I'm a little confused with waiver of medical examination and the jurisprudence you cited under such topic vis a vis ruling of Musngi case law. Thanks in advance, Atty.
Friend, I reviewed the Musngi Case [1935] and I find the latest jurisprudence is more demanding on Concealment in Life Insurance. However, the basic principle remains the same - the Insurance company should have all the information to handle both the micro-and-macro Financial Models in ensuring that there are enough funds to meet the happening of the RISK(s) that drain funds. So, without the accurate status of the Insured Parties, there is no meeting of minds as to what is being insured. I might be missing the area you are concerned about.

When no response from the Insurance Company, make a Complaint for non-payment of Claim with the Insurance Commission. Still, if not results, we file a Civil Case before the RTC for Sum of Money (collection case) versus the Insurance company.

Whenever a right to rescind a contract of insurance is given to the insurer by any provision of this chapter, such right must be exercised previous to the commencement of an action on the contract." -- does it mean po ba na, if the insurer is given the right to rescind, in life insurance, because of misrepresentation or concealment then the death occured and the claim for proceeds was filed. The insurer can no longer rescind or deny the payment of the insurance proceeds? For the reason that the claim or an action on the contract was made previous to a rescission, if any. An answer po is so much appreciated. Thank you po.
Yes, the Insurance company can no longer dispute its liability to pay the beneficiary even when there is concealment, on these instancdes: (1) the death occurs after the two (2) year Contestible period even when the Insurance company can prove concealment; (2) when the Insured died within the two (2) year Contestible Period and the Beneficiaries already filed their claim even before the Insurance company has declared the Insurance Contract void. However, a 2nd School of Thought is that the Insurance Company enjoys the benefit of the 2 Years Contestible Period so that when the Insured dies within said 2 Years, the Insurance Company can still declare the Policy as void for Concealment. I favor the view that the Insurance company enjoys the full benefit of the two (2) Year Contestible Period, regardless of whether or not a Claim has already been filed by the Beneficiary. But the Beneficiary can still legally claim the Coverage even within the 2 year Contestible Period has not been reached when he promptly files the Claim before the Insurance Company initiates the declaration of the Policy being void. This latter situation is a legal battle revolving around the filing of the Claim, despite Concealment, before the disclaimer of the Insurance company is made.

Friend, I reviewed the Musngi Case [1935] and I find the latest jurisprudence is more demanding on Concealment in Life Insurance. Anu po dapat na isusulat sa demand letter kasi hindi po namen alam ung dapat savihin.. wala po kasi alam sa batas tungkol po sa insurance.
