I've seen the video, uncensored, and the seat was not locked. As soon as he fell, the seat lifted up and when it fell back from the pressure of the ride stopping, it locked down. The video is horrifying, the situation is horrifying and can not imagine what everyone who saw that is going through, especially his family. Rest in peace Tyre Sampson, you didn't deserve to die so young.
Very tough to watch :( but you can see he submarined right out of the restraint because he was too big to be on this ride in the first place. It's a crime that the operators allowed him to ride and he trusted them to know better.

Signs don't mean anything it was the ride operators responsibility to make sure all riders were secure and the restraints were in the proper position...not to mention tell that young man he was too large to be safe in that seat. I wonder if the locking mechanism of the harness gave out. Metal fatigue. Those things are locked/unlocked hundreds of times a day. Maybe 6 days a week. They are usually 3 inches wide. What are the forces they can take? Body weight slamming against them?

Those “operators” are children themselves with probably very minimal training and on minimum wage. We have to hold the company accountable for this mistake for both the negligence of proper training, system failure and the life lost
The park is responsible because the ride operators allowed him to ride when it could have been inferred that he was too large. As a supervisor in attractions for a major theme park company, it is 100% up to the ride operators to allow or deny a person ability to ride an attraction.

I’m so sorry for this family’s loss. I do believe it is not the responsibility of a 14 year old to know he couldn’t ride as most teenage kids only think about having fun not the risks involved. The fault goes with the staff’s negligence or inadequate training and/or the company having specify ride standards and providing proper training and limitations to follow. I do hope this case is an eye opener to the world that amusement rides are dangerous and the owners of these rides have responsibility to the public to make the ride safe at all times by 1st maintenance, test runs, having a back up safety like a seat belt, having specific rules on height, weight, and training staff adequately.
The ride operators job is to ensure rider safety. I'm too short and my lil feelings have been hurt over and over again but I'm still here.....hurt feelings and all. Very sad incident and my Prayers are with this Family during this very difficult time.
im a ride operator and i let people who were overweight and under the height limit on the rides all the time to make sure they have the most fun, none have ever died from falling.
Um if the seat was locked the park is still responsible. He still fell out, locked or not locked. If there was a malfunction with the harness then the guys that built the ride are responsible. Either way someone has to take the blame.
Yes. Park is 100% at fault. Whether locked or lights on they should be TRAINED to be aware of weight restrictions and should have seen the danger he was in by the way the harness was before beginning the ride.

@@sandib4234 Honestly from watching the video , the family member did imply that he was denied access to 2 other rides and was probably just excited that he was able to actually get on this ride with his friends. Even though he was scared he also really wanted to ride this ride and didn’t think too much of it because the employees didn’t say anything or tell him he was too big to ride like the other employees at the other rides did.
On the video, I noticed that he turned his head to his left to look at the crew member at least 3 times before ride went up. He knew it wasnt right but he didnt speak up, its very sad. Me has a kid I was shy to speak up when I felt something wasn't right and I belived that happen to him. Now has an adult I've gotten in rides when the bar doesnt go as tight as I want it to on my legs and I do speak up and tell the crew members.... They correct it and make everyone on the ride lift their arms again so they could do it once more. This is just very sad.

That frame at 1:59 tells the story. His body was too big for the harness to lockdown and after he flew out it simply snapped back and locked. I saw in another video the operator who was supposed to walk around the whole ride got hung up talking to some other riders never making it to the kid when the other operator started the ride. The kid probably did not know the seat tilts forward before dropping, he did not have a prayer of holding on.
I went out on a limb to say that the kid let him ride despite the weight limit because he was likely too intimidated to tell him he couldn’t ( he was a huge kid) so my thought is even if he did do that safety check, he wouldn’t have told him he couldn’t ride
How do we know the attendant didn’t check it ? We saw a video that was only suppose to be taking his friends. When checking the rides there is a certain route you take we didn’t see the whole process so we can’t assume it wasn’t done just like we can’t assume it was. We only saw part of the process. I could see if we saw from the point they were in line until they were seated to say he wasn’t properly checked. The green light was lit indicating LOCKED.
It wasn’t the harness. He must have slipped out of the seat. From the bottom. It’s not about the harness. Yes the harness was still locked. But it wasn’t all the way down like every one else’s. AND If u notice , the ride tilts forward. If u look at the video, it tilted back in place when the riders was asking to “let us off”! When it tilted forward, his weight pressed up against the harness. His rear end slipped out of the seat. That’s why it was still locked in place. He had too much play room under the harness. Gravity and the speed made him come up out the seat.
That’s exactly what happened , It was locked , there was just to much room , everyone else harnesses lock all the way down to there private area , the Boy had it all the way almost to his belly button, there was way to much room , the down force made him slip out

They mentioned in this video that there is board that the operators look at before the ride starts to see if all the harnesses are locked in. The board was all green, indicating everyone was locked in.

