The plaintiff knew damn well, She can't build a fence on somebody else's property. She just thought she'd get away with it.
The plaintiff was confident she could move her fence onto her neighbor's property without consequences because she is white and her neighbor is black.

Yes. Especially if it's something your neighbors are going to see. Even if it's in your legal right (on your property), it's not a bad idea to just go over there and ask/talk about it. You're living next to them. Might as well make sure they're in the loop.

@@casual35 that's true. However, when you're advise that it wasn't on the correct property line. That's when She should've got two consults for two different companies then. Even if it was an honest mistake. Fit it. Don't take your neighbor to court even after the fact. She knew she was wrong. She should've apologized for the inconvenience. And did the right thing and the whole world wouldn't know about this misunderstood event.

"Take the fence down, I don't have to explain why"...no one would say it that way. The fact that they removed it in the middle of the night is hilarious.

Hmmm I’m not sure yet, but I get the impression plaintiff put the fence up without much input from the defendants and is annoyed by their resistance after it was installed. It doesn’t seem like she actually sat down with them, more like on the day of: “hey guys this fence is here what do you think even though it’s going up anyway”. I could be wrong though.

My daughter bought a farm house in a tiny community. She had the land surveyed and noticed the neighbor was encroaching her property with trash. She contacted authorities and they told her that if his stuff remained on her property he would own that piece of her property. She had to hire a lawyer to fight it and she won. Protect yourself and get a survey!
