    In this video, I address comments received for manufacturing plushies based on a free crochet pattern by @crochetedbyel. I want to explain the context, my intentions, and the lessons I've learned from this experience.
    I hope this video helps clarify my actions and shows my genuine intention to learn and grow from this situation. Thank you for your understanding and support.

    When my daughter was sick and had to go to a hospital, they gave all the children a plush and gave one to their siblings. That being said, donating them to a children’s hospital would bring a lot of joy to a lot of children. It would definitely be something positive out of a negative 🥰

    Maybe contact the designer and see what they want you to do with them? Since it's their design I think they should have a say in what is done with them.

      ​@ellenacollinson4448 It's probably a good sign she hasn't heard back yet. Hopefully this means the designer is considering her answer carefully as opposed to answering quickly with clouded judgment. This is something that could effect the crochet community in very negative ways.

      I get it. I mean, still, bad you! But social media has really messed with our common sense. I'm an origami artist and the amount of tik toks out there showing people how to fold things without ever crediting the designer makes me want to scream. I see it in a lot of other areas as well (the lack of credit), so while it IS common sense, social media has made it really easy to forget or overlook it, especially if you're new. Hopefully the designer is taking her time to consider all angles of this situation before she gets back to you. After all, this doesn't just effect the two of you but the crochet community as a whole.

    It doesn’t take a rocket scientist to know that mass producing someone else’s design is morally wrong.
    That being said, it takes a lot of balls to make a video admitting you messed up. Is it damage control? Maybe but, it takes guts.
    What’s done is done…all you can do now is learn from the experience.

    I'd like to encourage you to donate the plushies. One option for donating the ducks would be to donate them to hospitals. My daughter was born with a congenital heart defect that required multiple surgeries when she was young. She really enjoyed and was comforted by the plush toys given to her (by the hospital through a charity donation program) during her stays in the hospital. They also gave plushies to my son which comforted him as well while seeing his sister go through this complex medical situation. I really think donating the plush ducks could bring a lot of comfort and joy to other hospitalized children and their siblings.

    Making a mistake sucks. Making a mistake publicly and having people call you out on it sucks. Making a mistake that cost you $1000 sucks. Admitting this mistake and learning from it? Good for you. I saw that other video yesterday, and it was well-spoken, and I'm glad that everything just became an open conversation and learning opportunity. I know some hospitals will accept stuffies for children that are ill. Maybe check with them?

    Not only credit the original designer of the pattern, but also ASK FOR PERMISSION to use their pattern . Not doing so, was the biggest misstep. Also, the duck did not become popular because of your concept of 'build a plushie'. It was popular in its own right BEFORE, you turned it into a build a plushie at your market.

    As a fellow creator it’s great to see you taking accountability for not crediting the original designer, Crochet by El. As I’m delighted to see your commitment to working on that moving forward. But it’s also really upsetting that you don’t really address the other huge issue, that you tried to mass produce your product without the original designer’s permission when so many small businesses are finding their creations mass produced on sites like SHEIN and Temu without their consent. I appreciate that you’re committing to doing better in the future and this is in no way meant to be rude or bullying. But as a creator, please try to understand how hurtful it can be for a designer to suddenly see their work commercialized not just without their consent, but having never been asked in the first place.

    Hind site is amazing but in all honesty if you hadn't been called out, you would have sold the plushies. No, maybe you didn't realise but you read the pattern intro and it clearly states, give credit to the designer. Call this Karma and learn from it.

      It's common sense in the crochet world to credit the designer of a pattern if you intend to sell or do something major with it. Smh common sense isn't so common anymore.

    Cat said in her video not to send any hate and that it should be about a discussion, but I also agree everyone has a right to their own opinion and some are passionate because they put themselves in the designers shoes. I think Cat did a great service by providing a lot of education in her video of why this was wrong and not just calling you out. I didn’t think about factories stealing that design and I’m sure will you feel awful if that happens. I hope the designer gets back to you so you can get some closure on what to do with the ducks.

    I know I'm suuuuper late to this video, but I want to start by saying I really appreciate the way you've taken the criticism and learned from it. It's so refreshing to see someone actually listen and grow instead of deflect.
    When it comes to selling plushies designed by other creators, I tend to safety-pin a tag with the name of the design, care instructions and fibre content, and the creator's name on my work, that way anyone who buys it knows that it isn't mine, but it doesn't seem too 'extra'. I hope this helps :)

    I think donating them would be great. There are so many options, children's hospital, homeless shelter, domestic violence center, church, or nursing home.
    Please do not throw them away when we have so many in need. 😊😊😊

    I get you learned a huge lesson and you can totally tell how bad you felt… and I didn’t see any “I’m sorry” in the video… it may go a long way. I get your young and your brain is still developing and you’re trying take responsibility. An “I’m sorry, Crochet by Elle” would do the job too.