My heart hurts for this young man’s family. Whether this accident was due to basic park negligence or system failure (could have been a combo of both), a life was needlessly lost. A 14 year old kid and his family is now paying the price.

When I was at Silverwood one time my cousin who is also a big man went on the spincycle. The worker said he couldn't go on because the restraint didn't click enough. He was very embarrassed but I'm so glad they didn't let him go on. May Tyre rest on Paradise his family needs justice. How negligence of the workers to let him on. They shouldn't of and if the other people didn't let him how come for this ride they did.
at the end of the day, we want answers and WE ALL want JUSTICE. the ride seat was not locked. you can clearly see that it was not all the way down and there was a gap. it might have been locked when it came down because the force of the ride, it swung the seat shut. no one would be able to slip out if it was locked. The free fall tilts 30 degrees when it’s on the way to the top, so that means this 350 pound child weight was all up against the harness the entire time down, That tilt could’ve played apart in it too yet nun of the news are talking about that.
Experts at the trial will present all the evidence. Too early to tell now. But they already showed that the signal board showed all green lights before the ride started, which means all the harnesses were locked in place.

If it was locked after the fact, it had to have slammed locked after he fell out and when the ride stopped at the bottom, that’s the only way because I saw the video and it clearly wasn’t. His seat was the only one not lit up.

You can absolutely see that the harness isn't able to lock down completely on Tyre & he shouldn't have been allowed to ride. The harness being locked when the ride stopped means nothing, momentum alone could force it into a locked position. They need to change the law and enforce posting signage warning against height/ weight or other restrictions for the safety of patrons at these parks, including carnivals and fairs. Absolutely heartbreaking and tragic, this could've been avoided.
But there is a signal light board that tells the operators if a seat harness is not locked down. Did you watch this video? They said all the lights were green.

@@K-Z1 There is absolutely no way any employee could have guessed his weight correctly. A 14 years old kid is not supposed to weight that much, as long as the green light for the harness was on, the employees are authorized to begin the ride. If there was a sign with a weight limit warning, not seeing or ignoring the sign makes it entirely the user's responsibility, since they are the only ones responsible for knowing their own weight. In the other hand, if the security light is not working as intended, then it's the manufactures fault. But I don't see any skilled lawyer losing this case for the park in any court of the country.

@@almondkissed3794 Yep! Negligence plays a big roll here. He was simply too big for the chair and harness. Since as the harness was significantly higher than the others, it caused an opening by his lap. When they reached the top, the chairs actually tilted forward, and this is what caused the problem( it shifted him and forced all his weight onto the harness.) When they dropped and the air brakes engaged, the jerk caused Tyre to slip through the opening at the base of the harness and plunge to his death. The ride slowed down and Tyre kept going, hitting the ground at 75mph. And even though he fell from only halfway up, it was like he fell from the very top. He should have _,never_ been allowed on that ride. He was way too big! May he rest peacefully! 💚🕊️😢

It was locked. That doesn’t mean the park wasn’t at fault. They were negligent. He was too big for the ride because it couldn’t lock on him properly. It was locked but not far enough to secure him from slipping. The parents will get millions from this park for sure!
I think the fact it was locked shows that there is a serious issue with the ride design and they would be accountable for designating a harness position as safe and clear to take off when it clearly wasn't.

The saddest part of this all is the fact that this boy died probably absolutely terrified, feeling himself slip and seeing himself pivot towards the concrete, all because someone probably didn’t want to be accused of “fat shaming” for telling him he couldn’t ride a third ride, they probably felt bad for the kid. But when it comes to a clear decision of someone’s life and you’re putting them on something with that much force, you should most definitely be paying close attention to the machines regulations. The company is def responsible, sadly the young guys running the ride. And I’m sure they will feel the pain of that choice for years to come.

Yes his weight played a contributing factor in why the harness wasn't securely locked, but it was the ride operator that failed to do his job.

Even if he was a smaller size and the harness wasn't secured properly, no person would be able to hold on the bars at the speed while the ride was descending. I'm done going back and forth with you. If he didn't fit, he shouldn't have tried to make it look like that wasn't the case, but even still, he shouldn't have tried to get on the ride, and even still, he should have not gotten that big. All said and done, there is still other young lives here effected for life, his friends who were on the ride with him and those who worked there. Couldn't imagine those on the ground having this young man land not to far from them. This is something along with his friends see him fall to his death. When I first heard of this tragedy, I knew it was because he was to big for that ride. I myself have rode rides with harnesses that come over the shoulders and lock into place. Here is my opinion on the employees operating that ride, they should have walked around and checked every harness making sure it was locked into place. Clearly they did not do this, because they would have known his wasn't all the way secured and locked. Really praying for his family through this horrible tragedy.
It was locked, otherwise the ride wouldn't let the operators start it. It is just that the gap was so big between the seat and the harness, AND they were 30 degrees tilted, AND there was 4Gs of force (4 times gravity) that he was able to be forced through that small gap. It is sad that he was allowed to be on this ride, he doesn't look safe from the picture of him at the station 😢
I can’t imagine being on the other side of the ride and looking down watching that. Like when I got brought back down I’d be so scared like people screaming and everything I really hope he is resting in peace and God is with the family

