    Im in the same situation right now. Im not at fault and the damages to my vehicle shows i was the person that got hit. But the other driver is not accepting fault.

    I came over railroad tracks and was crossing the street that ran parallel to the tracks, the other driver had a stop sign which said traffic coming over the tracks does not stop. She ran right into the side of my car. She admitted to the police that the accident was her fault. I just had liability issurance and my carrier said they would do nothing. Her issurance carrier kept blaming me for the accident, I guess federal law is nothing but shit.

    Is it worth the hassle of proving not at fault of an accident in a No fault state? No injuries involved

    • @ZarzaurLawPA
      @ZarzaurLawPA  10 місяців тому

      Without a permanent injury as a result of a car accident, there cannot be a claim. If you do have a permanent injury, PIP (personal injury protection) covers you regardless of whether you are at-fault in a crash, up to the limits of your policy.

    After accident other driver said my fault bro while I was recording with my cellphone... can I use this in court to prove I'm not at fault

      Thank you for tuning in and for your question. Yes, you can certainly use the recorded video on your cell phone in court to prove that you were not at fault for the car accident.

      @@ZarzaurLawPA No, @SHIZZOTHEPRO said he recorded AUDIO of someone saying "my fault." That is AUDIO and is NOT ALLOWED, at least in 2-party-consent states.. ILLEGAL to record audio in a 2-party consent state without PRIOR CONSENT (and who would give that?) . For example,, in California, the person who audio records someone without prior consent from that person will be charged with an Invasion of Privacy crime , which is in the " California Penal Code. Chapter 1.5 Section 631 (a) and is punishable by a fine up to $2,500 or by imprisonment in the county jail not exceeding one year or by fine AND imprisonment. Subsequent offenses are punishable by a fine not exceeding $10,000 or by imprisonment in the county jail not exceeding one year...or by fine and imprisonment." Then, if the person who has recorded the audio is also guilty of something else (maybe they don't have proof of insurance, which is also a crime) . well, let's just say they are stupid if they try to use cellphone audio, at least in states where it is not allowed.

      @@youtubewatcher1135And that’s why I think that’s a very flawed law. You can literally have someone admitting fault to something and because of a law like that, they won’t serve time for their crime.
