How should we state the number of days that they will be away, since it is not a sustained absence? when you say "continues physical presence" you mean "continues residence" not "physical presence" right? because physical presence is a minor issue as it only counts days within 5 years (you have to accumulate at least 50%), "continues residence", that is the problem. So the re-entry permit does not avoid the reset of the clock if you are absent from the country for one year or more in one trip, right? It only prevents that they cancel your LPR status, right?

Hi maneesha , thank you so much for the informative video . I got green.card in 2003 and since then applied for reentry permit 3 times not qualified for citizenship. But since 2018 I have been in usa not less than six months every year till date overall staying for 36 months in 5 years but in 2020ive been in my native country for nearly an year during pandemic . My husband age is 72 years and hence could not take a chance of tranvelling . Will that be considered and will we be eligible to apply for citizenship or will it be considered from 2021

The form can’t be filed online, you can leave the US once you get your fingerprints taken but not sooner. Depending on your location, there’s a mailing address for each state, check it out in the i131 page in the uscis page

My 2 cents, apply for it. Having the documents in order is a great way of showing customs and immigration officers that you are not intending to abandon your green card. Technically, after 6 months abroad your residency status may come into question when you try re-entering the USA.

Hi Maneesha, thanks for your great video. I have a quick question. Once I submit my I-131, I would like for the USCIS communications including receipt notice, biometrics appointment and the reentry permit to be mailed to my friend's address since we may not be around during the process.
Is it OK if I put my friend's address in Part 1? I am worried, because then the "Physical Address" I put on this form will not be the same as the address that USCIS already has as my home address.
I got info from another attorney that we can provide an address of our home country consulate or embassy so USCIS deliver there and than we can collect it from there

Yes, that is really an option to have it sent to the consulate/embassy in your country and then collect it from there or have the consulate/embassy to mail it to you in your country. However, I did not want to do that because I am traveling a lot. I just wanted it to be delivered to my US mailing address (i.e. my friend's place). Most USCIS forms let you list both a mailing and a physical address but this one does not. So, I decided to put my mailing address on this form in the place allocated for the physical address and then I attached a cover letter and explained why I did it and that this is my mailing address and my physical address is XXX. So far, it has been fine and I have received the receipt notice at my mailing address. I will wait and see how next steps go and will let you know whehter it completes without a problem or not.

No, re-entry permits have to be applied for before you leave the country. If the green card holder left the country with the intention of coming back and then got stuck outside for more than a year, they should look into SB1 visas. I would consult an attorney - details matter so best to run your particular situation by an experienced attorney (I am not an attorney, I work in the industry and am happy to recommend a few if you'd like a consult)

hi Do you need the two passport size photo for the re-entry permit?
If you look online all kinds of immigration lawyers will tell you 'yes'. However, I don't think you need photos. Looking at the USCIS instructions for form I-131, if you are applying for a re-entry permit for lawful permanent residents of the United States, it is clear (for various reasons) that you don't need supply photos. On the other hand, if the person at USCIS does not know the instructions themselves, they may mistakenly require photos and deny (or at least delay) the application.
So, to be on the safe side, just spend the 20 dollars or so and get two passport photos.

More explanation: Photos are required for Refugee Travel Documents and Advance Parole Documents. Such applicants will not have a Biometrics appointment, where their photos would be taken (hence, they also don't pay the Biometrics fee of 85 dollars, but only the application fee of 575 dollars). That is why USCIS needs the photos. A Green Card holder has their biometrics already stored in a USCIS database and is also supplying a photo of their Green Card (and passport information page) that contain photos of the applicant and will have their photo taken at the Biometrics appointment. So, logically, there is no reason whatsoever, to include photos in your application. I successfully applied for a re-entry permit in 2019 and did supply photos. However, those photos were probably just thrown away. The photo that appeared in the re-entry travel document is the one that was taken at the Biometrics appointment and not the one that I had included in my re-entry permit application. In fact, when I returned to the US in 2021 after two years and renewed my Green Card online, they did not require new Biometrics (photos + fingerprints) as they already had those from my re-entry permit application and those to them were recent enough.
All in all, be on the safe side and supply photos. I would. But you really should not have to.
To give you a German example. I went to a German embassy to renew my passport not for the first time. They wanted a birth certificate despite the fact that the German Foreign Ministry website is very clear about this only being a requirement if you apply for a German passport for the first time. Although this was not my first time, they still asked for one. I pointed out the rules to them and the person at the embassy mumbled something to the extent that the German Foreign Ministry was wrong, can you believe it. In any case, I don't even have a birth certificate to start with, so did not supply one, and still got my passport without any issues. Just know that bureaucrats that don't know what they are doing may make your life difficult even if you are right and they are wrong. So, why take the risk.
