    To address the quesiton that has popped up a number of times:
    If your CCTV system captures images of people outside the boundary of your private domestic property - for example, from neighbours’ homes or gardens, shared spaces, or from public areas - then the GDPR and the DPA will apply to you.

      So are you saying if you have a camera doorbell with a wide angle lens and a 40ft front garden resulting in any person likely to be captured outside of the property to be unrecognisable because of their relative scale constitutes personal data? And where does the burden of proof fall?

For instance, if you live in the US, depending on which state you live in, there are various laws that govern audio recordings, mandatory signage, and/or the visual capture of private spaces of your neighbors. So it's probably worth researching those nuances for your particular jurisdiction before you buy a particular camera setup.

      @@JS64100 There are no rules on filming in public places. Anyone can do it as it is perfectly legal.

    While in the scenarios you describe, I totally agree with you.
    However, was woken up recently as a car crash outside my house, caused my parked car to be written off (and 2 other parked cars hit).
    Neighbour across the road came over and said her ring doorbell had captured most of it.
    Very helpful and zero complaints from me

      I think my neighbour probably feels the same she knows I'm recording because I have to sticker on my door and we've had problems with kids being little idiots outside so if anything happened to her property as well as mine it would be captured as we live in flats and are doors are side by side we literally share a walkway n garden so she's got free cctv in a way

      I was about to write something very similar! I have got the motion capture set to within my boundaries, but obviously the camera is on a fish eye so it does view out to the road regardless. There was a crime outside and I purposefully put the ring in live view to capture it and the police were very grateful for it, they submitted it in evidence and didn't say I had breached anything in that situation. Useful video from BbB though and glad I am (accidentally) compliant!!

      Do these judgments apply to the State monitoring the public at large, would the Police use any video or audio obtained by such methods as evidence for the prosecution in a court of law?

    Recently I had a prowler and when I reported this to the police, the first thing the wpc asked me was "do you have a ring doorbell camera?"

    What's more likely - getting done for breach of privacy, or capturing useful evidence? And in the former case, unless you publish or give them footage, how do they prove what was captured?

      Exactly. Most people compromise themselves thinking the law is on their side. The law is stacked against all of us. Its similar to the TV license, most convictions are from people speaking to license fee goons or letting them in. Its on the prosecution to show your guilty and in both cases the only evidence of guilt would come from the home owner.

      I'll just deny that my CCTV is functional if I get any bother. It looks like the law favours the criminal. Ironically the police always knock on your door if they think you may have footage that will help in a case, they seem happy to turn a blind eye to it unless it's excessive.

    We ended up exchanging this model for the slimmer version ua-cam.com/users/postUgkx0jZ_lGlDVJhDnmagEU8gn47cmfPNlLQU because it was too wide for the only door trim area that made sense to mount it on. However, we should have just noted the dimensions prior to purchasing. Otherwise, we love the doorbell. It works perfectly, and the video is very clear, even at night.

    If it is legal to film in a public place then if you have a cctv camera on your property facing the road then is that not the same as filming in public?

      If you film from private to public you come under the GDPR Laws but if you film from public to private you are ok as the law allows you to film what ever you want who ever you want in public. Crazy but affords the Joe public protection from companies or home owners etc. People that are in public who don't want to be filmed have to avoid or wear a mask for their privacy. Nut isn't it

      You have to display a CCTV notice near the camera. I have one and my neighbour opposite too because we capture everthing passing our homes

    4:47 Even if you blank out the area of the door. If they leave their flat they will still have to walk in the area of the frame that is not masked so you will still be monitoring them. So it doesn't seem to serve much purpose apart from not being able to view directly into their flat when they open the door.

      I've got a commiment, what about all those camera's being put up at street corners, junctions and housing areas.
      Does that not infringe on our data protection?

    Something which I cannot understand is that , when a case is brought to court which has never before been ruled upon, or which even goes against or modifies previous rulings, how can someone be found guilty, or have to pay damages, when no-one previously could have known that it was illegal?

      If the law changed and then you were convicted afterwards without knowledge of the law change, it would previously be a case of "ignorance is no defence". But, I am fairly sure circumstances are always considered.

      Yes, I also believe that circumstances are considered. For instance, if you've received a cease and desist letter, then it's probably worth verifying if that letter is BS or not before completely dismissing it out of hand.

    My neighbour has a security ring camera in their back garden. Every time I open my back door the flood lights come on and my whole garden is lit up from the bright lights. Does this mean that the camera will pick up everything the light does?

