitionary na terminate ang contract?