This is the first ride I have seen that does not have a secondary restraint along with the shoulder harness. I worked as a ride operator at a Cedar Fair park, and every ride with a shoulder harness also had a latch that secured between the legs. This was a faulty design right from the start. The ride manufacturer has to bear some responsibility for this tragedy.
The girl whose friend taped the fall said exactly that “why doesn’t this have a seatbelt” as they were going up. I forgot what the blond operator said back to her.

The video shows all of the evidence. No need to investigate anything. The harness wasn’t locked. It was at his chest, when it should’ve been down towards his waist. The worker even YELLED at him when the ride was going up to "make sure his seat was locked" THEY KNEW. The fact that the light was off on his seat was a dead giveaway.
It was locked, just too high. He slipped out through the gap! I’ve been on a ride just like this. The error is the ride allegedly giving a green light, when the harness isn’t low enough.
Usually a limit posted is 80% of it's limit for safety I'm not sure if that applies to that ride or not 50 lbs over shouldn't have caused that terrible accident I'm so sorry for the young man and his family may God bless the family rest in peace young man
It’s definitely the fact that he wasn’t secured. The attendant saw and did nothing but yell at him-! “On the left” because he only checked the two in front of him. He should have hit the stop. It’s the red button we can see clear as day In the original video. That video is DAMNING evidence.

I believe the tilt is what caused it to go south as well. There was a huge gap in between his legs and abdomen. He was slipping through that. And that harness i believe wasnt made to hold all his weight.

The tilt is why he slipped out - it tilts when it’s up top and comes down very fast - plus his weight and the speed coming down - poor boy was probably hanging on for dear life. If it didn’t tilt I think he would have made it. RIP Tyree 🙏🏾
Wasn't just the tilt it was a combination...because if the harness was down there be no space to slip out.. & he didn't slip out at the top when it was tilt.. it was when the ride descended back & the brakes were applied that when it happened.. no matter how strong you aren't strong enough hold on from that force
Honestly he would have had to have been Sampson or Hercules to stop himself from falling against 2 G-Forces pulling at his approximately 350 pound weight. It's basically 2 times 350 pounds for an estimated 700 pounds pulling against him.
False…the ride never tilted and he wasn’t holding on.it stopped damn near the middle of the ride and the pressure from it stopping so fast made him fall.
honestly they should not reopen it at all and should completely tear it down. out of respect for the family and loss. if you are willing to pay to build it you should be willing to tear it down.

He weighed way too much to be allowed on that ride. Telling him he was too big and making him upset would have been better than costing him his young life. Employees should be taking weight and height limits seriously seeing as a lot of these accidents have happened due to children being too light, too small, too heavy, or too big. The ride operators looked young but if they’re working on dangerous rides they need to be educated enough. Condolences to the family and the people who had to witness something so traumatic.

There’s new released footage of him sitting in the ride before it took off and any sane person would think “hm that looks a little off”. The harness needed to be fully snapped down in order to properly hold someone of that size, therefore it’s no surprise that he slipped out. Most rides would see a person that size and tell them that they couldn’t ride, but since he had been rejected from other rides that night he was eager to finally have some fun. Unfortunately it was that “fun” that cost him his life.

It indeed was locked, but the ride tilts at a 30° angle as it comes down, which pushes his weight into the guard and as it stops with g force it slides him out from under as there was nothing between the legs

How was he supposed he was too big for the ride? He was a kid! Kids don’t think about anything like that, he was probably just thinking how fun? I am on spring break. I have a child that age and I know she would have been thinking this is going to be fun. I don’t allow her to get on some rides.

They let him on and didn’t hit the red stop when they noticed something was wrong. Another kid might be losing his life over this.. that kid only shouted at him.. never hit the stop. He wasn’t even there to let em off the ride. All of these news stations aren’t showing the kid yelling “on the left” likely because the park paid them off.

