      The same thing actually happened to my father after an on the job head injury. He often ends up raising his voice or yelling when speaking without realizing it, generally having issues with controlling tone. Not to mention, he now lacks a filter when speaking. As my mother says: "you never know what he might say."

      Frontal lobe damage will do that. The most famous case of it took a soft spoken construction worker who got a piece of metal shoved through the front of his head and turned him into a violent drunken wild man. Can't get through psychology 101 anywhere without them teaching you about him.

And not really the same, but after hitting the left side of my head in a car accident (on the right side of the drivers head - our heads bonked together, lol) I randomly quit smoking. Didn't have a craving at all after the accident. It was the craziest thing and I can only assume the accident had something to do with it. It wasn't so bad I had to stay in the hospital.. they just checked me out and told my bf at the time to keep an eye on me for a day or two for any possible concussion symptoms. 🤷🏻‍♀ It lasted for about a year when after a breakup (with the same bf) I got a pack of smokes and screwed it up. 🤦🏻‍♀

    American lawyer here. I’m so glad you covered the McDonalds coffee case thoroughly and talked about how the case wasn’t just an example of stupid and frivolous litigation by overly zealous plaintiff’s lawyers.
    My understanding is that the McDonalds store at issue *deliberately* overheated their coffee to a significantly hotter temperature than any of their competitors did, and the reason they did so was to try and keep the coffee hot and “fresh” for longer to try and lower their costs. Because they overheated the coffee, when it spilled on the lady she was burned *much* more severely than she otherwise would have been if the coffee was at a normal temperature. The injuries she received were honestly pretty horrifying, her inner legs and coochie area were severely burned and disfigured. If the coffee was at a normal temp, she would’ve received minor burns, not life changing ones.
    Long story short, the right verdict was reached in the McDonalds case, it wasn’t an example of frivolous litigation, and frankly the plaintiff probably deserved even more money than she got.

      If McDonald's as a company choose to serve all their coffee at that temperature then it wasn't an uncommon temperature, it was a normal temperature cup of McDonald's coffee, which is different then "a normal temperature cup of coffee"

      ​@Xiellion This case and the coffee temperature were specific to this store so it's not a "normal mc donalds coffee" also that doesn't matter because it's illegal anyway. As a restaurant you can't do x,y,z it doesn't matter if you think y can be used as a trade secret you still can't do it and it can't be common.

    My favorite bizarre court case is from the late 90s, where Pepsi promoted a ....promotion, where you collected points from purchasing Pepsi products and could turn them in for various prizes. The ad for the promotion ended with a joking show of someone landing a Harrier jump-jet, with a points price below it of 7 million. Some mad lad found a loophole that allowed him to buy points at 10 cents per point, and promptly provided the $700K to claim the points for the jet. Pepsi said no, the man sued. The judge said "boy you crazy".

    It's definitely not as extreme as the Gloria Sykes situation, but my great aunt had a brain tumor removed and she instantly went from a strict prim and proper type of woman to being kind of foul mouthed and funny. Nothing too extreme, she was still a sweetheart, but her filter was just gone.

    The case about the aunt who sued her nephew is just like Stella Liebecks and its completely misunderstood.
    So what she did was sue her nephew after her insurance refused to pay because her sister had liability insurance included under her homeowner's insurance. She sued her nephew with the full support of him and his parents because in the state where this happened they *require* it. It was to get _their_ insurance to pay, not the nephew. Social media blew this up and this poor woman had to do media interviews with her nephew and family to clear it up. I had it wrong at first too.

    I remember reading for the 8 year old kid case, is that they couldn't sue the HOA directly due to some law and had to name a specific person which happened to be her nephew. And that the family were still normal with each other

      Yep, they had to go through homeowner’s insurance to get medical bills paid for, and name an “offender”. The family never had any problem with this, it was just scumbag journalists who demonized this woman and ruined her career prospects for the rest of her life because the first google result when you search her name is “aunt from hell sues nephew for hugging her”.

