- The plaintiff rented an apartment to the defendant for three years. He claims the defendant up and left in the middle of the night and left the place in a total mess. He’s suing for the cleaning costs. The defendant argues he left the place perfectly clean. He says he was on a month-to-month lease and the apartment was infested with pests, so he doesn’t owe. He’s countersuing for money owed.

I was formerly homeless, and I respect my home because I'm proud I made it. I can't imagine mistreating my apartment.
I'm the same way but so many people out there don't share our respect and gratefulness. Even my wife was a slob and just generally treated her rent controlled house like it didn't matter when we met and first started dating. She changed at my urging and when she left after 2 years she only owed $290 for some minor damage to a kitchen drawer and a broken closet door. For a woman with 3 boys ages 6 to 10 I think that's pretty good.
@1967davethewave when you see people doing this over and over again, it's easy to forget that there are those who are thankful and treat their house like their temple. It's my home. I worked really hard to get here, I've seen many people trying to get here to, they're out there.
@1967davethewave there was a family at the last shelter who did doordash, went to the parks between orders and found success.
Unfortunately, that gets washed out by: Out of all the major cities, Eugene has the nation's highest rate of homelessness at 432 people per 100,000. There are people squatting on sidewalks, smoking crack downtown, and sleeping on sidewalks. And the cops won't do anything.
Take a trip next-door to Springfield, it's clean, and has Simpson's murals everywhere.

@@themrs.1200 I never moved into her rent controlled HOUSE. She eventually moved into my house, that I owned. We were both young back then and she wasn't a good housekeeper and showed little respect to the place. But she grew, I grew and we are both better and more mature today.
The guy that interviews the litigants as they exit the court room is such a troll 😂 There has to be footage somewhere of him being cursed out 🤣🤣

Defendant = "time line is off" = liar liar pants on fire. He's standing there looking confused but he KNOWS he left that place in a mess.
My husband and I just moved from our apartment after 6 years and purchased a home. We cleaned the tubs, mopped floors, had the carpet cleaned and took pictures of everything as proof. We had multiple leaks, mold and other issues in our time there. But bottom line: You leave a place [better] or the same excellent condition as it was given to you!
That is a lovely thought, leave the place better than when you took over! It's a mindset I also have, but I think perhaps we're in the minority!
I take the same approach. Was in an apartment for 15 years. When I moved out and had the landlord do a walk through, she was blown away. Actually said it looks better than before and could literally have someone move in the next day without hesitation. All hardwood, no carpet throughout the place, so made it somewhat easier.
I take pride in taking care of a place. Actually am more focused on this because the place is not mine.
I cleaned the old house I rented too lol took a full week.😱

(two episodes a day 30 minutes each) and now it’s in reruns probably for the entire month of October.
That was one reasonable landlord!
It amazes me how many people that lose say the same thing, 'I didn't get time to explain my side of things', don't they realise that all their documents (their evidence) have to be handed in prior to the case being adjudicated and all documents from both side have been examined, prior to them presenting their case in court, therefore the outcome has already been determined...

A judge knows how to rule without having to hear every single detail a litigant thinks is important. A judge doesn't rush to judgment even though a litigant feels the judge didn't consider what he feels is important.
That comment that guy in the street made about having parties and if he makes damage o well is immature. His place probably looks disgusting or he doesn’t have his own place.

if the landlord shows up you complain, if he doesn’t show up you complain that he doesn’t do anything.
tenants are just programmed to complain.

Fair but refuses to hire an exterminator? And charges $150 to clean up some boxes when they had a good relationship? All landlords are scum and just look for every penny they can extract from tenants.
@@Tuturu708 it's $150 to dispose of the garbage AND for cleaning. That seems super-reasonable, given that the guy clearly didn't do a thorough cleaning on his way out. On the exterminator, all you have there is a he-said-she-said. The defendant couldn't prove that the landlord refused to pay for an exterminator. Moreover, the supposedly "unlivable" conditions caused by these pests persisted for 1.5 years. I think something dramatic happened in the defendant's life and he dumped his issues partially on to his landlord.
@@newsflash7609 he lived there for 3 years. Was the landlord not going to do a deep clean of the apartment anyways? Why is it the tenants responsibility to make the apartment spotless for the next one? They’re not the ones profiting off basic human rights
@@newsflash7609 5:33 He reported to the landlord he was experiencing the issue and the landlord did not act on the report. He doesn’t have to prove anything - a letter from the landlord’s pest control company would have sufficed. Pest control should not be shifted on to the tenants.

This is the odd case where a landlord sues their former tenant and only asks for what they are genuinely owed. In most of these cases, when the plaintiff is the landlord they want $500 for hauling off a couple cans of trash, $1000 for cleaning the carpets and $2000 for replacing the screens. And when the plaintiff is the tenant they always want $5000 for pain and suffering because the landlord kept their security deposit because they moved out with the house trashed and also tried to use the deposit for the last month's rent. Kind of refreshing to see a landlord treat this as what it really is, a business transaction and not get all personal a butt hurt.
How do u keep coming back to the apartment if you're leaving the country now you're there for court?

Why is it that with every case that involves landlords the guy outside always asks the same question and yes I agree judge Milan is rude she tells the plaintiff to tell the story but Milan keeps interrupting yes I know that she is cross examing but she can wait till the plaintiff tells her what is going on

Many people think that the judges are rude when they interrupt but you forget that she already has a written answer and complaint from both parties, where they had ample time to recount their positions and tell the truth. When people tell their stories they make things up to better serve them in the moment under pressure and judge Milian knows that. She interrupts because they are going on a tangent and not telling the truth.

i think that deposits should not be legal since landlords can still sue tenants for damages . the whole point of the deposit is to cover damages but if they can get a deposit AND sue for more then requiring deposits are just another financial hardship on tenants and its not a fair system . especially when rents are so high nowadays .
Simple answer! Don't damage the place, or at least not more than your security deposit, have your rent paid in full, and give the proper notice and you won't have to pay extra, and you might just even get money back! 😳😁 According to your logic, the landlord should just have to eat the money if rent owed and damages exceed the security deposit (or in your world where the landlord cannot even collect a security deposit to help protect himself and his property), and the tenant can just walk away without ANY consequences!! No siree Bob! 🤣🤣
@@adwallace021938 how does my logic state that a tenant can have no consequences ? i stated that the landlord can sue the tenant and let a judge decide rather than the law allowing mandatory deposits for damages that do not even exist yet or have not been determined by a judge in a court of law that the tenant is responsible for any damages . its like the police fining you for a traffic violation that u were never guilty of yet , but they just assumed based on statistics that u would eventually get a traffic ticket so they may as well require u to pay it right now . like i said , the system is unfairly biased against tenants and in favor of landlords .
@@adwallace021938 also , decades ago deposits were like 20 percent of the monthly rent amount and now they are equal to the monthly rental amount , and with the inflated overpriced rents nowadays , the deposits are also over inflated . if the rent is 2000 per month for a one bedroom in a major city , then the deposit is usually also 2000 , even if its a small place that would never rack up nearly that much in damages .

Nobody ever stands up to Milian when she's ranting and disrespectful but that wouldn't happen with me. I don't care what, she'd never disrespect and talk down to me like this and not hear a mouthful back then I'd walk out. Doug wouldn't speak to me as he did to this defendant either.