It was not a small gap. Look at Tyre sitting in his seat. The harness is stopped mid belly due to his size. Now add in the fact that the seats tilt forward at 30 degrees once at the top. So now his weight is all leaning forward onto the harness, and butt is sliding towards the front of the seat after tilt. The gap left in the harness, the weight shifting tilt , PLUS the immediate jolt caused by the brakes engaging during the descend all that combined with his weight resulted in him basically free falling. His body stayed in motion even when the seat/ride stopped. Imagine gravity just yanking him down by his feet for example and he falls right out of the seat because the harness is higher than it should be to be considered safe.....
There is NO excuse for these types of accidents in fairs and amusement parks. Lights or no indicator lights, there should always be a fail safe and at the very least it should be an operator checking every seat is locked and people are secure.
This is a case where responsibility will shift according to the smartest lawyer. If there was a weight limit for the ride, a scale should have been used to weigh every rider. This is a serious matter which could shut the park down.❤
Did no one notice that every light that is under each seat was on except for his as it was going up? That has to mean something. It’s haunting watching it go up being the only light not on knowing what’s coming.
I am appalled how simple this is. He’s too big for the ride. His weight is likely/possible to make the bar protrude too far out and he could easily slip out due to the bar being far out and unable to close down far enough to keep him in the ride. As someone who doesn’t like taking chances and is naturally paranoid, this was remarkably easy to avoid. It should be one of the first things these kiddos are looking for. Which is another thing, this ride appeared to run and operated by a bunch of kids even the supervisor who came over to ensure “they checked it.” You need an adult that has experience in life and has been around long enough to know death can happen in a second, it’s a serious thing.
So heart breaking, condolences to the family. Praying for the family, all who witnessed this tragedy and the worker too. Question: Do the worker's actually weigh rider's(on scales), before the ride or do they take the word of rider regarding how much they may weigh? Just asking, either way in this case, I believe the Park is negligent in this child's death. The child had no idea he was too heavy for the ride because he was approved and seated.( questionable, locked in properly) He trusted, that he would be safe on this ride. The only thing good that will come of this tragedy is this young man's life will make changes in how Parks operate from now on and make us aware of the hidden dangers that could befall us even when we think we are safe. No matter what size you are!
It's clear as day to me why he fell. Too tall, making him scoot forward pretty much sitting close to the edge of the seat to allow for the harness to come low enough to lock, which still isn't low enough because of the huge gap it allowed. Also his stomach area did not let it come down much lower without discomfort. The gap and him not sitting in a 90 degree angle were the causes because his hip only needed to thrust a bit forward while his stomach was being pulled down by gravity as g forces were developing creating a bigger gap due to the sudden decrease in speed during the lowering portion of the ride... That's why. He was too big and the harness locks too soon giving the employees a false sense of appropriate safety because it's enough to trigger the sensor/green light.
Agreed! But I also wonder why, if he knew he was going to fall out, why didn’t he hold on with all his strength, to try and stay in the chair?!?! Seatbelts should have been installed in the first place, coming down at that velocity is a negative g force, so when the ride stops/slows down, your body has to “catch” up to gravity!! Safety restraints should have been checked twice, even being 14, if he felt he was in danger, he should have gotten off the ride!! Even little things such as peer pressure can alter our decisions in situations like that. Maybe he was genuinely scared or in shock while he was starting to slip out. He also weighed about 340 lbs multiplied by all that downward momentum I can only imagine how heavy it would've been for his arms to allow him to hold on. I know right?.. It's crazy how even a strap from the middle of the seat attached to the bottom of the harness would have kept it from happening... He didn't even scream when he fell. I went on a ride just like this 2 years ago, and you can be damn sure I made sure my harness was tight and locked asf. We don’t play, I’ve heard about accidents on these drop towers. RIP man. I would’ve never went up with ANY slack on the harness.
For everyone wondering how he could've slipped out if his harness was locked, I saw a video where an expert (I believe it might have even been the one in this video) explained how it happened. That the seat was latched/locked but due to his size the gap at the bottom was too large. When they dropped, the negative G force essentially caused his belly to rise upward/everything "flattened" for that split second with the speed, enough for him to slip right out of that bottom gap. If he had been smaller, that bottom part of the harness would've been in between his legs (like it showed on the other passengers) and he wouldn't have slipped out. It is still negligence 100% because locked or not he was not at a proper weight to safely ride this ride. Also I want to apologize if I didn't explain this the best, but just trying my best to repeat what I heard the expert say. I'm so sad for this sweet boy.
I can already tell from the nature of this incident and the conversations already being had that there will be no justice in this case. It's going to boil down to the kid's weight and him being responsible for his own actions...especially if he was previously already turned down from two rides.