    The world really has gone mad.
    Some of my all time favourites are:
    1) The Asian lad who sued Lynx (body spray) for millions because women never chased after him like the advert suggested. Case lost!
    2) The burglar who sued because he got stuck in a couples garage when the door jammed shut on him and was left inside it for a week with only tins of dog food to eat (couple were on holiday). Case WON!!!
    3) My favourite - the criminal who fell off the top of the jail wall trying to escape and received leg and spinal injuries on thudding back to earth. He sued the jail for having a wall that was not high enough to prevent him from scaling it. Feck me - case WON!!!!
    The world is full of idiots - criminal AND legal !!

    With the chinese case, its actually well documented that the entire supposed lawsuit/divorce actually never happened. This is one of those stories that is a giant telephone game and combining of a made up story and an advertisement. In the original story it was about their first child and then they get divorced, but in later stories its became 3 kids of different ages, and has a family portrait. The Family portrait was actually an advertisement for a plastic surgery studio with a pretty couple with ugly children of various ages.
    Funny enough there is an actual lawsuit atached to this story about a model named Yeh Wan Cheng, who supposedly did not sign off on how her likeness was used and the Heilongjang Morng Post who started all of this has a history of printing urban legends without verifying anything, (insert snarky comment here) such as a story about a man in his 50's having an online girlfriend and asking her out on a date before ultimatly finding out its was his own daughter in law and other just completely coked out stories that could only work on a website with a bass and drum line.

      The most heat resistant part of the human body is the tongue, that can take up to 75°C/167°F without suffering damage. Serving a beverage hotter than this should be a crime in itself.

    I've had multiple close friends and acquaintances completely change their personality after a bump on the head.
    The incidents range from mild (getting knocked out in a boxing ring).....
    To serious (taking a baseball bat to the skull and having to pick up pieces of it to take to the hospital with us.)
    Even had one close friend who had a small brain tumor but he was a different person after his surgeries.
    Needless to say... A bump on the head can do some crazy shit. And cte can also really mess you up.

    That insurance excuse near the end sounds legit. I've seen a case where someone couldn't get their insurer to cover damage to their car after they had hit a kid who ran into the road. The insurer was telling the client to pursue the parents of the injured child since they were the party responsible for the accident.

    For clarification, Dank, the one about aunt suing her nephew was really about insurance. There are even interviews with both her and her nephew where she explains that she did it because her insurance only offered $1 for her medical bills.

      He did mention all that and added "press X to doubt" on the justification. Even then, dragging a 12 year old through court to get your insurance money (that she really didn't make a good claim about) is pretty out there.

      I think because her own insurance didn't pay out, she tried suing the kid's parent's homeowners insurance, and had to add the kiddo as a defendant by necessity.

    I was part of the Red Bull class action lawsuit, still have the 10$ check from the settlement as a memento. It was about the marketing convincing consumers that it's a superior source of energy, when in fact it has less caffeine than most coffees

    The hot coffee suit is a ridiculous case, all down to corporate greed.
    The overheated coffee Stella got was anywhere between 195 and 210f, and it melted the fabric, which was polyester, not cotton.

    I remember Stella and the coffee court case hitting the news. Maybe McDonalds did a PR campaign, maybe they didn't, but her case came up after a string of really stupid court cases where people were awarded millions because they did something pants on head retarded. So her case was lumped in.
    But once I learned the actual details, to be blunt coffee shouldn't be so hot that it literally melts your pants to your legs.

      I thought 88C didn't sound like that much. Looked stuff up and read that: "According to the National Coffee Association of the USA - which many large companies in the food and beverage industry listen to - coffee should be served at around 180-185°F"
      185 degrees Fahrenheit = 85 degrees Celsius. Three celcius off.
      I think it was just a case of bad luck and frankly, those pants sound the more dangerous issue here.

    About the Gloria case.. it is a very, VERY scary thing that it is possible that head damage can upset the prefrontal cortex that's.. kind of the area that tells you to not do things you want to do.. if you look into the past of a lot of serial killers a lot of them had head injuries when younger.
    Not saying "Bump your head, make many dead" but Phineas Gage, which had a very disturbing case of being a metal head changed from being a upstanding and hard working guy to becoming the opposite.