    Everyone makes mistakes, but it takes a great person to own up to and take accountability for it, which you've done! I never even realized that you had used another creator's pattern, so I understand the frustration and confusion of others when it came down to manufacturing a plushie based off of someone else's crochet pattern. Nonetheless, thank you for crediting Crochet By El and opening this up as a conversation and learning experience!

    This is incredibly reassuring to see. It definitely comes across that it's something you just got swept up in in all the excitement and personally I don't feel there was any malice behind it. It must be hard reading a lot of negative comments, try and remember to take some big breaths and remember the comments of those supporting you through this.     I think this video is a great reminder to those new to the crochet community to give credit where credit is due. Cat Cake Crochet was very genuine in her video and no one had the right to “attack” you like they did. It was obviously a mistake, your video is fantastic and kudos to you for doing it. Facing criticism and hate isn’t easy. I do believe that you should send the ducks to the designer so she can do with them what she wants. I feel like that is the best way to make it right.

    I think this is a lovely apology video, young, and I totally understand how you made your decisions. I think you are very creative with sale ideas and will love to see how you apply it in the future as it will help me with mine, for example your build a duck was brilliant.     It is really hard taking criticism (even well earned criticism). Good job and nice apology! It’s hard to admit we are wrong and own up to it but we have all faced that type of situation to varying degrees at one point in our lives, so you aren’t alone. I agree with the other comments on here, you should ask the creator what to do with the already paid for ducks. Also, I get the humor helping in bad and stressful situations. It is definitely a coping mechanism.

    I’m going to be in the minority here, but it’s a duck with a hat and purse, there have been cute renditions of that forever. You can’t own an idea like that and it doesn’t seem like she has a trademark. Good on you for apologizing. These same people that are lambasting you better lose their minds anytime they see someone selling a baby yoda that isn’t Disney.

    I'm glad you made this video. I saw Cat Cakes' video, commented on it, and then noticed she linked to your response. I appreciate how you acknowledged your mistake without making excuses.
    Copyright can be tricky, especially in creative fields. From my experience with mascot making, I know clients can be very strict about sharing photos of our work. Even though this situation is on a smaller scale, the principles are the same. It’s easy to cross ethical lines, and I understand I might face similar risks without meaning to. I hope I’d handle it with the same respect. It’s a good reminder for all of us to respect intellectual property rights, whether they belong to big companies or small creators.

    Honestly, I appreciate you apologizing for not crediting the creator but I don’t think you should put the ducks that you purchased/mass produced out in the public at all. Put them in a box in your garage/attic and accept the loss. They shouldn’t have been created so they shouldn’t go out to the public even if free, just my opinion.

      How when the pattern isn’t trademarked? Like for example photographers make presets that others can use to edit their photos the exact same way as the original creator and most of the time make them free, if the person using the preset starts to get business because of the edits they don’t gripe over it soooo I’m confused lol

She’s mentioned before where she’s gotten the pattern and only started sayin “my ducks” when she started adding pizzazz with the accessories which again is perfectly legal because there was no patent or trademark. Plus it’s not like she has a factory or staff making them, she’s making them all herself 🤷🏾‍♀️

      @@SuperMilan14but she did contact a factory and have them produce them in bulk for her; that’s the major issue. Most patterns state that you can sell your items you’ve HANDmade from the pattern in small quantities, but copying the design itself and having it manufactured en masse is different.

    You’re young, you got revved up, mistake, yes but it’s done.
    I do markets and no I don’t identify designer but I do check pattern for permission to sell and have messaged a few to ask permission. One actually said sure, as long as you’re not mass producing by factory or staff. Just me, so she told me to tell her my socials and she’d send people my way because she just writes the patterns, doesn’t sell finished. So a lot of designers are very gracious and supportive.
    Just a note, that vendors also frown upon “made in China” factory made products as their competitors.
    Good for you for addressing this. You could have just shut off and carried on.
    I would either give them out with purchase at your shows or contact a seniors home, fire department or children’s aid. They all like to have comfort items to give to kids or seniors in distress. And sounds crass but as a business this is a charitable donation or waste write off on your taxes.
    Now you shake it off and move on. Stay enthusiastic and build from here. You’ve apologized and reached out, good for you.