you are wrong. Yes the kid was partly at fault, true. But the ride has a 287 lb weight limit that was not being enforced and also the staff operating the ride should check each rider and evaluate if they are safe in the ride, which, if they had checked properly, they should have determined that he was not safe. Also the design of the harness is at fault, it did not have seat belts to secure the end of the harness to the seat. Typical designers and owners of the machine not caring about people's lives, only about their wallets.
I believe 1 or 2 things happened with the seatbelt to be locked. 1. He graved onto it when he fell and it locked or the ride caused it to lock after he fell.
I seen another video interview with someone at Funtime the company that built the ride and also the manual on how the ride operates. There was a problem with the ride. The contour of the seat and the shoulder restraint look a person in where they can't come out unless they are too small which wasn't the case. The ride will not start if the shoulder restraint is now down in place. The ride operators are to make sure the person is seated into the contour of the seat properly. FunTime claims that if someone fits in the seat properly they can ride. The shoulder restrain is held down buy hydraulic cylinders that are supposed to be tested every 15 days to see if they are holding. The cylinders look like they failed to hold under the extra weight of this football player that was still able to fit in the seat properly because he most likely had a lot of muscle instead of fat. I didn't see any other system in place to hold that shoulder restraint down in place than the hydraulics. Bottom line is the ride won't allow it to operate unless the shoulder restraint is down where it should be. Either the system that detects the shoulder restraint being down in place or the restraint failed.

Ride max weight is 287 lbs and the boy's dad says he weighs 340 so the shoulder/ torso harness could not close down far enough to be able to prevent someone from slipping out the seat. Yeah "the seat was still locked" however locked down far enough and traveling 75 mph then stopping on a dime will produce alot of G-force on a 340 lb body so no wonder he slid out that seat. The park and it's owners will be sued, and if they aren't sued then somethings really wrong. Also they keep mentioning that the ride has a safety function where can't be started unless all seats are in the locked position however those are basically dummy lights and don't actually show if each shoulder harness is Locked Down Enough to close the gap and keep the rider from sliding out the seat.*
I’m waiting on them to speak with the young man that was next to him. I guess that was his friend. If anybody knows the details of what happened up there it would be him. If Tyre told him to tell his parents he loved them because he knew he wasn’t going to make it down (his dad said this in an interview) I’m sure Tyre probably was telling him others things as well on the way up. This is so devastating. I’ve been thinking about this since it happened.
All amusement park need to have all limitations written. They must be enforced. The young man weight was over the ride limitation.. The young man life was loss because the park failed to disclose the ride limitation.. Now they are talking he was to heavy to be on the ride..They should've told him that while he was alive. That harness was probably open when he fell and then when the ride went back up the harness locked after he fell out. Even if it was locked, the staff shouldn't have let him get on the ride!
I came completely out of the Viking boat ride that swings back and forth when it hit the top height. I came completely out as it was going down and my feet caught the safety bar and I dropped back down in my seat. I’m not that small and don’t scare easy I’ve bridge and cliff jumped off 60-100 foot bridges and cliffs and sky dived. I was terrified and was screaming stop the ride. I’m not super small as far as rides go either.

I’m so sorry for this family’s loss. I do believe it is not the responsibility of a 14 year old to know he couldn’t ride as most teenage kids only think about having fun not the risks involved. The fault goes with the staff’s negligence or inadequate training and/or the company having specify ride standards and providing proper training and limitations to follow. I do hope this case is an eye opener to the world that amusement rides are dangerous and the owners of these rides have responsibility to the public to make the ride safe at all times by 1st maintenance, test runs, having a back up safety like a seat belt, having specific rules on height, weight, and training staff adequately.

im a ride operator and i let people who were overweight and under the height limit on the rides all the time to make sure they have the most fun, none have ever died from falling.

Um if the seat was locked the park is still responsible. He still fell out, locked or not locked. If there was a malfunction with the harness then the guys that built the ride are responsible. Either way someone has to take the blame.
Yes. Park is 100% at fault. Whether locked or lights on they should be TRAINED to be aware of weight restrictions and should have seen the danger he was in by the way the harness was before beginning the ride.

@@sandib4234 Honestly from watching the video , the family member did imply that he was denied access to 2 other rides and was probably just excited that he was able to actually get on this ride with his friends. Even though he was scared he also really wanted to ride this ride and didn’t think too much of it because the employees didn’t say anything or tell him he was too big to ride like the other employees at the other rides did.
On the video, I noticed that he turned his head to his left to look at the crew member at least 3 times before ride went up. He knew it wasnt right but he didnt speak up, its very sad. Me has a kid I was shy to speak up when I felt something wasn't right and I belived that happen to him. Now has an adult I've gotten in rides when the bar doesnt go as tight as I want it to on my legs and I do speak up and tell the crew members.... They correct it and make everyone on the ride lift their arms again so they could do it once more. This is just very sad.

That frame at 1:59 tells the story. His body was too big for the harness to lockdown and after he flew out it simply snapped back and locked. I saw in another video the operator who was supposed to walk around the whole ride got hung up talking to some other riders never making it to the kid when the other operator started the ride. The kid probably did not know the seat tilts forward before dropping, he did not have a prayer of holding on.