    Are you supposed to take your neighbour's word for it if they say that they are not recording you ? Especially in my case, where my neighbour installed one by stealth, i.e.,not consulting any of his neighbours and ignoring all the guidelines such as not putting up signs, etc

    Tried sneaking in at 0523 on Saturday completely wrecked after my works Xmas party. All captured on the Ring bloody doorbell. The evidence was unfortunately overwhelming so I’ve gone Guilty early and agreed she can have that new kitchen.
    My question is have Ring breached the human rights act in respect of a bloody good night out once a year? There should be a mute function on the app for such situations. The Alexa was shouting motion detected at the front door, the dog started barking and that woke the wife and kids up.

    i have an indoor Hive camera which is trained so as to cover the three doors which offer access to the property. There is a window which looks out on to our neighbours driveway, but with a very limited field of view. This indoor camera has on some occasions recorded my neighbour taking rubbiish to his bin. Certainly not what i intended and I was surprised that the motion detection was that good.

    I have a local authority CCTV camera metres from my front garden. What rules apply to those? The old CCTV cameras you could tell which way they were pointing, you could see them move, but the new 'ball' cameras (sorry, don't know the technical term) don't move so i don't know where or what its looking at. Can i apply for a Subject Active Request from the local authority?

    I have a cctv system that was put in for monitoring myself as I kept falling, but then Installed a camera on my door and with the agreement with my neighbour was happy to record both sound and vision. This has been beneficial in finding who was stealing our parcels. There is clear CCTV posters noting the camera is there with a warning. As yet, both myself and my neighbour have saved stolen parcels and kept these thefts down now.

    Just this morning I called police to report dodgy recordings on my cameras from last night...complete with audio...looking for a place to hide an item on my property...1 telling the other to scuff out their footprints in the fresh snow etc. Without the audio I would not have known just how dodgy these people were behaving. No issue or even comment when I called and turned the 3 recordings over to police

    Please could you help my neighbour and I share a communal are for our rented flats where the doors to our flats are very close she have put up a ring doorbell and it is causing me a lot of distress because I feel she is infringing on me and my family privacy. Where this camera is beyond the common shared front door and in the interior of our shared area within earshot of private conversation and constant goings and comings of my family

    Thank you for the heads up. I am a buyer and seller situated in Flats, a couple of my parcels have been stolen recently from outside my front door, thus I have purchased a ring camera. Very useful information, as one of my neighbours isn't happy with me putting up the camera. It certainly as got me thinking.

    Ring doorbells are a godsend. It means you can screen people who come to your door without opening it.

    We had that, in conversation with our neighbour he mentioned something, that I know I only said in private with my wife. The only way he could have known was from the door bell sound recording.

    BBB tell me who I have to handle my ID to ? I'd check in to the hotel recently and guy told me that in London I have to ID myself. Now I think he photocopied my drivers licence. I don't think this is right.

    I've set the motion detection zones to only trigger on my property. Recently an oik tried to break in (all captured on cameras). He then left my property and the tail end of the video caught him breaking into my neighbours opposite. Vids have been supplied to the police and will be used as evidence in court soon (they have apprehended and charged someone).
    The ring 'privacy' just says it will prevent motion detection in those zones, so not sure the difference in terms of what I've already done...

    Is there a right or expectation of privacy regarding audio recordings in a public place? If a property has no front garden and its front door leads directly onto a public street, does the audio recording feature need to be disabled?

    We have had police three times to our house because they know we have camera's not had one person say anything about an issue, plus we have a shared path and entry so how would you handle that situation if there was an issue?

    If i have a "private" conversation at my front door, could the Ring next door capture the conversation? I understasnd the house across the road can because of motion detection, but the house next door wouldnt unless someone walks past? How long after someone walks/frives past does audio typically record for?

    As an amateur photographer I take photographs and sometimes film from my apartment windows. I am just filming or photographing the sky and the car park also appears in the pictures. Am I subject to GDPR? Surely not, as you are allowed for journalistic and artistic reasons? Which begs the question if you are taking photographs out on the street, which I also do. I often photograph private property such as buildings or works.

    You CANNOT expect to have privacy in a public place - PERIOD. If you're going to discuss private things while out in public, then it is entirely YOUR fault for being stupid enough to do so, as it should be obvious that there is potential for others to be able to hear you whether you like it or not. It's basic common sense! How bloody stupid can you get? Filming in public is NOT a crime - especially if such filming is strictly for security reasons.

    I live in a block of flats, with buzzer to get into building. I have a neighbour's front door directly opposite my front door. If a camera was recording it would film inside his front door.
    My Housing Association say no to Ring Doorbell or similar. I'd love to get one but no chance.