    I am really glad that you took the constructive criticism and community debate as a point of reflection and ultimately learned from this situation. Watching your video and explanation, I don't believe you had any malicious intent with mass producing the plushies and appreciate your humbleness but I am relieved that you have decided not to sell them, as well as trying to open communication with the original designer. If Crochetedbyel doesn't get back to you, I think donating the ducks is probably the best way to go (without tags), but that is one opinion. As for market sales, I haven't sold crochet items before but I did sell a lot of sewn products in the past, some of which used other designer's patterns. I didn't credit the pattern on signage but all my handmade items had tags and I would credit the pattern designer there. I hope you are able to move forward on your crochet and small biz journey, a little wiser than before.

    With selling physical products from a pattern, most patterns will state if you can not sell finished items from it or not. If the pattern does not clearly state it, message the maker of the pattern. The worst that they could say is no. Also, if you make a youtube video showing the product; like stating if it sold or not sold, or that you made it, you can simply tag the creator in the description

    It’s a tough one. I’d prob suggest holding onto them until you get in touch with crochet by El. Give her the choice of what to do.
    If it was me, I’d allow you to sell the ones you have but not to make anymore. I’d also ask that you refrain from using my patten in the future

    The way they came about may have been wrong but at least you have taken accountability and a lot of people aren't mature enough to do that. I can see how you got caught up in the moment and your enthusiasm overrode common sense. I agree with the person that suggested donating them to a children's hospital. They are soooo adorable, just imagine the joy they would bring to a sick child! I feel like you have learned a valuable lesson so I wish you nothing but success going forward because I don't see that you are a malicious person, so you certainly do not deserve any backlash for making a mistake.

    I sort of think that a possible positive solution would be to put the designers name on the tag and give her a portion of the profits. That way it isnt a loss. I mean so long as she agrees.

    Always, always hire legal advice before you make something and will sell it for profit. It only costs $200-$300 for 30 min full of info that will save you hundreds of thousands and possibly legal action against you. You have. Cricut, I’m pretty sure you’ve seen the copyrighted images there. It’s not just something you write, it’s registered. And whoever does NOT register copyright for their designs (not patent, dear Lord) they CANNOT file a law suit in federal court. You will get over this and so will El.

    I am just starting to do markets, one of the things I have been drafting is a QR code that leads to like a google sheet with all the patterns I use and links to their OG source I am thinking about a cute sign like "I can make that myself" - yes you can! or something cheeky like that.
    As for not hearing back from Crochet by El, I imagine their DMs are also probably kind of overwhelming right now, so they may just not have seen or not quite be ready in how to respond.

    Aloha from Hawaii 🌴 We all make mistakes. And need to ask for grace. You're doing the right thing. You can donate to charities that service ill children. And also provide the plushies for there siblings too. Everyone in the family suffers too. Old folks homes too. Kindness goes along way. ALOHA!

    Thank you for owning up to your mistake. And don’t let this discourage you, you did the right thing and owned up to it. It shows integrity and will build your character as a person. I think you could’ve recognized it a bit sooner, but I can see how it might’ve been a confusing situation to handle. As for what to do with the manufactured ducks I think you should wait on the designer to decide what to do. And maybe try to create your own pattern for your “build your own plushie” station. It’s still a great idea. 😊

    The other issue I have besides mass producing somebody else’s design is that crochet can’t be mass produced. So is it not crochet? Or is it crochet that’s being produced from women in other countries being paid pennies?

    Honestly, good on you for trying to make it right. Cat Cake's video did initially shock me, but this is a very respectable response. Definitely look into donating them to a childrens hospital or maybe some group homes or shelters in your area.. there has to be something you can do with them that will make it right... good luck ❤

    It was morally wrong to take someone else’s creation and have it mass produced! That being said hopefully you learned a powerful lesson. Create your own pattern and then mass produce it! It’s her creation and her intellect rights that you took. Think of how she feels. The right thing would be to shut it down and move on . I pray you are blessed and have learned

      @@SuperMilan14 if you look it up 1 it takes a lot of money to patent or trademark something, 2 copyright laws on crochet say you may sell the finished product but you can’t resell the written pattern. and it’s more so being a decent human being to just ask for permission to sell it at least credit that person. no one should have to put a trademark on their stuff in this community 😒

    I personally think if you talk about a pattern on UA-cam than credit. Or you can say if you want any of the patterns I talk about comment below and I’ll drop it .
    As of markets it’s kinda being extra naming the every single pattern is too much. I have people come to my booth and ask me if it’s my pattern I just tell them they can look it up on your Etsy etc .
    I’ve also seen some creators have a google doc that they link
    You aren’t not obligated to share info about patterns unless in this case because you did obsess over a creators patterns due to good feed back.
    Maybe you thought there would be no repercussions because you are a small creator but I am glad you learned your lesson
    I hope to see you grow as a creator and im glad you owned your mistake

    It's isn't t just not crediting the creator the problem but crocheters have enough problems pricing their product with time and costs. Competing with a cheap chinese knock off is dumbing down the market.