How do we know the attendant didn’t check it ? We saw a video that was only suppose to be taking his friends. When checking the rides there is a certain route you take we didn’t see the whole process so we can’t assume it wasn’t done just like we can’t assume it was. We only saw part of the process. I could see if we saw from the point they were in line until they were seated to say he wasn’t properly checked. The green light was lit indicating LOCKED.

It wasn’t the harness. He must have slipped out of the seat. From the bottom. It’s not about the harness. Yes the harness was still locked. But it wasn’t all the way down like every one else’s. AND If u notice , the ride tilts forward. If u look at the video, it tilted back in place when the riders was asking to “let us off”! When it tilted forward, his weight pressed up against the harness. His rear end slipped out of the seat. That’s why it was still locked in place. He had too much play room under the harness. Gravity and the speed made him come up out the seat.

They mentioned in this video that there is board that the operators look at before the ride starts to see if all the harnesses are locked in. The board was all green, indicating everyone was locked in.

When I was at Silverwood one time my cousin who is also a big man went on the spincycle. The worker said he couldn't go on because the restraint didn't click enough. He was very embarrassed but I'm so glad they didn't let him go on. May Tyre rest on Paradise his family needs justice. How negligence of the workers to let him on. You can absolutely see that the harness isn't able to lock down completely on Tyre & he shouldn't have been allowed to ride. The harness being locked when the ride stopped means nothing, momentum alone could force it into a locked position. They need to change the law and enforce posting signage warning against height/ weight or other restrictions for the safety of patrons at these parks, including carnivals and fairs. Absolutely heartbreaking and tragic, this could've been avoided.

@@K-Z1 There is absolutely no way any employee could have guessed his weight correctly. A 14 years old kid is not supposed to weight that much, as long as the green light for the harness was on, the employees are authorized to begin the ride.
If there was a sign with a weight limit warning, not seeing or ignoring the sign makes it entirely the user's responsibility, since they are the only ones responsible for knowing their own weight.
In the other hand, if the security light is not working as intended, then it's the manufactures fault. But I don't see any skilled lawyer losing this case for the park in any court of the country.

Since as the harness was significantly higher than the others, it caused an opening by his lap. When they reached the top, the chairs actually tilted forward, and this is what caused the problem( it shifted him and forced all his weight onto the harness.) When they dropped and the air brakes engaged, the jerk caused Tyre to slip through the opening at the base of the harness and plunge to his death. The ride slowed down and Tyre kept going, hitting the ground at 75mph. And even though he fell from only halfway up, it was like he fell from the very top. He should have _,never_ been allowed on that ride. He was way too big! May he rest peacefully!

The saddest part of this all is the fact that this boy died probably absolutely terrified, feeling himself slip and seeing himself pivot towards the concrete, all because someone probably didn’t want to be accused of “fat shaming” for telling him he couldn’t ride a third ride, they probably felt bad for the kid. But when it comes to a clear decision of someone’s life and you’re putting them on something with that much force, you should most definitely be paying close attention to the machines regulations. The company is def responsible, sadly the young guys running the ride. And I’m sure they will feel the pain of that choice for years to come.

Yes his weight played a contributing factor in why the harness wasn't securely locked, but it was the ride operator that failed to do his job.

All said and done, there is still other young lives here effected for life, his friends who were on the ride with him and those who worked there. Couldn't imagine those on the ground having this young man land not to far from them. This is something along with his friends see him fall to his death. When I first heard of this tragedy, I knew it was because he was to big for that ride. I myself have rode rides with harnesses that come over the shoulders and lock into place. Here is my opinion on the employees operating that ride, they should have walked around and checked every harness making sure it was locked into place. Clearly they did not do this, because they would have known his wasn't all the way secured and locked. Really praying for his family through this horrible tragedy.

It is just that the gap was so big between the seat and the harness, AND they were 30 degrees tilted, AND there was 4Gs of force (4 times gravity) that he was able to be forced through that small gap. It is sad that he was allowed to be on this ride, he doesn't look safe from the picture of him at the station 😢

This is the first ride I have seen that does not have a secondary restraint along with the shoulder harness. I worked as a ride operator at a Cedar Fair park, and every ride with a shoulder harness also had a latch that secured between the legs. This was a faulty design right from the start. The ride manufacturer has to bear some responsibility for this tragedy.

The worker even YELLED at him when the ride was going up to "make sure his seat was locked" THEY KNEW. The fact that the light was off on his seat was a dead giveaway.

I believe the tilt is what caused it to go south as well. There was a huge gap in between his legs and abdomen. He was slipping through that. And that harness i believe wasnt made to hold all his weight.

