One of the biggest problem I find with cases like this are when we are told the officers are on some kind of paid leave or even a leave at all. Like they seriously think this incident is so mundane that they shouldn't immediately be fired and also have chargers put against them. They did everything wrong in this video. I once had a cop pull me over because she read my license plate wrong told me the plates belonged to a Nissan poniac which was just laughable unless i magically stuck those two cars together lol but then i got excused of stealking license plates. No, they cannot legally detain you for any amount of time unless they are sworn officers of the peace. In this case, the security guard was an off-duty cop, so this muddles things a bit and I think gives him the right to act as a peace officer. If you ever have a scuffle with private security, no, they have no more right to detain you than you have to detain someone. That is called a citizen's arrest and is only permissible in cases of suspected felonies. This is why good stores will use security measures to document and build a case against a shoplifter until they hit the felony thresh hold of usually a few thousand dollars to meet a state felony statute. I am not a lawyer. Your statutes may vary. Be familiar with your local and state laws. Know your rights.

yeah... even the news is twisting it. No store security guard can have "probable cause" even if they are a "professional" police office in another job. An employee of Walmart asked a customer "do you have a receipt" and the guy said no. One of the biggest problem I find with cases like this are when we are told the officers are on some kind of paid leave or even a leave at all. Like they seriously think this incident is so mundane that they shouldn't immediately be fired and also have chargers put against them. They did everything wrong in this video. I once had a cop pull me over because she read my license plate wrong told me the plates belonged to a Nissan poniac which was just laughable unless i magically stuck those two cars together lol but then i got excused of stealking license plates. But when all said and done she came back to my car told me I thought the F was an E didnt apologize instead told me everyone makes mistakes at their jobs, havent you ever made a mistake before?(which I do understand people make mistakes) but police officers mistakes should be taken much more serious since they have the power to Maybe "accidently kill someone" I think our work mistakes are in a whole different category. While she left too I got a rude comment for her to throw in (prob because she felt dumb) don't always assume you didn't do anything wrong!" Instead it wasn't an assumption of mine.... I drove away with no ticket and a cop on a power trip who even though she couldnt ANYTHING. Still threw in her dumbass comment.

No, they cannot legally detain you for any amount of time unless they are sworn officers of the peace. In this case, the security guard was an off-duty cop, so this muddles things a bit and I think gives him the right to act as a peace officer. If you ever have a scuffle with private security, no, they have no more right to detain you than you have to detain someone. That is called a citizen's arrest and is only permissible in cases of suspected felonies. This is why good stores will use security measures to document and build a case against a shoplifter until they hit the felony thresh hold of usually a few thousand dollars to meet a state felony statute. The police didn't really ask to see the receipt at the door. They asked if he had a receipt and then the man was attacked. You're not identifying the situation properly. There is no way all that was warranted over a frozen pizza.

yeah... even the news is twisting it. No store security guard can have "probable cause" even if they are a "professional" police office in another job. An employee of Walmart asked a customer "do you have a receipt" and the guy said no. The guy was a bit douchy when he was asked to show it by saying "you don't have the right to ask" but that is where it should have stopped. security guard should have said "Ok well we have you on camera and we can ban you from the store for not showing a receipt" or even just let him go over $7 of pizza.
Instead the guard acted like the victim had just shot the president, and went full USA Police office on him and decided to overwhelmingly overpower him, and THEN whip out the badge.
This is typical police behavior of escalating issues without proper words. Another example is the cops in Texas who went guns full drawn to a army lieutenant and pulled him over thinking he stole the car.

Off-duty cop working as a Walmart security guard seriously oversteps his bounds as a security guard and assaults a customer who exercised their rights to refuse to show their receipt upon leaving the store.
On top of all that, he was not "resisting arrest" and he hadn't done anything wrong or broken any laws. It's not even like they could've said they had reasonable suspicion for lawbreaking, because what they accused him of wasn't even a law.
Finally, that knee to the neck was absolutely malicious. There were three fully grown men pinning him down. They didn't need to crush his windpipe. Hell, they didn't even have the right to force compliance, because he'd not done anything wrong.

You are not required to show a receipt. unless you have previously agreed to it. It's not in my best interest. somebody being willing to violate my rights and no way shape or form means that I should have to do something to make them not violate my rights. That receipt is my property, there are not allowed to take my property from nor can they force me to show them my property. everything in that bag has already been purchased by me, they have no legal authority to search the bag or to even be able to look inside of the bag.
