They don't have legal rights to anything. Hell, if tey did, there would've been trouble with Yuuka. Her "redesign" is nothing more than a new haircut. Not to mention their rights would also cover the characters' names, so the redesigns wouldn't get ZUN off the hook.
Kinda sounds as something that could be in TH9. It would be interesting a mod where Mima and Shinki are included along Yuuka and Alice (with a sprite swap) in the game.
It's sad that a true lossless version of this theme doesn't exist. (The one in Unreal Mahjong CD is actually just the reencoded stream from Magus in Mystic Geometries, which is a 128 kbps Ogg file.)
I feel that there are two main reasons.. the first is that after their absence in all the indexing works like Bunkachou and the Akyu books it would seem strange for a blast from the past to just appear. The second is that PC98 characters aren't popular with the majority of fans nowadays (relative to the windows-era ones) so ZUN wouldn't have much support to bring them back unless they are already related to the story (unlike Yuyuko, Sakuya), but I still hope ZUN will do it one day.

EOSD is the first time since Mima has left that an incident took place, so the song works as a Sign of a new Era. Mima leaves to reincarnate, and Reimu gains a new Ally in resolving incidents, being Marisa. Also as a Side Note, I love the idea of Marisas' personality change Is her trying to be cool as she sees Ma I'm her mind, and redesign can be considered Marisa just giving herself a new Look, or Maybe it's a parting Gift from Mima. Thanks to her assistance, Marisa has grown Strong. She can fend for herself until Mima returns one day...
Uh...this *isn't* an unused theme at all. This is the music that plays for Shinki's boss fight in Magus in Mystic Geometries. I mean, it even states this in the description, and a quick Google search will get you all the information you need to know about the game.
No. This song was created after Mystic Square. None of the unused tracks in the Mystic Square music room sound anywhere close to the melody of An Ordeal From God. You can confirm this for yourself by getting a PC-98 emulator and the Mystic Square ROM.
That and legal issues due to them being made during his time with Amusement Makers. Amusement Makers has the rights to most of the PC-98 characters. Which is why he had to redesign Reimu and Alice completely [Not to mention he couldn't outright state Alice's backstory, even though she recalled Reimu in PCB], Marisa to a lesser extent, and Yuuka also got a very small redesign.
Simple. ZUN worked for Amusement Makers, and they towned the Touhou project during the PC-98 era. I cannot recall exactly where I saw this information, it was ages ago. However, it explains perfectly the redesigns of Reimu/Alice [And more minor ones of Yuka/Marisa], as well as the lack of returning characters. If you work for a company, make something for the company that the company sells, then move on, you can't keep making and selling it. That's simple ownership law.
So Wait . . . Does this mean Shinki officially has a modern theme? Like Will this be the day we've waited for? Will this be the day we open up the door?

Genji is referenced in the newest Touhou game, so this still holds true a decade later.