Clear case of negligence from this amusement park. Tragic. The family of this kid can easily win a lawsuit for wrongful death.
He weighed way too much to be allowed on that ride. Telling him he was too big and making him upset would have been better than costing him his young life. There’s new released footage of him sitting in the ride before it took off and any sane person would think “hm that looks a little off”. The harness needed to be fully snapped down in order to properly hold someone of that size, therefore it’s no surprise that he slipped out. Most rides would see a person that size and tell them that they couldn’t ride, but since he had been rejected from other rides that night he was eager to finally have some fun. Unfortunately it was that “fun” that cost him his life.

They let him on and didn’t hit the red stop when they noticed something was wrong. Another kid might be losing his life over this.. that kid only shouted at him.. never hit the stop. He wasn’t even there to let em off the ride. All of these news stations aren’t showing the kid yelling “on the left” likely because the park paid them off.
The attendant was on drugs or drinking- you can tell because of how he loses his train of thought near instantly. They need to drug test that kid ASAP if they want justice.

It was not a small gap. Look at Tyre sitting in his seat. The harness is stopped mid belly due to his size. Now add in the fact that the seats tilt forward at 30 degrees once at the top. So now his weight is all leaning forward onto the harness, and butt is sliding towards the front of the seat after tilt. The gap left in the harness, the weight shifting tilt , PLUS the immediate jolt caused by the brakes engaging during the descend all that combined with his weight resulted in him basically free falling. His body stayed in motion even when the seat/ride stopped.
Imagine gravity just yanking him down by his feet for example and he falls right out of the seat because the harness is higher than it should be to be considered safe.....

There is NO excuse for these types of accidents in fairs and amusement parks.
Lights or no indicator lights, there should always be a fail safe and at the very least it should be an operator checking every seat is locked and people are secure.

I am appalled how simple this is. He’s too big for the ride. His weight is likely/possible to make the bar protrude too far out and he could easily slip out due to the bar being far out and unable to close down far enough to keep him in the ride. As someone who doesn’t like taking chances and is naturally paranoid, this was remarkably easy to avoid. It should be one of the first things these kiddos are looking for. Which is another thing, this ride appeared to run and operated by a bunch of kids even the supervisor who came over to ensure “they checked it.” You need an adult that has experience in life and has been around long enough to know death can happen in a second, it’s a serious thing.

Question: Do the worker's actually weigh rider's(on scales), before the ride or do they take the word of rider regarding how much they may weigh? Just asking, either way in this case, I believe the Park is negligent in this child's death. The child had no idea he was too heavy for the ride because he was approved and seated.( questionable, locked in properly) He trusted, that he would be safe on this ride. The only thing good that will come of this tragedy is this young man's life will make changes in how Parks operate from now on and make us aware of the hidden dangers that could befall us even when we think we are safe. It's clear as day to me why he fell. Too tall, making him scoot forward pretty much sitting close to the edge of the seat to allow for the harness to come low enough to lock, which still isn't low enough because of the huge gap it allowed. Also his stomach area did not let it come down much lower without discomfort.
The gap and him not sitting in a 90 degree angle were the causes because his hip only needed to thrust a bit forward while his stomach was being pulled down by gravity as g forces were developing creating a bigger gap due to the sudden decrease in speed during the lowering portion of the ride... That's why.
He was too big and the harness locks too soon giving the employees a false sense of appropriate safety because it's enough to trigger the sensor/green light.

Even little things such as peer pressure can alter our decisions in situations like that. Maybe he was genuinely scared or in shock while he was starting to slip out. I know right?.. It's crazy how even a strap from the middle of the seat attached to the bottom of the harness would have kept it from happening... He didn't even scream when he fell. He seemed to have gone unconscious right away after landing so hopefully he didn't suffer. 😔

@@brittanyselear8015 from what I heard, they said the ride goes down at 75 mph, so it would be really hard to hang on. And his friends said that he was scared when he was on the ride, he said " if something happens tell my parents i love them". So he must have known something was wrong.
He looks a lot older because of his size but he was just a 14 year old kid. This is so sad.
I’ve never seen the video of Tyre alive on the ride until just now. My heart breaks for the family.

If they look at the photo before he went up, they'd very clearly see why he fell out. It's a shame that they're trying to lie their way out of responsibility

