Blind doesn't always mean no vision at all. Most people who are legally blind can still see shapes etc. so if he knows there's a sign on the east side of his house, he can easily point at it from a distance

My great uncle was blind when I took care of him outside he had to have his walking stick no matter what. Everyday situations outside are totally different from inside situations. I don't walk outside everyday and it's raining no, changes day to day

he is crazier lol. A lot of people live in these places because they simply can't live in the city so the nutter ratio is often higher. The police take 40 minutes if they hurry so it is a different reality in these backwoods places. Your comment is still valid though for sure.

I think around 2000 they took away the 'shooting in the back' law in texas (I think) so basically you could shoot at will and only had to show they were there for no good, and the burglary rate instantly dropped by some huge margin. Was current news when I was there then if I remember.

But it would be an accurate to say that you could “shoot at will and only had to show they were there for no good.” Under common law there is a “inferred principle” of the right to self-preservation. Being that while an act of great bodily harm is being done to you, you may use deadly force to defend your own life. In Practice even this definition can be too big.
A hypothetical situation where two strangers in a train station get into a fight. Jones is ontop of Smith on the ground, Jones was the aggravator, Smith was breaking no law while being in the area where he confronted Jones, neither did Smith agitate Jones. Jones has struck Smiths several times in the head, Smith is bleeding, his skull is fractured. Jones raises his fist up to strike Smith again, a gunshot, Smith has fired a single bullet killing Jones. Seems pretty cut and dry right? It would be a defense to Smith to say that he was in fear for his life, AND was in imminent peril. However by definition Jones did not exert deadly force, as Smith survived. Perhaps Smith has no permanent injuries. I mentioned above that Smith was bleeding and his skull was fractured, are we certain that Jones caused that or is Smith in blood thinners and has prior skull injuries. Further if the injuries were not serious could we not conclude that Jones intended to not leave serious injuries on Smith? That Jones, a benevolent giant of a man misunderstood by the people around him, was sparked to anger, and leapt toward Smith, swinging and connecting with his head. Smith fell backward and Jones fell upon him. Jones now felt the gun in Smiths pocket, fearing for his life he struck Smith again, before the inevitable; a single full metal jacket tore through Jones sternum, ending not only his life but his dream and love for the very people who doubted him. Smith was a heartless man, who had no care for the sanctity of life! He knew full well that Jones had no intention of killing him, but he sprang upon the opportunity like a hyena, cackling as realized he has been able to take another life. Jones, committed assault, and here see the battery upon Smiths face. And still Smith murdered him. Smith never feared for his life, Jones never intended to take it. It was a mutual understanding between two men to fight, and Smith betrayed that trust. Boom conviction, 2nd degree manslaughter.
Of course that seems ridiculous, and “that seems ridiculous” is a valid legal argument. The “reasonable person” is a sacred standard with in law, which simply asks “would a reasonable personal think this, or do that, or believe such and such”. I believe a reasonable person would feel their life in danger underneath Jones.
Now instead, before the fight happened Smith looked up and saw Jones, he turned and ran. He was much faster than Jones, and yet he turned after gaining a significant distance and shot Jones once killing him. Was Smith the aggressor? Certainly he COULD have run. And if we do not place the duty to flee on Smith could we place it on Usain Bolt, definitely this is a man who can run.
And this idea “duty to retreat” is where we find Castle Doctrine. Duty to retreat places the responsibility on the victim of a crime, to if at all possible, retreat from conflict and resolve the issue at a later time.
In states that grant a Stand your ground doctrine, the ability to retreat is irrelevant, if you believe you are in harms way you may use force appropriate to defend yourself in like kind.
Castle doctrine extends further protection when you are “in your castle” which is commonly your home, vehicle, or place of work but theoretically could extend elsewhere.
Castle doctrine can be applied to protect the use “deadly force” regardless of the threat you may or may not believe faces you. Even if prosecution could prove beyond a reasonable doubt, that you were aware the home invader was coming in only to verbally berate you, and you the home owner knew this, deadly force is authorized as the act of entering the castle is by definition great harm.
Texas has one of the strongest castle doctrines which theoretically even extends use of deadly force to recapture property which was taken from me. In other words if you return home, from the street see that your door is kicked open, you are not in danger of great harm so duty to retreat is already irrelevant. However you would be authorized to enter your home, initiating a fight with any home invaders, and use deadly force, as the act of breaching your castle was a direct great harm done to you.

TEZ wrong. It Varies on state to state but in general you CANNOT use deadly force to protect property. But a trespasser in your house at night that may cause you to fear for your life is another story.

Really what should have been done is the officer bring the guy to the blind dudes house so they could talk it out since it was a misunderstanding and they are neighbors and then if the blind dude still wanted him trespassed then they could file that paperwork.

I mean tbf I can see how a blind person wondering around a fence could be misconstrued as a potential burgler. The body movement and mannerisms could look unusual to the passerby, and he could just assume there's a potential issue.