    You made a mistake but learned alot. If the designer of the pattern isn't writing you back then she must not care what you do with the plushies you made. I would just give them away to kids who would appreciate them. That way your mistake can be turned into a good deed. I don't think you need to credit the designer, she never replied.
    Also don't worry about what people say about your awkward cutie way about you when you are nervous or uncomfortable. It's cute, I like it. Not everyone will like you for that but eventually you will find your people on here and they will love you for the things you do that make you who you are. So stay true to yourself and don't change to who you think you need to be on UA-cam. There are people on here that are so miserable in their life and it's their goal to make others more miserable then they are, try to ignore that the best you can and embrace the positive. ❤😊

    It's quite an easy mistake to make especially after the initial one. I'd say to contact the seller again and if not just donate them with no inspiration by. I have also designed patterns of my own. At least it didn't go too far after that and you have learnt from that mistake. As for the signs personally I was thinking of doing small cards with the pattern credits on them. But that's just my idea for if and when I do a market.

    I think you should defiently donate them to chairty. I think its an sweet idea. I personally think it would be wrong to give them out at your booth. I think thoses plushies will defiently make a bunch of kids happy.But this video really suprised me. When i learned about what happened i hadnt watched any of your videos.
    I generally though you decided to manarfacture them because there was nothing on the pattern saying you couldnt. Im glad this wasnt the case and i mis read the situtionBut your reaction was just so sweet and wholesome. It was an great apology video. Im subscribing i generally love your personality! :)

    Don’t be too hard on yourself, we all make mistakes maybe a few more when we are younger 😅 I’m 45 and still learning.
    Now go do something to take your mind off this as getting to wound up in it isn’t healthy. Put the Ducks to bed for the meantime. And decide what to do at a later date. When you feel more at peace with yourself ❤

    Great Video Ashley! It’s all a learning curve. I would give advise as a 62 year old woman, please do not use profanity, it’s a turn off for me as I enjoy all ages of designer videos, but usually will not continue watching or subscribe if continually used. Just a friendly mother’s advice. Well done!

    I had only heard about this from the video of the creator you mentioned. Shortly after I watched it you made this video. Props to you for taking accountability. If the designer was okay with you selling the ducks maybe they could get a cut of the sales. How you have handled this made me immediately subscribe.

    Im a new subscriber. I watched 2 videos about this issue before coming here. Making mistakes and learning from them is a good thing. You're taking accountability and humbling yourself... you deserve grace.
    I would hold on to them until I was able to get input from the original creator.

    You can gift the plushies to the church (as you said) or you can sell them and donate the profit. That way you can choose where to donate the money.
    So, you can get out of this without a loss but also won't profit of it.
    It would be very important to make all the finances available though so people trust you. Like how high are your costs and how much will you be able to donate from any duck that is sold. That is also a good way to atone to the community, showing that you are actually a honest person who really tries.
    Just another option with more work. But maybe also a good training for future projects.
    Also do get in contact with the pattern creator. When you do that they can decide for themeselves if they want to be part of getting a good home for the plushies.
    I also think it's a good idea to add QR Codes to patterns on booth's.
    Also very good for you for learning! Keep it up!

    I know everyone, especially creators, say you "have to" give them credit when in fact, you don't as long as you aren't claiming the design as your own. It is done as a courtesy. If you are doing something on social media where you are discussing what you made, then yes, you should list the pattern creators. At a market, no. That's getting carried away. You ran into an issue because you were using "my" and took it a step further by turning it into a plush. Now you know better so you can do better. Hang in there.