      If the council are unwilling to improve security by putting CCTV in public areas then screw them and put a camera up. Safety comes first regardless

    My neighbour has his ring doorbell on the boundary of his 7ft fence to his property looking out over our private car park. He says it to see if anyone is attempting to gain access to his property. He has recorded neighbours and sent e mails to them in the past. The police where involved but nothing has come of it. All the neighbours have asked for him to put the doorbell on his house to look over his property but he refuses. Where do we stand.

    I have a Ring camera. My house had a brick through the window and tyres slashed on the cars in the drive. The happened in November this year. The people who did this used a wifi blocker to block the camera recording their activity. This is a warning to anyone who has a ring camera. This is a major flaw, get hard wired CCTV if you are worried about crime.

    Question : If someone is captured stealing a car or murdering someone on what you would consider a video that breaches data protection, would you as a defence attorney argue to make that video inadmissible as evidence ?

    our door camera ,which I installed because I am away alot working ,so when my wife is alone she can see who is out there ringing the door bell , unfortunatly it also pionts straight at the house across the road(there is no way around it) and it is has a very good quality picture,it only turns on though when sombody presses the button and nothing is recorded and no audio ,does this make me free from any data protection act ? I can't really adjust it so the neigbours house is not in view ,we have apox 10-meter "walk-path "to our front door if I take the neighbour's house out of the picture then twe would be looking at callers knees,-ps we do not know the people in the house across the road and don't want to start a problem

    Audio can be incredibly important, in the event of a crime. Imagine... "criminal No.1" talking to their partner, "criminal No.2", by name.. this would be immensely helpful in an investigation. Also worth noting, simply "capturing" video of others, is not a breach of data protection... sharing it would be. Side note, if your neighbour is burgled, but they didn't have a camera to capture the event, your data may be usable in their proceedings

    This is all very well. But how about CCTV cameras in shops and on buses that record audio?
    And what of the dash cams in cars that also record audio?
    Often after a particularly public crime, police appeal to car owners for footages.

    when I set my ring privacy zone to block my opposite neighbour's front door (althgough they are happy to be viewed) I found that everything in front of the zone, including my driveway up to my front door blocked too. A good idea, not implemented very well...

    My Mum’s next door neighbour who is my son’s best friend and my best friend’s son, he has CCTV which he has set to cover my Mum’s path, with our permission it gives me peace of mind knowing he is keeping an eye on her for me.

    Why don't these cameras have, an easily made, F-stop to set the depth of field. IE only people on the property should be in focus, and passers-by would be blurred. Simple.

    My neighbour installed a doorbell camera to the corner of their property (far away from a door) purely to cover the adjacent road and bus stop. It covers none of their property at all. Is it only the data protection legislation that they could fall foul of?

    I would very much appreciate further commentary on the privacy issue rather than the DPA issue. Even with digitally blocked out areas it is still quite unsettling having cameras pointed at your property. In a case I know of a home owner had the whole 180 eastern aspect of their neighbour’s property under their cameras with bright lights on all night too. Taking in all the neighbour’s back garden side of house, side entrance front garden and front access. Assurances were made about digital blocks but in the end it was too unsettling and excessive to the extent that it was troubling. luckily in the end after some tense discussions the cameras were moved. But….DPA aside I would value Legal commentary on privacy and article 8 right to private and family life. I expect there are some equally menacing situations out there.

And it's great timing because a YT Short also came up yesterday about a crazy man who was recorded knocking on a door and saying he wanted to r*pe and k!ll the woman in the house!!! That doorbell recorder helped save people's lives.

    Since ring cameras are set for a recording distance they can be set to record when someone enters your property , so this does not apply, if you have a snap shot then yes you may fall foul but it is so easy to once every few days just wipe the history then you are complying

    My home security system was installed by a registered professional company. At quite a considerable monthly expense, considering the times we are now living in, this is also monitored 24/7 by the company. There is ample warning signs on the front, side, and rear of my property, these are quite large signs stating that recording equipment is being used and monitored, this is of course motion detected. As this was set up by a company which I'm sure, abided by all the current legislation, how could I be held responsible for any infringements of the law?

    I've previously told people that whilst in public you may record but that people filmed have certain legal rights more so when there are 'auditors' who believe they can film anywhere anytime they choose. However, when on any private property those rules change dramatically as in one case, a young man whom was filming BTP at a rail station decided to do so, as such I spoke to him privately and explained the Same rules seeing as he jumped train from paying his ticket. The result ended well and actually de-escalate the situation that was building with positive results all round.

      God bless America. Here people know and understand that it is your sole responsibility to protect your own privacy. If you or your private dwelling has anything in view from the public or private property I own, I am protected if I film it. If it’s visible from any place I’m allowed to be, then I can film it. Don’t want me to film it? Cover it up.