    I swear the McDonald's one always pisses me off because everyone's knee-jerk reaction is "Hurr durr of course coffe is hot" and don't know a single other thing about the case.
    Her compensation was even reduced because of some personal liability. She didn't even want that much, but people blame her for starting a whole lawsuit craze, because surprise to no one, a company didn't want to pay her what was reasonable.

      @@slvrshore5300 you don't understand the full story, you should look into it. It's such a huge case that in many law schools it is taught as an example of how "frivolous lawsuits" are often not frivolous at all, but that the actual truth of the case is hidden from the public. I'm sure it's probably taught in marketing and business classes as a success story in "media spin" too, though I don't have firsthand knowledge of that.
      In this case, McDonald's had been warned multiple times before the incident that they were serving the coffee dangerously hot. McDonald's said they knew it was too hot to drink when they served it but it made the coffee last longer in store, and they thought customers liked it too hot to drink as it would still be hot after their commute to work or some crap. They had been warned that it would take something like 5-10 seconds to cause 3rd degree burns at the temp they served the coffee, and if they had reduced the temp about 10 degrees it would have become 30 seconds to a minute to cause the same injuries. 30 seconds is enough time for you to brush it off or get your pants off of react in some manner if there's a spill. At 5-10 seconds you're guaranteed injury if it spills, yet McDonald's continued to serve coffee THAT hot to people in moving cars. Additionally, McDonald's also incentivized their employees to rush people through the drive thru to increase sales and minimize "drive times." A whole bunch of things that McDonald's was doing, that they should've known better. Instead, McDonald's did them, knowing that what they were doing was dangerous.
      The woman in the case acknowledged the spill was her fault and had conceded a percentage of blame for the injury, but if McDonald's had taken ANY steps to minimize the danger of what they're serving, then the woman would not have been injured beyond a mild 1st degree burn when she spilled. The woman went from living alone and being independent to needing multiple skin grafts, constant care, and never fully recovered, requiring a caretaker until the day she died. All caused by the coffee from that McDonald's. It ended her life as she had known it and it was never the same again.
      That is 100% the fault of McDonald's, and all the woman asked for was that McDonald's cover her medical bills. Instead, McDonald's took her to court and lost multiple times (original suit, and appeals) costing them far more money than her medical bills would've cost, before they finally reached a settlement, but as part of the settlement, the woman was required to sign a NDA and was not allowed to speak to the media about her accident, and McDonald's would not be required to admit blame. Once McDonald's had gotten the NDA, they went on a media tour to all the outlets to make the woman out to be a crazy person with a "frivolous" suit, even though her case was FAR from frivolous. The full story only came out years later because when the woman was more or less on her deathbed, she started to talk to the media and there was a big documentary about it. She figured there was nothing McDonald's could do to her once she was dead.
      What McDonald's did to that woman is absolutely despicable, and I have refused to eat at McDonald's ever since I learned about it.

    With the hot coffee incident, it wasn't just the lady being a Karen. The court found that particular branch of McDonald's would overheat their coffee by a lot because people were complaining about getting cold coffee.

    I remember this story a health teacher of mine shared one day, he shared this story about a robber who was trying to break into a cellphone tower building. The building was surrounded by a barbed wire fence and as the robber hiked himself up over the fence, he straddled it for was seemed like just a millisecond. As he straddled the fence, he blew open one of his testicles and was rushed to the hospital. He ended up losing the testicle and sued the cell phone company for "having an unsafe environment for people to break into" and he fucking won.

      Did the McDonald's coffee woman get horrible 3rd degree burns? Yes. Was the coffee overheated? Debatable. For fast food standards, a bit over. According to many, though, it was in line with how hot you should serve coffee- between 180F and 190F (a bit below boiling- 212F). This is about the temperature Starbuck's serves their coffee to this day (between 180F and 190F). You'll get 3rd degree burns at that temperature in less than 2 seconds. Had McDonalds served the coffee at a lower temperature she still would have gotten the horrific 3rd degree burns. At 150F you still get 3rd degree burns in about 2 seconds. At 140F (the temperature McDonalds serves their coffee today) you still get 3rd degree burns after 6 seconds. She still put a piping hot cup of coffee between her legs... and then squeezed. Horrible burns are the expected result of that. The most generous reasonable view would be that the burns were worse than they would have been at a lower temperature, but McDonald's didn't spill the coffee on her, she did that to herself.@@jameskazd9951