    Hello, ( This is long but I hope this helps with your concerns.) I watched Cat's video and now this one, But since you are asking for opinions, I think that you should definitely ask crochet by el, one more time on her opinion since hers is the most important in this situation. As for what to do with all of your product, I think that giving them away as a gift without any profit value would be nice, maybe like a giant secret santa instance, and it would never hurt in any situation to credit the original artist, whether you are posting a video ( which we should do, ) or giving it away as a gift( maybe with a card that has her credit). Now as for the market situation, In my own personal experience, I have actually asked a couple of crochet designers if I have to have a sign that clearly states that it is their pattern, many have said ( and I'm paraphrasing) that as long as someone asks 'where did I find the pattern or if it is my own,' that I need to give proper credit, which is just usually telling them by word of mouth, But if I post any type of social media content where their product appears, that I need to put credit in the video somewhere, or in the description. I hope this helps and I am glad that you made this video and are aware of the situation, and have tried to make amends.

    I know you said she didn't respond to you when you reached out before, but I would try to reach out to her again to ask what she thought you should do with the ducks. Maybe she's okay with them being donated. Maybe she'd like you to ship them to her so she can give them out as the creator of the pattern. Maybe she wants something else done with them. I would just try to consult her before you do anything. If she doesn't respond again, just do what you feel is right I guess.

    I did see the hate you got and I know all the creators who produced content told them not to so the people that did give hate was angering me. IMO you're still able to make mistakes! When I first saw your videos I totally thought the duck was your pattern btw. I was like wow what a cool command kept it pushing. I think you should give the ducks away as a gift with purchase at your markets. I know you learned from this. And I just want to know did you ever have a convo with El?

    We live and we learn! Definitely a little pricey but you admitted to it and willing to learn more 💜 I’ve never done markets so I’m not sure how all of that goes, but I did think of something cute if it is something you’d like to add. A binder (or probably something cuter lol) with each page including a pic of a plush you are selling + QR & creator’s name of the pattern! Like you said, if someone likes a plush and would like to crochet it, they’d be able to find it there 💕

    Could you sell some of them for charity and ask the designer of the pattern (maybe even give her a percentage of the sales)? Donating them is also a good idea! :)

      @@chicken5970 I was thinking about this but I’m still not sure if that is ethical. I asked if she would want any sort of compensation, but I’m not sure she wants to be involved in this at all (rightfully so😅). So I will probably end up donating them 😁

    You gained a subscriber, i understand you are only in your 20's and their are a lot of life lessons going to be thrown at you, but saying your sincerely sorry and will try to do better is all you can do. Yes that is enough!! I strongly do not agree with the choice you did but it shows good character in owing up to the mistake you made. Try not to let the "Haters" get to you. You are a "Good person" so move on and live your best life. You will loose some subscribers and but you will gain new subscribers like me.

    Well done on posting to admit that your actions were wrong. Many of us who grew up without the internet made mistakes that weren’t so public, so posting online is a big positive step.
    It is very easy to make assumptions etc about another person and their motives. Yes you were naive in your understanding of real world business. The point is to learn and ensure future behaviours are more ethical.
    With regard to the manufactured plushies, in my opinion it should be left entirely up to the original designer how these items are disposed of. Yes they cost you money which makes it a costly mistake. Ethically though in my opinion it would be wrong to dispose of without getting the designers input, and if donated they should be done as a donation from her and not from you.
    I think of came up with a great concept for the design a duck. It is original and I completely understand why it sold out. If you are wanting to continue this then there are ways to cut down on production time. There are many people, especially older people, who can crochet. Often they are not able or not interested in doing a market. You could contract them to crochet items and pay by the piece. This gives them income and you are still able to continue your build a duck concept.
    As women in business we face many obstacles that men don’t necessarily face. So supporting and giving others an opportunity to earn money and get ahead would be a very positive outcome from this.
    With regard to manufacturing in china. It is important to remember that no matter what contractual agreements you have with the manufacturer that it is likely your product will become mass produced and sold on to other businesses. Always speak to a copyright lawyer before sending any designs to another country for production. Additionally make sure that you are dealing with an ethical manufacturer.

    I Like your outlook and perspective. Although you said your front lobe isn’t developed 😂 you took responsibility and are actively giving solutions. Most people may not even acknowledge their mistake or attempt to right the wrong. People will be people, take care of your self as you move forward and give yourself grace, you are very brave.
    As a crocheter who sells at market I don’t think it’s necessary to credit designers at markets however, I do give credit on my IG. If someone who crochets comes across my booth we can have a discussion and I can share information that way.

    We've all made stupid mistakes that seem obvious in hindsight! Especially in early 20s, we just don't have the experience needed sometimes. How we reflect and correct those mistakes is what really matters! It's all about learning and developing. I'm glad you're taking this all in stride.❤