    One of my friends has a ring doorbell and other cctv which captures the road outside and the neighbour's property. This was really lucky for her neighbour, as she captured a thief stealing something from her neighbour's car parked outside on her neighbour's driveway. Now, if that camera had been restricted, the thief would have got away completely free. We are tripping over ourselves with all this GDPR.

      If your CCTV system captures images of people outside the boundary of your private domestic property - for example, from neighbours’ homes or gardens, shared spaces, or from public areas - then the GDPR and the DPA will apply to you.

    I use EUFY cameras which have onboard storage and I don't have to pay ring a monthly fee.
    They have AI detection zones so they only detect and record movement in those areas

    I do wish that Ring had no-view zones, so that you can set certain areas to appear blank. If it were to generate a single snapshot of the area and a web link so that anyone can see what areas are set to blank and when they were changed, you could stick a card through neighbours doors giving them the confidence that you aren’t watching them.

      @@ImAnAutie I believe that all you can do is limit the distance that a warning chime is given at when someonee is at your door ... that the camera films beyond this! If you have evidence this isn't the case, please show it.

      @@alanharvey9720 it only limits the triggering. But the ring can tell you when it start recording now. It’s called Motion Warnings (not being confused with Motion Alerts. Warnings are for those being recorded while Alerts is for the home occupant).
      You only have to watch the Ring Doorbell News channel on UA-cam to see how useful these things are, and how many dangers are out there.

    The neighbor upstairs from my apartment came down one day and recorded at my door for the simple fact that I supposedly had loud music, she never called the police but she went to the Manager of the complex and showed her the video. So I had to give myself the mission to buy a Ringdorbell because she insists on making my life impossible.

    I have done the SIA Licensing course, and don't currently have use for what I'm about to ask (Which wasn't in the course for my CCTV Licence 8 Years ago) But my old neighbours would have use for the answer:
    Example before I moved Cannabis was still classed as a Class B drug. (Not sure if that is still the case)
    The next door neighbour kept smoking Cannabis 2 - 6x a day stinking up the neighbourhood I was never able to catch them in the act, and the neighbour on the other side of the junkies made a police report regarding the illegal stench; after which wound up with a ton of grief (which included rocks/bricks through windows and keyed car doors)
    With the stuff listed above would there be anyway to use the ring system to protect/record what happens in the parking area. (Use it as a deterrent) and record the neighbours when they commit the illegal acts?

      Several complaints to the police of the stink of weed should have been enough for numerous visits to the address by the police. It is not upto you to catch them in the act, and what you going to do? Get them in a full nelson and scream citizens arrest until the police come? cctv is never going to catch them smoking weed,as from video alone weed could easily be bog standard roll up. As for a camera pointed at a car park, that would take an expensive camera to pick up and identify a face from any real distance. So cctv could work for someone putting a brick through a window, but not for detecting if its a joint or a rolly.

      @@archie2archie If they need a PTZ camera they wouldn't have to buy one, they could have my PTZ camera. Boxed as new and never used. It wasn't that expensive at the time: approx £300.00 Granted I'd have to post it, I now live 158Miles from Stevenage. (Where the police do nothing because the dealers infiltrated them years ago, thus calling them only gives the caller grief unless the caller overwhelming has proof)

    We stopped using ours to record when Ring increased their subscription by 80%.
    It’s now purely a doorbell.
    With the saved money there are numerous, reliable DVR kits that record footage to a hard drive.

    The issue with the privacy blocking feature is that it also doesn't record anything you would want captured in that section aswell so its not really an ideal "fix" and besides, in the case of the image you used as an example, you can still very clearly tell who is coming and going from that property anyway so blanking it out really doesn't do anything, our neighbours door is currently captured on ours at the side of the frame, blocking out their house would render the doorbell basically useless for our own needs as we have to position the doorbell in such a way that it captures both of our front doors
    That being said the only time anything would be saved from that doorbell is when someone actually rings our doorbell so the neighbours would have to be standing there at that time lol

      It's more so that when the person opens the door you're not seeing directly into the flat. It would almost be like having a camera directly into someone's window.

      Most of this advice is about how to stay outwith the scope of UKGDPR, by being purely domestic. If you're not purely domestic, you just have to comply with UKGDPR by having a legitimate reason, telling people what you're doing etc. Dashcams are an anomaly really, but so far aren't considered to be cctv, thankfully.

    It's been documented on crime programmes on television so many times that police ask home owners for any cctv evidence they may have of suspects/criminals passing by in tbe Street and are grateful for this footage to solve crimes, so where does that leave the home owner/resident that owns the CCTV system in law when it's captured criminal activity outside the boundries of their property?
