Tennessee is following Florida's lead because Tennessee's new bill HR1259 goes into effect July 1, 2024. New law requires the county sheriff to remove a squatter. Once the property owner submits a complaint to the sheriff, the sheriff checks to confirm that the requester is indeed the legal owner (or a close family member that is allowed this power in the new bill), then the sheriff serves the squatter a notice to vacate. Then, if still there, the sheriff will remove them after 72 hours. It's not perfect and the owner will still have some costs but the legal costs are on the order of a few hundred dollars and it completely avoids the civil/eviction court. This is really how it should be nation wide.
But the squatter should have their income docked until the homeowner is reimbursed
Georgia moved these types of cases to the magistrate court with a non jury trial. If someone is claiming a lease the court must hear it within 3 days and rule within 7 days. This speeds up the process a lot.

Movie starts with him just helping his mom and going through this whole thing taking down the first squatter, the realization that many people go through this, realizing he can help them and then becoming the squatter hunter. Maybe the it could lead to him getting the burger guy out, or have some other kind of build up towards something. Idk just thinking out loud, but I think it could be done and actually think Josh Brolin could play him perfectly.

@@TheIcedCoffeeHournot even after talking to hasan do you see how awful this is, these people were failed by the system and most of the homes they are squatting inside of ARE VACANT. This guy only mentioned the edge cases and even then you could tell that he wasn’t telling yall everything because obviously he works in a legal gray area. The people that move in are homeless just trying to put a roof over their head and are using the law and unused homes to fix the problem the state should have fixed many years ago (right to housing or at least better and more homeless shelters). Squatters rights are a thing for a reason.

this man is doing god's work. I should consider myself lucky after hearing this. Took me 4 months, a little over 8 grand in legal, cleaning, and repairs, and a lot of stress to get some squatters out. My squatters just happened to be extremely lazy and didn't show up to court to fight it or hired any lawyers. I have no sympathy for squatters.

When he said "make the house smell really bad" It reminded me of a story I read a few years ago. This wife was cheated on by her husband and abandoned. The husband threatened to leave her with nothing. I can't remember all the details, but they really aren't that important here. The wife got her revenge and got the house at a bargain price, and this is what she did. She put fish on the inside of curtain rods before she left. When the fish rotted, it made the house smell unbearably bad. No matter what the ex husband and his new wife did, they couldn't get rid of that smell.n So, they moved out of that house and moved into a new one. They offered to sell the house to the ex-wife dirt cheap. She bought it and then threw away the curtain rods. I would never have thought of putting fish in curtain rods, but that would certainly get rid of squatters.

Amazing story
Non-paying tenants = squatters. Even a homeowner with 100% equity still has to pay the government for their property; there is no reason to protect tenants who refuse to pay. If the homeowner refuses to accept payment to try to force a tenant out, that's something else. The government will not hesitate to seize property if property taxes are not paid. The bank will seize property if the mortgage is not paid. Why can tenants live in a property without paying? During COVID many cities decided to intervene by allowing tenants to not pay rent. Did they tell the banks to stop collecting the mortgages, or stop collecting interest? Nope. Did the city decide it would generously stop taking property tax? Also, no. These laws are ridiculous. If people care so much about tenants, then why don't they help the tenants themselves, instead of forcing homeowners to shoulder the burden.
Flash is a hero. He should run for president 2024! Thanks Jack and Graham for shining this spotlight.

Here in FL, we don't play that nonsense. You squat... you'll most likely go to jail, but the sheriff here advises us use your gun. Very easy to make it a self defense situation.

Grahams dystopian solutions requiring biometric data to sign a lease is not only unwise but would open the door to totalitarian government overreach.
It also doesn't make sense. The thumbprint is actually a really good method because it's unique and you're not using it everywhere so it's harder to steal unless you target that person exactly.