This is not making any sense I pretty much assume that it was due to the weight issue of the ride I remember about six years ago before I lost weight I remember going to a fair and I wanted to get on the ride and the gentleman said I was over the weight limit to get on at that time I was embarrassed but now looking at this story I appreciate him embarrassing me and let me know that I shouldn't have got on it just as well as these employees I'm going to call them untrained employees they let him get on that ride knowing he had no business on it who cares about hurting anybody's feelings these days I think we all whether him be breathing and still alive then his feelings being hurt this place definitely needs to be closed down cuz if you continue to have unskilled untrained employees on these rides they are going to continue to let people they should not even be on these rides to get on them because they are afraid to hurt their feelings so what it could have saved the life but it didn't you guys were scrambling like y'all was scrambling eggs and when the ride ended you even asked I thought you checked to see but did you check the belt how about why didn't y'all double check before it went up knowing that this ride went up as far as it did and drop at that amount of speed everybody needs to be charged and this Orlando ride needs to be sued
I went on a ride just like this 2 years ago, and you can be damn sure I made sure my harness was tight and locked asf. We don’t play, I’ve heard about accidents on these drop towers. RIP man. I would’ve never went up with ANY slack on the harness.
For everyone wondering how he could've slipped out if his harness was locked, I saw a video where an expert (I believe it might have even been the one in this video) explained how it happened. That the seat was latched/locked but due to his size the gap at the bottom was too large. When they dropped, the negative G force essentially caused his belly to rise upward/everything "flattened" for that split second with the speed, enough for him to slip right out of that bottom gap. If he had been smaller, that bottom part of the harness would've been in between his legs (like it showed on the other passengers) and he wouldn't have slipped out. It is still negligence 100% because locked or not he was not at a proper weight to safely ride this ride. Also I want to apologize if I didn't explain this the best, but just trying my best to repeat what I heard the expert say. I'm so sad for this sweet boy.
I can already tell from the nature of this incident and the conversations already being had that there will be no justice in this case. It's going to boil down to the kid's weight and him being responsible for his own actions...especially if he was previously already turned down from two rides.

you are wrong. Yes the kid was partly at fault, true. But the ride has a 287 lb weight limit that was not being enforced and also the staff operating the ride should check each rider and evaluate if they are safe in the ride, which, if they had checked properly, they should have determined that he was not safe. Also the design of the harness is at fault, it did not have seat belts to secure the end of the harness to the seat. Typical designers and owners of the machine not caring about people's lives, only about their wallets.
This is such a tragedy. I pray for his family I cannot imagine.
I believe 1 or 2 things happened with the seatbelt to be locked. 1. He graved onto it when he fell and it locked or the ride caused it to lock after he fell.
Well those are the only two things that CAN happen .

I seen another video interview with someone at Funtime the company that built the ride and also the manual on how the ride operates. There was a problem with the ride. The contour of the seat and the shoulder restraint look a person in where they can't come out unless they are too small which wasn't the case. The ride will not start if the shoulder restraint is now down in place. The ride operators are to make sure the person is seated into the contour of the seat properly. FunTime claims that if someone fits in the seat properly they can ride. The shoulder restrain is held down buy hydraulic cylinders that are supposed to be tested every 15 days to see if they are holding. The cylinders look like they failed to hold under the extra weight of this football player that was still able to fit in the seat properly because he most likely had a lot of muscle instead of fat. I didn't see any other system in place to hold that shoulder restraint down in place than the hydraulics. Bottom line is the ride won't allow it to operate unless the shoulder restraint is down where it should be. Either the system that detects the shoulder restraint being down in place or the restraint failed.

*That boy was too heavy and too big to be allowed on this ride. Ride max weight is 287 lbs and the boy's dad says he weighs 340 so the shoulder/ torso harness could not close down far enough to be able to prevent someone from slipping out the seat. Yeah "the seat was still locked" however locked down far enough and traveling 75 mph then stopping on a dime will produce alot of G-force on a 340 lb body so no wonder he slid out that seat. The park and it's owners will be sued, and if they aren't sued then somethings really wrong. Also they keep mentioning that the ride has a safety function where can't be started unless all seats are in the locked position however those are basically dummy lights and don't actually show if each shoulder harness is Locked Down Enough to close the gap and keep the rider from sliding out the seat.*
I’m waiting on them to speak with the young man that was next to him. I guess that was his friend. If anybody knows the details of what happened up there it would be him. If Tyre told him to tell his parents he loved them because he knew he wasn’t going to make it down (his dad said this in an interview) I’m sure Tyre probably was telling him others things as well on the way up. This is so devastating. I’ve been thinking about this since it happened.

All amusement park need to have all limitations written. They must be enforced. The young man weight was over the ride limitation.. The young man life was loss because the park failed to disclose the ride limitation.. Now they are talking he was to heavy to be on the ride..They should've told him that while he was alive. The park failed this young man, he would be still alive if the weight limitation was posted and enforced. This is heart wrenching because his death didn't have to happen. My prayers goes out to his family. He was only 14 teen.Gone to soon.

That harness was probably open when he fell and then when the ride went back up the harness locked after he fell out. Even if it was locked, the staff shouldn't have let him get on the ride!
I came completely out of the Viking boat ride that swings back and forth when it hit the top height. I came completely out as it was going down and my feet caught the safety bar and I dropped back down in my seat. I’m not that small and don’t scare easy I’ve bridge and cliff jumped off 60-100 foot bridges and cliffs and sky dived. I was terrified and was screaming stop the ride. I’m not super small as far as rides go either.
