They still could. But for all intents and purposes, the community decision is what brought Flameheart back. As far as the story is concerned, he's been back ever since then. He just hasn't shown up in-game.

But Flameheart is also mention very often as King, I dont think that when Flameheart is in command you have that much freedom. Pirates are very free when we think what the Piratelord allows.

Hopefully the skeleton crew will be tuned based on the crew size that owns it. Skeletons use to be pretty cracked until they got toned down. So hopefully if a solo manages to capture the Burning Blade then the A.I crew will make up for it.