I had a Covid squatter that was a tenant that violated the lease in that he failed to maintain utilities. When it became cold enough to freeze the pipes,I isolated the water away from the bathroom. When the voos did not like that,I put an external hydrant that the tenant could get water and dump in the toilet to flush it.
I maintained that no one has the right to cost me tens of thousands of dollars. The cops had a problem that there was no water to the building. By draining water lines inside the walls where they could freeze, and maintaining the water to the building, there was still a way to flush the toilet. I was simply protecting the house from a flood.
It never went to court because the cops gave him the bad news that I was still laying the water bill. I called the water department daily to make sure no water was being used.
Finally the right to evict came back. Our own government added to the problem by taking away our right to evict. Supreme court eventually ruled that governors and presidents were wrong in assuming emergency powers in the taking of property. Why the hell we cannot recover our losses from the government gone rogue is beyond me

So many things I don't understand here
1 - the woman who was arrested for changing her locks -- Can't she just say I have no idea who this random person is, and now cops say okay well its a civil matter now?
2 - How does it work with the cameras? if you present camera footage of the break-in then cops have to remove the squatter?
3 - I don't understand why castle doctrine doesn't apply. I can say holy shit some guy tried to break in and I had to shoot him to defend myself, how can they legally do anything against that?
4 - Why can't someone just hire a bunch of strong armed men to go in there and forcibly detain the squatter / remove them, once they're out, take control back of the house, then even if cops come on the squatter's wishes, just say we have no idea who this random person is, then again its a civil matter, but its on the squatter to prove anything (which doubtful they will)
2: Yes video proof of the actual crime allows you to prosecute. Otherwise they can claim someone gave them permission.
so theoretically speaking if I watch their patterns and setup the alarms when the squatters aren't inside the house I can move all of there stuff and claim the house as mine back without involving the sheriff eviction process that could take months to do.

Correct, IF they broke in. If they have a key, or door is unlocked, it’s less clear.

My home always had a home security system with anti-squatter protections. In fact we got a home security system primarily to protect from squatters while we were gone for extended periods of time.
If we leave to go on vacation and come home to find someone squatting in our home, we could have the squatters arrested immediately. Because the police can verify our home ownership with the security company and then have the squatters kicked out no matter what BS they try and pull about having a fake up lease or something.
Everyone just get a security system and squatters will be done. Every single squatting situation I’ve seen the home in question doesn’t have a home security system. 🤦♂️

It’s not a landlord’s problem if you can’t afford a house. Squatting needs to become illegal and those that break in should get arrested. If the homeowner must pay taxes, then this can be considered criminal not civil.
My neighbor had squatters in her house and I provided as much video of them as I could. I even caught their drug deals on my iPhone footage at 3 am in the morning. They were a group of young Black guys. Every evening, the entire neighborhood reeked of their marijuana. The HOA received many complaints but did nothing.
It took my neighbor a year to legally get them out with CA Civil courts and with a very expensive attorney.
She spent 30k cleaning up the house. This is the reality.

Wage garnishment.. this is the only path to restitution when evicting a non-paying tenant or squatter.. they have no choice but to pay when it comes to a garnishment. Use social media to find out where they work, there’s plenty of clues and ways to find out..

This is what Hasan failed to understand. Squatters often take from the poor and vulnerable. It's not always a "this home has been vacant for 20 years" situation. Story like this are actually quite common.

Squatters laws are so broken in the usa and it greatly affects the rental and housing market in a negative way. We drastically need to change laws related to squatters.

Unfortunately I had to consider how to kick out my dad. My parents are going through a divorce and luckily my mom had a judge who was able to approve her permanent protection order against my dad. We were able to avoid dealing with eviction/squatter issues because of that. I really enjoyed this episode, keep the diverse topics coming.
If I come back from vacation and I find out there’s a break in, I would fear for my life. My state has a castle doctrine. 🤔

Sad stories are ones where the house is a family asset and current generation owner is so upset at the failure to protect it, as they can't afford the legal process to get the squatters out, they go to the other extreme by shooting the squatters and then themselves so that it passes back to the family 'squatter free' as inheritance from the person who committed suicide.
