Yeah, it sounds so stupid when written down. What a waste of Police time and resources, all on the say so of some gobshite from Capita. Like the man says, the fact that he was seen through the window, apparently watching sports on his TV proves nothing. Also, I believe the Capita bloke has broken the law by spying on the householder through the window. Better take a look at the TV licence related videos by the Black Belt Barrister.

Someone smashed into my practically brand new BMW where I had parked it. There was a CCTV camera pointing at that area so I called at the local police station which involved a special trip to get the necessary forms to request the CCTV footage. The forms were very lengthy and took me about an hour to complete. I sent it to the police with some photographs and after about three weeks I got some standard letter stating they didn’t have the resources to locate the relevant footage. It was so infuriating as they could have told me that before I spent time calling them, visiting the station and completing the forms. Amazing they have the resources for a tv licence that costs around £154 a year but not £4000 worth of damage to my car although I’m sure if I had been a celebrity or royalty they would have found the resources.

When I served with American forces in England I had no trouble getting video evidence any time someone falsely accused one of my servicepersons of a crime or incident (which was surprisingly often). I'd just phone them and send someone down. Theyd cue up the video, make a copy and provide it the same day, no paperwork, no muss, no fuss. We'd look at the video and it would always exonerate my troops from the bogus claims, usually made just because they were American and the citizens figured my troops hadnt any rights. So, believe me when I say they lied to you. They keep that video and have no trouble whatsoever finding relevent footage especially if you know the day and general timeframe of an incident.

I had a hit and run knock early last year on the Ring road of Manchester (im dyslexic and I didn't get their plate) happened around 6pm and i reported it around 7pm . got call next day to take a statement I described exactly where it happened. chased them up a few days later they told me they don't keep any camera footage after 24 hours so I had no chance (basically couldn't be bothered looking). 2 weeks later I get a call from my insurer saying I had a hit and run claim and injuries claim against me cause the little shits decided to try and claim after they thought they were in the clear, that i had hit them and run off. So I;ve spent the last year and half with an dealing with that and an extra £300 tacked on to my insurance.
At one point my insurer aske me to chase the police for a record of my call to the police. I chased the road traffic police who said yes but there would be a £35 admin fee, so I chased the regular police who did it for free..,

As an American I had to look up that Justice of the Peace bit. Apparently JPs, who are not required to attend law school or be certified, can issue warrants and try minor criminal and civil cases. Here, all of those things can only be done by judges who must be attorneys first and then be elected or appointed through a congressional hearing process. A much better system, I think.

Fiery Mongoose, a JP is usually known in the UK as a magistrate, who is a member of the public who is employed by the court system to reside over minor crimes, heard in the Magistrates court. The magistrate (JP) presiding can be from any position in life, even something like a street sweeper, and it is thought a person who is from any "walk of life" will use his life experiences to decide on a case. If the case is thought by the Magistrate to be serious it can be upgraded to the Crown Court, which is presided over by a qualified Judge.I doubt this would happen with a misdemeanor such as a breach of TV licensing. The issue of the warrant would be to allow entry to the property to determine if he had receiving equipment to watch TV, and nothing more. This would then be used as evidence in a future court hearing.

@@wojtekpolska1013this is not correct. It's worse.
They send letters repeatedly to anyone for whom they do not have a license registered at that address. Record of a TV purchase doesn't need to have anything to do with it.
There is no legal requirement to regularly report to TV Licensing that you don't use a TV or iPlayer. There is a requirement to report to the DVLA that your car is off the road for tax purposes, but NOT the equivalent for TV.
But they get round this by claiming they can't hold your claim you don't do anything requiring a TV licence, on file for longer than a certain time for data protection reasons (apparently). On that basis they justify restarting repeated hassling letters after a few years and thereby attempting to force you to either:
      - make a regular nul-return that's not required in law, or
      - put up with the restart of constant letters carefully crafted to be as legally threatening as possible and still get away with it in terms of insinuation of wrong-doing without evidence.

I spent the next day in hospital with a broken eye socket and concussion. When I called the cops no-one came to see me, the cop on the phone asked me if I saw the license plate of the other car, I didn't. He then checked on his computer while I was still on the phone, and discovered there was no county owned CCTV at the site of the incident. The investigation ended right there, on the phone. He said no point going any further, case closed. That was it! And yet they have all day to go after ppl for a TV license. Pathetic.

"This is a warrant, trust me, I am a police officer"
Oh how the mighty Great Britain has fallen. When you hear that line, it's time to get out of dodge

Trust me, I'm a police officer ! Don't make me puke. Repeatedly inviting himself into the house, telling the guy it is a warrant, but it isn't signed by a judge. These officers have no shame or respect for the law.

TBH the copper like many dont actually know the law where this is concerned, they actually think they are there to assist a private company ..... i must admit that its a bit much to expect any PC to know EVERY law but this particular law should be taught to PCs as its quite a common occurrance

Paul Desmond You are absolutely right. Even judges take time out during proceedings to study and interpret law.
If you truly wanted to be a law abiding citizen, start reading the statute books and 300 years later once you've read it all and up to date, you'll realise bending over backwards to comply with one law and you'll inadvertently end up breaking six others at best. At worst you're compliant, but well and truly screwed.

N don't forget while you're learning all those laws, they get changed constantly, new ones get added and they don't tell anybody. Then there's the laws that are technically laws, but no judge or law enforcement officer will ever actually enforce it.

Vee Eight Of course not all officers will know every law it would be stupid to assume or expect them to, but if an officer is called to do something or know a situation they will be put into in the near future you would expect them to read up on the matters at hand and know how to go about the situation would you not?

A householder gives implied consent for tradespersons and visitors to enter the curtilige if the property. There is nothing therefore wrong with someone looking in a ground floor window if is it freely visible from where a visitor would be.
The householder is free to put up signs asking that on one enters.
If he is further worried about privacy, pull the curtains.
No difference here with looking into the window of a car which is in the street etc