    The smear campaign McDonalds ran against Stella was disgusting, especially since it came out in the trial that MCdonalds had been notified of customers being injured by dangerously overheated coffee multiple times before; it was a known issue that they chose not to fix. Growing up in the U.K. of course I heard about the case of an entitled American idiot suing McDonalds because they spilled their coffee and it was hot… I couldn’t believe it when I later heard the real story and saw the extent of her burns, and it was a real wake up call to young me to be cautious about believing the narratives that corporations put out, because they will lie out their arses.

    The broken arm one was more than likely a legitimate attempt to get the nephews parents home owners insurance to pay out. And head injuries can have weird side effects. There have been cases of people being able to speak foreign languages fluently without having studied them.

    Legend from my time in law school about a convict from the prison in Timisoara, Romania, who tried to sue god for breach of contract because when he was baptised, he entered into a contract with god, who was supposed to keep him away from evil, but hadn't, since he was in jail. Court had it thrown out because the defendant didn't have a valid address where they could contact him, because the plaintif had listed him as domiciled in heaven. Well played, court. Well played.

    A note on McD's coffee in 2023, it's rather nice. They order good beans on par with any other coffee chain like Dunkin or Starbucks. McD's also orders really nice high quality coffee mugs and lids due to this lawsuit, so it's really not an unappealing product at all, at least in the US.

    In 2006 a Dutch woman sued the lottery for psychological damage because the lottery had a feature where entire streets get selected (postal code) and everyone who bought a ticket living there would win a prize.

    16:47 190°F is definitely inappropriately hot for any food establishment to serve coffee or other liquids at. I used to work in a coffee shop and one customer wanted a super hot coffee, we were hard pressed to find any options that were above 135-140°F, even when brewing a brand new pot or pulling an espresso shot. If you read the warnings plastered all over your hot water heater it will inform you that water that is 125°F or above can cause severe burns or death from scalding. The same warning labels go on to say that water at 130°F will produce serious burns on adult skin after about 30 seconds, raise the temperature to 160°F and the time needed to cause a serious burn is less than 0.5 seconds. Add in the factor of the hot liquid soaking into fabric/clothing and the hot liquid being held against your skin by the fabric long enough to cause your skin to blister or worse. That poor lady

    You should look up Swedish self defense cases.
    One man was housing a friend who had been threatened to death by a third person. This third man then found out where he was staying, broke into the home-owners home - walked up to the home owner brandishing a hunting rifle in a hallway who warned him he would shoot. A scuffle for the gun broke out, accidental discharge (ruled by the court even), and the home invader died.
    The home owner was charged and convicted of manslaughter, because he did not make a sufficient enough serious warning - he should have fired a warning shot with a bolt-action rifle.
    Even the Lawyer's Confederation of Sweden thought this was a horrendous ruling.

    I got one.
    Here in Trinidad we had a coup attempt back in 1990 by a group called the Jamaat al Muslimeen...gonna just let you guess what kind of people they were.
    It lasted only 6 days before they surrendered to the army after being holed up in the Red House (our Parliament) and the local tv station (we only had the one at the time).
    Before they came out though, they forced our Prime Minister, at gun point, to sign an amnesty for the entire group. And our court system upheld the document...

    i was one of the people that got suckered into thinking the coffee lady was just a frivolous lawsuit for years. Then i actually decided to look it up. She suffered horrifically and actually tried to work it out with them. Then on top of that Mcdonalds shamed her in the media. They deserved much more than the slap on the wrist that they got.

    To be clear its not that we can file a lawsuit for any number of reasons, we can file a lawsuit for any reason. The suit gets adjudicated in court.

    When it came to the McDonald’s coffee court case it gets a lot worse. It was used by McDonald’s and other cooperators to shine acight on court cases like these shown here in their favor, and overall cementing a culture of “suing is bad and petty” in a lot of the modern American mentality of the time. Hell their was even a country song about the fucking thing. Worse still they purposely pinpointed and created a narrative that she was not only stupid, but also around half her age, a Karen, as well as black.
